Abstract

The urgency of this research is to examine the implementation of the Supreme of the Court Circular Number 3 2015 on the addition of livelihoods for children from 10% to 20% per year. Since the determination Supreme of the Court Circular in the Family Court of Sawahlunto, in 2018 were 7 decisions have been made, 3 to applicated and 4 doesn’t. The inequality when considering the jury leads to three fundamental questions: What is the position of Supreme of the Court Circular in the concept of the positivist legal philosophy? What are the Judges considerations to implementing and not implementing Supreme of the Court Circular? Howabout the Islamic Law perspective to Supreme of the Court Circular in terms of adding child livelihood? To answer the object of research, the implementation Supreme of the Court Circular Family Court Sawahlunto is extensively examined as sociological/ empirical legal research. The results of this research philosophically Supreme of the Court Circular is a harmonization between Islamic law and positive law, on the condition that Supreme of the Court Circular offers the jury a guarantee of legal certainty when deciding on the addition of a child. Consideration of the jury in the implementation of Supreme of the Court Circular to ensure that children's livelihoods are met in terms of economic needs that further improve and maintain descendant relationships for those who do not implement Supreme of the Court Circular due to the limited ability of their fathers. Supreme of the Court Circular’s perspective on Islamic law regarding the addition of a child at 10% to 20% per year is relevant to the problem of the Maslahah Mursalah, which is to maintain hereditary relationships.

Abstract

This study examines the Fulfillment of Human Rights by the City Government of Bukittinggi on Human Rights. Review of Siyasah Dustiriyah. The problem is how to fulfill the human rights of street vendors (hereinafter written as PKL) by the City Government of Bukittinggi, and how to review the dusturiyah siyasa of the fulfillment of human rights to street vendors. This research is a type of empirical juridical research or field (field research). The sources of this research consist of primary data sources, namely the Head of the Legal Division in Bukittinggi City, the Civil Service Police Unit (hereinafter written as SATPOL PP) Bukittinggi City, street vendors and secondary data, namely scientific books, research results and related legislation. with research. Data collection techniques are interviews and documentation. After the data was obtained, then the data were analyzed using a qualitative descriptive method. To ensure the validity of the data, a data credibility test was used which was carried out through triangulation. Efforts to fulfill the human rights of street vendors by the Bukittinggi City Government have been carried out, the first such as facilitating a place to sell for street vendors, such as the kiosks that have been built by the Bukittinggi City Government, precisely in a row of roads located in the Aua Tajungkang Village, Tangah Sawah District, Guguak Panjang City. In Bukittinggi, the two street vendors are required to pay the rental fee for the kiosk they occupy every month to the Bukittinggi City Market Service Office, then for street vendors who are still selling in places that are not designated for them to trade, they will be given sanctions, such as verbal warnings by the Satpol PP. Siyasah dusturiyah explains the making of laws and regulations, where the concept explains the application of Islamic law to obey the rules that have been made by the government. In the city of Bukttinggi, the Government has issued Regional Regulation Number 8 of 2014 concerning the Arrangement and Empowerment of Street Vendors. As the Regional Regulation has not been able to fully cover the fulfillment of human rights, so it seems that the Government has not provided fulfillment and justice to street vendors and the actions taken by law enforcement officers who have not been corrected in carrying out their duties.

Abstract

 The promulgation of the Marriage Law is as a tool of social engineering or an instrument to regulate the community and as a guideline for the community to carry out a marriage. So those friendships that are carried out are not based on or violate religious law contained in the Marriage Law deemed invalid, one of which is interfaith marriages. The diversity of Indonesian society has been regulated by several provisions and diverse institutions, moreover related to the requirements of marriage. The occurrence of social facts in the form of violation of the regulations of marriage in the way of interfaith marriages according to the Sociological jurisprudence school is the result of proper gradation, morals which have been the basis for the formation of law. If ethics or morals become evil, it will result in bad behavior, both the behavior of individuals, groups and state officials.

Abstract

The State Civil Apparatus (ASN) is an occupation for civil servants and government employes with employment contracts who work for government agencies and play a very fundamental role in maintaining the unitary state of the Republic of Indonesia. ASN urgencies include the implementation of public policies, civil servants and the connected the nation must be able to act as organizers of government and developmental missions through the implementation of policies and professional public services. In fulfilling its function as a link and unification of the nation, ASN must strive to protect the integrity of the unitary state of the Republic of Indonesia from terrorism crimes that can break the sovereignty anchored in Bineka Tunggal Ika. Dirrect speak and written expressions of opinions on social media don’t contain elements of hate speech against to Pancasila, the Constitution, Bhineka Tunggal Ika, the Unified State of the Republic of Indonesia and the government. Don’t convey information that shows the nuances of hate speech against ethnicity, race, religion, and between groups. ASN doesn’t participate in activities that lead to insult, incitement, provocation or hatred of Pancasila, the Constitution, Bhineka Tunggal Ika, the Unified State of the Republic of Indonesia and the government.

Abstract

The politicization of religion in general elections has been a global issue in both religious and secular countries. Since 1955 to 2019, Indonesia experienced political contests laden with religious attributes, which sparked conflicts. This research aims to analyze the relevant issues and motives associated with using religious elements in the presidential election campaign 2019. This study  is  empirical  research  and  involves  interviews  with  high-level  officials of  political  parties.  Furthermore,  the  online  mass  media,  official  blogs  of candidate  pairs  for  president  and  vice  president,  and  social  media  were employed  as  secondary  data.  Following  the  analysis,  the  result  implies  that the politicization of religion in the 2019 presidential election campaign firmly appears  amidst  the  decline  of  presidential  and  vice  presidential  candidates' religious  polarization.  The  use  of  religious  issues  in  the  campaign  yielded public  sympathy  and  antipathy,  affecting  the  electability  of  presidential and  vice  presidential  candidates.  Meanwhile,  counter-elements  contradict negative images that discredit presidential and vice presidential candidates. The motives for politicizing religion were identified as "political pragmatism" and "culturalism politics". Ideological interest was also identified as a motive but  did  not  arise  in  the  2019  presidential  election.  From  siyāsah  shar'iyyah perspective, the politicization of religion could threaten the sharia objective of  creating  social  advantage  (maṣlaḥah).  Politicization  using  religious  issues amounts  to  religious  commodification,  which  is  irrelevant  to  the  sharia objective.Keywords: politization of religion; campaign; presidential election; siyāsah shar'iyyah AbstrakPolitisasi agama dalam pemilihan umum telah menjadi isu global di banyak negara, baik negara-negara berbasis agama maupun sekuler. Indonesia telah  melaksanakan  pemilihan  umum  sejak  tahun  1955  hingga  2019  dalam prosesnya  banyak  sekali  muncul  isu-isu  keagamaan  yang  menyebabkan terjadinya konflik dan perpecahan. Penelitian ini bertujuan untuk memetakan dan menganalisis isu-isu terbaru dan motif penggunaan isu keagamaan dalam kampanye  Pilpres  2019.  Penelitian  ini  merupakan  penelitian  fenomenologis empiris. Data diperoleh dari pengurus dan anggota partai politik. Selain itu diperoleh dari media cetak, media elektronik, media online/internet seperti blok resmi  pasangan  calon  presiden-calon  wakil  presiden  dan  media  sosial.  Hasil penelitian menemukan bahwa politisasi agama dalam kampanye Pilpres 2019 semakin menguat di tengah melemahnya polarisasi agama. Isu-isu keagamaan dalam  kampanye  telah  menimbulkan  simpati  dan  antipati  publik  sehingga mempengaruhi elektabilitas pasangan calon presiden-calon wakil presiden. Di sisi  lain  isu-isu  yang  mengkonter  berusaha  menormalisasi  citra  negatif  yang dialamatkan  pada  pasangan  calon  presiden-calon  wakil  presiden.  Isu-isu  ini muncul untuk kepentingan sesaat sebagai wujud politik pragmatis, di samping politik kultural. Kepentingan ideologis tetap terbaca walaupun tidak mengemuka secara  transparan,  karena  hambatan  konstitusional.  Dalam  pandangan  siyāsah shar'iyyah, politisasi agama dapat mengancam tujuan syariat untuk mewujudkan kemashlahatan. Politisasi dengan menggunakan isu-isu keagamaan merupakan komodifikasi agama yang tidak sejalan dengan cita-cita syariat itu sendiri.Kata Kunci: politisasi agama; kampanye; pemilihan presiden; siyāsah shar'iyyah

Abstract

This study examines the disharmonization between Tanah Datar Regent Regulation Number 10 of 2021 concerning technical guidelines for regulations in Nagari and West Sumatra Province Regional Regulation Number 7 of 2018 concerning about Nagari. The problem is the Regent regulation does not pay attention to the procedures, order, and hierarchy of laws and regulations, internal factors violate the principle of laws and regulations, namely the principle of “Lex Superior Derogat Legi Inferiori”. The Regent Regulation should guide or adjust to the updated Regional Regulations and display the old regulations. From these problems arise the question of factors causing disharmonization. This research is a field research data obtained through interviews with the legal bureau section of the Tanah Datar Regent office then the data is narrated descriptively. Results are discussed with the theories put forward. This study found that it has violated the rules of blinding laws and regulations, namely the hierarchy of legislation as explained in Law Number 15 of 2019 concerning the Establishment of Laws and Regulations.

Abstract

The main problem of this research is the application of the restoration justice approach to prevent divorce in Nagari Saruaso. The data obtained shows that from 2020-2022 there were 162 divorce cases in Nagari Saruaso, this is a cause for concern. So it takes thought and solutions to anticipate it. So this study aims to provide an alternative to restoring household relations through a Restorative Justice approach to prevent divorce. This type of research is Juridical Sociology with Qualitative Typology, where data obtained from the field is narrated, interpreted to provide answers to the research object. Primary data sources are ninik mamak, religious scholars, cadiak pandai, bundo kanduang and the wali nagari government. Secondary data sources from books, journals, and laws and documents from Wali Nagari. The results of the study revealed, firstly, based on efforts to apply the restoration justice approach to prevent divorce in Nagari Saruaso, it was carried out by involving all components into one forum, namely the involvement of ninik mamak, religious scholars, cadiak pandai and bundo kanduang to provide advice so that divorce does not occur and spouses husband and wife back in harmony. That the concept of applying the Restorative Justice approach is carried out by all the above components through Gondang Sayak and Gondang Kuali to prevent Divorce in Nagari Saruaso. Gondang Sayak is a peace process that only involves the closest family, then Gondang Kuali is an effort to reconcile husband and wife by involving all components such as ninik mamak, pious scholars, cadak smart, bundo kanduang. Abstract

This article was the result of community service in Nagari Tuo Pariangan, Pariangan District, Tanah DatarRegency related to technical assistance in the drafting of the Nagari regulations. The Nagari Regulations are the statutedrafted by the village level legislature (BPRN/BAMUS) and Wali Nagari. Therefore, Nagari Regulations usually haveto be made in accordance with the provisions of laws and regulations. In order to be able to create good NagariRegulation, those who create nagari regulations must have to a holistic and comprehensive understanding of theprocedures for designing nagari regulations since planning untill clarification. The difference from other articles waswrited of this article endowed with a method of devotion participatory action research (PAR) and a shift in legislativefunction at the Nagari level to go to a traditional village.

Abstract

In order to advance knowledge, higher education has a duty to educate all facets of society, including the local population. Additionally, as advancing general welfare is a duty of higher education, these efforts can be carried out through fulfilling duties related to the tri-dharma of higher education, all of which are interconnected and cannot be separated from one another. One of these dharmas is community service, which is why LP2M UIN Mahmud Yunus followed this approach when performing research-based service. Prior study must be done to ensure that the service is modeled, structured, and evaluated in accordance with the needs of the aided community.

Abstract

Putusan Mahkamah Konstitusi Nomor 97/PUU-XIV/2016 merupakan puncak tertinggi pengakuan atas kepercayaan lokal di luar 6 agama resmi dan seharusnya menjadi jaminan kepastian hukum keberadaan kepercayaan lokal dalam bingkai Kebinekaan. Namun fakta hukum yang terjadi tidak demikian karena penganut kepercayaan lokal Sabulungan di Kabupaten Pulauan Mentawai belum mendapatkan jaminan kepastian hukum sebagaimana dikehendaki oleh putusan MK tersebut yaitu terkendala dalam pemenuhan hak keperdataan hanya karena tidak menganut satu dari enam agama resmi di Indonesia. Untuk mengungkap fakta hukum tersebut, peneliti menggunakan penelitian hukum yuridis empiris dan dari hasil penelitian terungkap bahwa Dinas Dukcapil dari 23 jenis layanan yang ada dapat teridentifikasi 8 jenis layanan yang yang berhubungan dengan masyarakat penghayat kepercayaan arat Sabulungan. Kemudian 2 dari tiga Lembaga Keuangan juga telah memberikan perlindungan hak keperdataan kepada penghayat Sabulungan untuk menggunakan fasilitas perbankan. Sementara salah satu bank lainnya belum memberikan pemenuhan hak keperdataan bagi penganut Sabulungan karena sistem pada bank tersebut tidak support.
