Abstract

In its initial period of enactment, the 1945 Constitution emphasized that Indonesia was a legal state. This is stated in several provisions therein, namely Article 27 paragraph (1) and the Explanation of the 1945 Constitution. Entering the reform era which resulted in constitutional amendments, provisions regarding the rule of law are contained in Article 1 paragraph (3) and Article 28D paragraph (1) of the 1945 Constitution The task of the rule of law then is to ensure that law enforcement is achieved. Law enforcement is largely determined by legal culture, because the existence of law is largely determined by legal culture in the form of community values, views and attitudes. Meanwhile, the goal of the state as a mandate for independence, as reflected in the fourth paragraph of the Preamble to the 1945 Constitution, aims at an ideal form of society, namely civil society. Imbued with the spirit of 78 years of independence of the Republic of Indonesia, this article presents efforts to build a legal culture and create a civil society. To achieve these two efforts, several provisions in Law Number 17 of 2007 concerning the 2005-2025 National Long Term Development Plan can be the main reference.

Abstract

Sebagai penganut demokrasi, Indonesia menempatkan kekuasaan tertinggi berada di tangan rakyat. Rakyat mempunyai peran penting dalam kehidupan berbangsa dan bernegara. Kontribusi rakyat sebagai pemegang kekuasaan tertinggi dalam suatu negara, secara teoritis dapat diwujudkan melalui dua model, yaitu secara langsung ataupun keterwakilan melalui lembaga-lembaga tertentu sebagai mandataris rakyat. Model kedua dipilih oleh Indonesia dalam menempatkan kedaulatan rakyat. Sehingga, kedaulatan yang dimiliki rakyat sedikit banyak dibatasi dan hanya dapat direalisasikan secara tidak langsung melalui lembaga-lembaga perwakilan. Padahal, sesungguhnya peran aktif rakyat dalam pemerintahan amatlah penting, mengingat sejatinya negara itu dibuat oleh rakyat, dari rakyat, dan ditujukan untuk sebesar-besarnya kesejahteraan rakyat.  Indonesia juga merupakan penganut civil law system, dimana dalam tradisi ini semua peraturan perundang-undangan yang ada ditetapkan secara tertulis dalam hukum positif.  Berbeda dengan tradisi common law system yang menitikberatkan pada hukum kebiasaan dan putusan hakim terdahulu sebagai dasar dalam memeriksa dan memutus suatu perkara. Gejala adanya transplantasi hukum tengah terjadi dewasa ini. Realitanya civil law system yang dianut Indonesia sedikit demi sedikit mulai bergeser dengan diberlakukannya mekanisme yurisprudensi dalam memeriksa dan memutus gugatan citizen law suit sebagai bentuk kedaulatan rakyat

Abstract

Globalisasi dan dampaknya bagi perekonomian bangsa khususnya pada produk dalam negeri sangat luar biasa. Impor kebutuhan hidup baik kebutuhan primer seperti makanan dan minuman maupun kebutuhan sekunder tersier seperti kosmetik dan lain-lain justru semakin meningkat. Permendag No 57 Tahun 2010 juga seakan tidak berdaya terhadap serbuan produk luar negeri. Harapannya tinggal kepada Pemerintah Daerah, namun kenyataannya, alih-alih melindungi produk lokal, Pemerintah Daerah justru melindungi kepentingan pemodal asing yang ingin menanamkan sahamnya di wilayahnya dan melupakan atau kurang memberikan perhatian terhadap produk lokal. Tulisan ini membincang bagaimana seharusnya Pemerintah Daerah berperan dalam melindungi produk lokal menghadapi globalisasi.

Abstract

Exactly 79 years ago, on August 17, 1945, the independence of the Republic of Indonesia was proclaimed, and in its constitution, the 1945 Constitution, in the Body and Explanation it is emphasized that Indonesia is a state of law. In the Body there are also various provisions that regulate Human Rights. It is recognized that the state of law and human rights are issues that must be discussed in one breath, because there is no state of law without the recognition of human rights and the enforcement of human rights is an unbroken chain with the principles of democracy and the state of law.In the two main axes of the concept of the state of law, Recht Staat and the rule of law, which were both born and developed in Europe, Indonesia carries the concept of the Pancasila state of law. The Pancasila state of law is a concept of a state of law that is based on the noble views and philosophies of life of the Indonesian people from generation to generation. It is also a form of crystallization of views and philosophies of life that are full of noble ethical and moral values as stated in the 1945 Constitution. Recognition as a country of law demands the upholding and implementation of what is ideally organized by a country of law. So it will be studied how to realize a Pancasila country of law that protects Human Rights

Abstract

The constitution was born from the understanding of constitutionalism which limits state power on the one hand and guarantees people's rights on the other hand through constitutional rules. The constitution is where all laws and regulations must depend. Therefore, studying the journey of the Indonesian constitution is important for at least three reasons, namely, first, three constitutions were once in force in Indonesia, namely the 1945 Constitution, the 1949 RIS Constitution and the 1950 Temporary Constitution. From here it can be seen that there was a replacement of the constitution. Second, the 1945 Constitution has undergone 4 amendments in the reform era. And third, there are pros and cons to the results of the amendments in question. With a focus on the government period which is divided into 3 orders, namely the Old Order, the New Order and the Reformation Order, this writing, which is inspired by the increasing constitutional awareness of citizens, wants to study the dynamics of the journey of the constitution from a political and legal perspective

Abstract

The Constitutional Court (Mahkamah Konstitusi) of Indonesia plays a pivotal role as the guardian of the Constitution and the protector of constitutional rights. However, the Court’s ruling in Decision No. 90/PUU-XXI/2023 concerning the age requirements for presidential and vice-presidential candidates has sparked public controversy due to its inconsistency with previous judgments on identical legal provisions. This study critically examines the inconsistency of the Constitutional Court’s reasoning and evaluates the decision’s conformity with the principles of the rule of law and judicial independence. Using a normative juridical method supported by a statute and case approach, the research analyzes primary legal materials, including Constitutional Court decisions, relevant legislation, and judicial ethics regulations. The findings reveal that Decision No. 90/PUU-XXI/2023 deviates from the Court’s prior stance, effectively creating a new legal norm beyond its constitutional mandate, thus blurring the boundaries between judicial review and legislative authority. Furthermore, the proven ethical violations by the Chief Justice have weakened public trust in the integrity of constitutional adjudication. This article argues that such inconsistency undermines the predictability and legitimacy of the Court’s jurisprudence, which are essential to the rule of law. The study contributes to the broader discourse on judicial accountability by emphasizing the need for a coherent interpretive framework and stronger ethical oversight mechanisms to preserve the integrity of Indonesia’s constitutional justice system.

Abstract

The Constitutional Court has passed a decision in the case of petition reviewing Act No.1 of 1974 on Marriage to The 1945 Constitution. Decision is in principle to measure the constitutionality of the provisions of the Mariege Act governing registration of marriages according to the laws and regulations governing children born outside of the marriage. Through juridical analysis, this paper examines the implications of Constitutional Court Decision No. 46/PUU-VII/2010 against marriage law in Indonesia.[Mahkamah Konstitusi telah menjatuhkan putusan dalam perkara permohonan Pengujian Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Pada prinsipnya putusan mengukur konstitusionalitas ketentuan UU Perkawinan yang mengatur pencatatan perkawinan menurut peraturan perundang-undangan dan ketentuan yang mengatur anak yang lahir di luar perkawinan. Abstract

Lingkungan hidup dan sumber daya alam memiliki nilai penting dan strategis bagi manusia dikarenakan manusia merupakan bagian dari lingkungan yang keberadaannya saling mempengaruhi. Maka kebutuhan akan lingkungan hidup yang sehat dan asri harus diupayakan dan diwujudkan. Perlindungan dan pengelolaan lingkungan hidup menjadi sangat penting, terutama di tengah berbagai fenomena lingkungan yang berpotensi merugikan perikehidupan manusia. Penegakan hukum dipandang sangat urgen untuk mencegah maraknya pencemaran dan perusakan lingkungan. Penegakan hukum lingkungan dapat dilakukan secara preventif maupun represif, yang merupakan upaya untuk mencapai ketaatan terhadap peraturan perundang-undangan lingkungan, dengan ruang lingkup meliputi bidang hukum administrasi negara, hukum pidana dan hukum perdata. Penegakan hukum lingkungan melalui instrumen hukum administrasi negara dapat dilakukan dengan beberapa cara yaitu pertama, pengawasan. Kedua, pemberian sanksi administrasi dan ketiga, gugatan melalui Pengadilan Tata Usaha Negara.
