Abstract

Since the beginning of the Reformation Era in 1998, Indonesia has been transforming itself into a more liberal polity than that of in the New Order Era. This political circumstance is characterized by the freedom of opinion and the decentralization of power. During this Reformation Era, many local regulations have been enacted. One of which was sharia by-laws or local regulation based on Islamic norms in some largely Muslim populated regions. This situation has triggered concerns about the impacts of sharia by-laws over the inter-religious harmony among a very diverse society of Indonesia. This study aims to evaluate the sharia by-laws implementation in Pamekasan, Madura, and analyze its implication for inter-religious harmony. By using a qualitative approach and phenomenological descriptive analysis, it reveals that there has not been found negative impacts on the implementation of sharia by-laws since its enactment in 2001 until today. The internal and external potentials of Pamekasan residents, arguably, have become the determinant factor in keeping the by-laws in line with inter-religious harmony. These potentials include cultural-deeply rooted social capitals such as friendliness, politeness, mutual respect, and helping others. Besides, dialogue among religious elites, which is facilitated either by local government or civilian organizations, is frequently conducted and this helps to create a conducive atmosphere for all despite the existence of sharia by-laws in Pamekasan, Madura.Keywords: sharia by-laws, interfaith harmony, social capitals.

Abstract

Tulisan ini merupakan kajian terhadap adanya nuansa politis dalam memahami hadis. Kajian ini menjadi sangat penting karena karena ketika berbicara hadis, maka kita juga akan membincang mengenai orang-orang dan aliran politiknya dalam hadis tersebut yang berakibat pada kontroversi dalam memahami hadis. Metode penelitian ini menggunakan penelitian kualitatif, dimana data-data yang ada kemudian dipahami dan dianalisa dengan menggunakan metode kritik dan historis hadis pada pendekatannya. Sejalan dengan itu tulisan ini memetakan berbagai aliran dalam hadis sekaligus bagaimana pemahaman mereka terhadap suatu hadis. Hasil penelitian memperlihatkan bahwa terdapat setidaknya tiga atau lebih aliran politik dalam kesejarahan hadis yakni Sunni. Syiah, Muawiyah, Muktazilah dan lain lain.  Perbedaan kelompok ini telah menstrukturkan pemahaman terhadap hadis dalam metodologis-historisnya. Perbedaan pemaknaan kelompok ini akan juga sekaligus berkosekuensi pada pemaknaan terhadap hadis itu sendiri. Penelitian ini menyimpulkan bahwa berdasarkan metode dalam ilmu hadis dan sejarahnya, terdapat perbedaan dalam faksi politik dimana perbedaan ini akan berpengaruh pada pemahaman hadis.[Political Nuances in Understanding Hadith: Methodological-Historical Analysis. This paper is a study of the political nuances in understanding hadith. This study is very important because when we talk about hadith, we will also talk about the people and their political flow in the hadith which results in controversy in understanding hadith. This research method uses qualitative research, where the existing data is then understood and analyzed using the critical and historical method of hadith as an approach. So this paper maps out the various schools of hadith as well as their understanding of a hadith. The results show that there are at least two political schools in the history of hadith, namely Sunni. Shia, Muawiyah. The differences in these groups have structured the understanding of hadith in its historical-methodological terms. The difference in the meaning of this group will also have consequences on the meaning of the hadith itself. This study concludes that based on the method in hadith science and its history, there are differences in political factions where these differences will affect the understanding of hadith.]

Abstract

Understanding on the law omission seems controversial; some view it only as an interruption of normal life, and some discern it as an administrative violation. Differences in the understanding may produce difficulties in enforcing the administration of Islamic family law. In line with this context, while mapping forms of the law omission in various community groups, this study analyses reasons for differences of the understanding of it. This study was based on data collected from interviews, FGDs and Google Forms on three different community groups with religious structural characteristics in 4 regencies on Madura Island. This study revealed that social differences and social classes in a society have become a force that structures the society’ views or understanding of the law omission. Differences of the understanding have consequences for the levels of difficulties in enforcing the Islamic family law, especially in the administrative context, such as in cases of registration and dispensation of marriages. Structural differences that exist in a religious society become important to differentiate factors in an interpretation of a reality of life. This paper suggests to expand the observed cases and to provide additional data sources to enable an in-depth and comprehensive understanding of the impact of the law omission in the field of administration of Islamic family law.

Abstract

Artikel ini membahas peran pesantren baik salaf dan modern di Jawa Timur dalam menghadapi krisis lingkungan melalui pendekatan hukum ekonomi islam, ekologi serta teknologi. Pesantren yang dikenal dengan pola pendidikan tradisional dan kurang maju ternyata memiliki kontribusi nyata dalam praktik keberlanjutan lingkungan. Penelitian ini menggunakan pendekatan kualitatif-deskriptif dengan studi kasus pada beberapa pesantren salaf dan modern di wilayah Jawa Timur. Hasil penelitian menunjukkan bahwa pesantren mengembangkan model ekonomi lokal berbasis ekologi seperti pertanian organik, pengelolaan limbah, dan konservasi air yang berakar dari nilai-nilai Islam. Akad-akad dalam fikih muamalah seperti mudaharabah dan wakalah diterapkan pada beberapa unit-unit bisnis yang dimiliki oleh pesantren Sidogiri. Kemudian Pesantren Nurul Jadid Paiton Probolinggo sangat concern pada transaksi cashless dalam memenuhi kebutuhan harian santri. Wakaf produktif juga dikembangkan oleh dunia pesantren untuk menopang produktifitas pesantren ke depan. Aspek teknologi energi terbarukan seperti PLTS juga dipakai agar menjadi solusi kelangkaan energi di masa-masa yang akan datang. Serta ketahanan pangan tidak luput menjadi bagian yang digarap seperti menggunakan sistem pertanian hidroponik agar menciptakan inovasi ramah lingkungan. (This article examines the pivotal role of Islamic boarding schools in East Java, both traditional and modern, in mitigating environmental crises through a multidisciplinary approach that integrates Islamic economic jurisprudence, ecological principles, and technological innovation. Contrary to their reputation for traditionalism and limited modernization, these institutions have demonstrated tangible contributions to sustainable environmental practices. Utilizing a qualitative-descriptive methodology with case studies of select traditional and modern Islamic boarding schools in East Java, this study reveals that these schools have developed localized economic models grounded in ecological sustainability, including organic agriculture, waste management, and water conservation, all informed by Islamic ethical values. The application of Islamic financial contracts such as mudarabah and wakalah in business units operated by the Sidogiri Islamic boarding school exemplifies this approach. Moreover, the Nurul Jadid Islamic boarding school in Probolinggo has implemented cashless transaction systems to efficiently manage student needs. The development of productive waqf by these institutions aims to enhance their long-term productivity. Furthermore, the adoption of renewable energy technologies, such as solar power, is seen as a strategic solution to future energy challenges. The pursuit of food security through innovative, environmentally friendly practices like hydroponics underscores the commitment of these Islamic boarding schools to sustainable development).

Abstract

The Sādah Bā ‘Alawiyyah, as part of the Hadhrami Arab diaspora, has historically contributed to the dissemination of Islam in Indonesia. However, limited scholarly attention has been given to how this community internally manages sectarian differences, particularly between Sunni and Shia members. This study aims to fill this gap by investigating how the Sādah Bā ‘Alawiyyah community in Bondowoso navigates Sunni–Shia tensions through everyday peacebuilding practices. Employing a qualitative grounded theory approach, data were collected via in-depth interviews, participant observation, and document analysis. The study explores three key issues: the structural dynamics of the Hadhrami Arab community in Bondowoso, the interactional patterns between Sunni and Shia Sadah in daily life, and the socio-cultural mechanisms that prevent conflict escalation. Findings reveal that historical memory, intergenerational kinship ties, and ritual continuity function as core resources for building trust and sustaining peaceful coexistence. Rather than relying on formal institutions, the community resolves tensions through informal, everyday strategies that foster mutual respect and cohesion. Conceptually, the study contributes to diaspora and peace studies by introducing the notion of “family-based everyday peace”, demonstrating that Hadhrami identity is negotiated not merely through religious authority or social status, but through practical, lived strategies for conflict mitigation within plural settings.
