Abstract

Abstrak Pendidikan yang rendah yang mengakibatkan butuhnya perlindungan hukum sebab diri manusia ada hak yang perlu dibela. Kasus perdata yang terjadi hari-hari ini pelakunya rata-rata dari kalangan dimana justice for all itu tidak merata. Masalah yang terjadi pada penelitian ini, peneliti mengkaji dan meneliti dengan dalam yang mana tujuannya untuk mengetahui implementasi, faktor pendukung dan faktor penghambat serta perspektif hukum Islam dari peran advokat dalam mewakili klien di Pengadilan Agama Maros. Penelitian ini adalah pendekatan hukum Islam studi lapangan dengan menggunakan pendekatan hukum Islam. Data dikumpulkan dengan metode observasi, wawancara dan dokumentasi yang diolah dengan metode deskiriptif kualitatif. Kesimpulannya, Advokat juga dapat menjadi fasilitator dalam mencari kebenaran dan menegakkan keadilan untuk membela hak asasi manusia dan memberikan pembelaan hukum yang bersifat bebas dan mandiri. Namun kenyataannya di masyarakat profesi advokat terkadang menimbulkan pro dan kontra, terutama yang berkaitan dengan perannya dalam memberikan jasa hukum, Oleh karena itu seorang advokat yang akan melakukan praktek di pengadilan agama khususnya untuk mendampingi atau menjadi kuasa atas nama kliennya agar mendapat simpatik masyarakat, tentu harus mengikuti hukum acara yang berlaku di Pengadilan Agama. Dengan mengikuti aturan ini dapat meminimalkan praktek yang menyimpang, sehingga dapat dipertanggungjawabkan prosedurnya. Kata kunci: Advokat, Klien, Hukum Islam. Abstract Undeveloped education in society causes a need for legal protection because human beings have rights that must be defended. In the civil cases that occur these days, the perpetrators are mostly from groups where justice for all is not evenly distributed. The problem that arises in this research is that the researcher examines and examines the purpose of which is to determine the implementation, supporting factors, and inhibiting factors as well as the perspective of Islamic law on the role of a lawyer in the representation of clients in the Religious Maros. Search. This research is a field study on the approach to Islamic law using the Islamic legal approach. Data were collected through observations, interviews, and documentation which were processed using qualitative descriptive methods. In conclusion, lawyers can also become facilitators in seeking the truth and maintaining justice to defend human rights and provide free and independent legal defense. However, the reality is that in society, the legal profession sometimes raises pros and cons, especially when it comes to its role in the provision of legal services. follow the procedural laws in force in religious courts. Abstract

Mangngade or carrying out customs is a community activity in Mattampawalie Village, Lappariaja District, Bone Regency which is carried out every year in December and January. The problems raised in this study, namely how the process of the manggade ceremony is, and the factors that encourage people to work on the mannggade tradition, as well as the values ​​of Islamic law in the mannggade tradition. There are three stages in the manggade procession, namely mabbaji-baji (the process of cleaning the ritual place), mannggade sokko, mannggade beppa (cake). In mannggade the community performs prayers related to agriculture, in order to avoid natural disasters, gain peace, safety and success in personal life. The data collection methods used are ethnographic methods, archaeological data recording, and documentation. The results of observations, interviews, and data observations were then analyzed using concepts in Islamic culture and law. Based on these data, it was finally concluded that mannggade is one of the traditions that are still carried out by the people of Mattampawalie Village from generation to generation from their ancestors in building recognition of the existence of their group.

Abstract

The tension between statutory marriage registration requirements and the socio-religious legitimacy of nikah siri (unregistered marriages) continues to create challenges in the implementation of family law in Indonesia. This article critically examines the judicial reasoning employed by judges of the Makassar Class IA Religious Court in adjudicating isbat nikah (judicial validation of unregistered marriage) cases from the perspective of maslahah. This study employs normative juridical research using case-based and conceptual approaches, with judicial decisions and statutory regulations analyzed as primary legal materials. The findings reveal that the adjudication of isbat nikah cases extends beyond procedural-administrative considerations through responsive judicial reasoning grounded in maslahah. Judges utilize isbat nikah mechanisms to protect children’s legal identity and civil rights through the principle of hifz al-nasl (protection of lineage), while also reconciling tensions between state legal formalism and socially embedded Islamic marital practices. In certain cases, applications are rejected to prevent procedural abuse and legal circumvention based on the principle of dar’ al-mafasid (prevention of harm). This study demonstrates that maslahah functions as a foundational framework of judicial reasoning aimed at realizing legal certainty and substantive justice within plural legal systems.

Abstract

This study examines the effectiveness of legal protection for women victims of domestic violence after divorce and formulates strategies to strengthen substantive justice. Using an empirical juridical approach, the research employed statutory, case, and conceptual analyses. Primary data were collected through interviews with religious court judges, court clerks, advocates, and victims of domestic violence, supported by courtroom observations, while secondary data were derived from legislation, court decisions, Badilag documents, and relevant literature. The findings reveal that legal protection remains ineffective due to weak implementation structures, limited victim-centered perspectives among legal officials, and persistent legal cultures that treat domestic violence as a private matter. The study further finds that religious courts have not fully integrated gender-sensitive and recovery-oriented approaches into post-divorce dispute resolution. To address these challenges, the research proposes strengthening victim-oriented regulations, improving judicial capacity through gender justice training, expanding access to legal aid services, and promoting women’s socio-economic empowerment after divorce. The study concludes that substantive justice for women victims of domestic violence requires an integrative legal framework that combines responsive legal norms, effective judicial practices, and broader social transformation to ensure comprehensive protection, recovery, and access to justice.
