Abstract

The purpose of this research is first to describe the implementation of the 2024 General Election and, secondly, to describe the role of the younger generation in participatory supervision of the 2024 General Election. The normative legal research method uses legal materials as the main source, carried out using the philosophical, statute, conceptual, and historical approaches. The research results show that the 2024 general election will be the same as the 2019 election, namely that the legislative and presidential elections (Pilpres) will be held simultaneously. The legal basis for holding the 2024 General Election is the same as the 2019 General Election, namely Law Number 7 of 2017 concerning General Elections (Election Law). The 2024 general election stages begin on June 14, 2022; by Article 167 paragraph (6) of the Election Law, the general election stages begin 20 months before voting day, while voting day is February 14, 2024. Second, supervision of implementing general elections is a desire based on noble concerns (ultimate concerns), to achieve quality general elections. The existence of Bawaslu has experienced significant changes from time to time, which is a sign that its existence is very important for upholding general election justice. The limited number of supervisors is still one of the obstacles for Bawaslu in carrying out supervision at all stages of the general election. The younger generation's involvement in election supervision carried out by Bawaslu is participatory. Participatory supervision is generally described as a joint collective effort involving various components of society to supervise the implementation of general elections. The role of the young generation as participatory observers in general elections is to be able to provide initial information on suspected general election violations, participate in supervising/monitoring the implementation of general elections, prevent general election violations, and report suspected general election violations.

Abstract

Article 468 paragraph (3) of the Election Law mandates that Bawaslu and its regional offices carry out the Settlement of Election Process Disputes (PSPP) through mediation or deliberation and consensus. This mediation is not optional but obligatory, aiming to reach an amicable agreement between the disputing parties. This process reflects Indonesia's local wisdom in resolving disputes peacefully through deliberation. Mediation or deliberation embodies Indonesia’s local wisdom in peacefully resolving disputes, providing psychological and political peace of mind for the parties involved through a win-win solution approach. In PSPP, mediation is prioritized to achieve a fair agreement for all disputing parties. The method used is normative juridical and employs descriptive analysis. In the 2024 elections, the number of PSPP applications decreased significantly, but the quality of dispute resolution through mediation improved. According to Bawaslu RI data as of March 25, 2024, 64.46% of disputes at the stage of determining the Provisional Candidate List (DCS) and the Final Candidate List (DCT) were resolved through mediation, 83.87% at the stage of changes to the DCT, and 97.34% for the Settlement of Disputes between Election Participants (PSAP). For the verification and determination of political parties, 16.67% were resolved through mediation. This success was supported by mediator training, the enhancement of election supervisors’ capacities, as well as representative technical guidelines from Bawaslu RI, along with the strong commitment of all election supervisors.

Abstract

One of the campaign methods in the 2024 election is campaigning through social media. In order for the implementation of the Election Campaign to run well and in accordance with the applicable laws and regulations, it is necessary to conduct supervision. Bawaslu is tasked with supervising the implementation of election campaigns, including monitoring campaigns on social media. The purpose of this research is first to describe the 2024 General Election Campaign through social media; second, to describe the Supervision of the 2024 General Election Campaign through social media. The method of normative legal research (legalresearch) using legal materials as the main source. The results of the study show that first, The presence of social media as a tool for disseminating information aimed at the public or voters in elections is considered an effective and important step, especially in shaping opinions and setting political agendas. In Central Kalimantan Province, there are four Social Media platforms registered and used by 2024 Election participants, including Instagram, Facebook, Tiktok, and Youtube. In Central Kalimantan Province there are 86 social media platforms for political parties and legislative candidate members. Second, Bawaslu of Central Kalimantan Province has formed a team to monitor the campaign via social media accounts during the 2024 Election stages. The large number of accounts on social media is an obstacle for Bawaslu to supervise campaigns on social media. Campaigns on social media are certainly in separable from the possibility of campaign violations on social media, including hoaxs or hate speech. The Election Law has not specifically regulated the limitations/prohibitions related to campaign violations on social media.

Abstract

Peningkatan kapasitas dan kapabilitas jajaran pengawas pemilu dilakukan melalui Evaluasi kinerja pelaksanaan Penyelesaian Sengketa Proses Pemilu pada pemilu Tahun 2024. Bawaslu memiliki kewenangan untuk menyelesaikan sengketa proses pemilu. Kegiatan evaluasi ini bertujuan untuk mengetahui kelemahan, kekuatan, peluang dan tantangan yang dapat dijadikan sebagai pedoman dalam pelaksanaan penyelesaian sengketa proses pemilu berikutnya. Kegiatan ini melibatkan Ketua, Anggota dan staf dari 14 Kabupaten/Kota yang berada di Provinsi Kalimantan Tengah dan dilanjutkan dengan kegiatan yang melibatakan Ketua dan Anggota Panitia Pengawas pemilu Tingkat Kecamatan se-kabupaten Kapuas. Kegiatan yang dilaksankan di Palangka Raya dan Kapuas meliputi pemaparan materi dan tanya jawab. Melalui program PKM ini, diharapkan Kegiatan ini dapat bermanfaat bagi pelaksanaan tugas jajaran pengawas Pemilu pada tahap berikutnya yaitu Pemilihan Kepala Daerah yang telah memasuki tahapan pada tahun 2024 ini.
