Abstract

Consumers using online food delivery applications that provide electronic payment in 2020 increased to date. One of the most used services by consumers in Indonesia is GrabFood, created by PT. Grab Technology Indonesia. In practice, the system for fund claim service provided does not follow the Restaurant's agreement as a Merchant. This study analyse how PT. Grab Teknologi Indonesia violates the UUPK. This study also analysed the fund claim method based on Law No. 8 of 1999 Consumer Protection (UUPK) between PT. Grab Teknologi Indonesia as a GrabFood service provider and Restaurant Menepi Kitchen as a merchant. This study uses normative and descriptive research methods based on secondary and primary data as supporting data and to obtain conclusions deductively. PT. Grab Teknologi Indonesia had violated UUPK article 7, letters a and g regarding the obligation of service providers to provide compensation if the services received are not following the content of the agreement and must be responsible for providing compensation as emphasized in UUPK article 19 and based on contractual liability

Abstract

This research discusses consumer protection in cases of credit congestion in Indonesia, with a focus on improving law enforcement as one of the key aspects in ensuring adequate protection for consumers. In this context, effective law enforcement is crucial to protecting consumer rights and maintaining the integrity of the financial system as a whole. This research identifies several strategic steps that can be taken to strengthen law enforcement against financial institutions that violate consumer protection regulations. The results of this research are: First, it is necessary to increase supervision and law enforcement from financial supervisory authorities, such as Bank Indonesia and OJK, through routine audits, surprise inspections, and strengthening authority. Second, cooperation between financial supervisory authorities and law enforcement such as the police and prosecutors is important to increase the effectiveness of law enforcement.

Abstract

ABSTRACT Ecotourism of Labuan Amuk is encouraging number of tourist visits which are still considered suboptimal. The aim of this study discusses the existing conditions and examines the strengths and weaknesses as well as opportunities and threats to formulate strategies and programs for developing ecological tourism as sustainable tourism in Labuan Amuk, Antiga optimally. A quantitative and qualitative approach used. Data collection was carried out through observation, in-depth interviews and questionnaires of 15 tourists visiting Labuan Amuk; the community, and tourism business actors (private) in Labuan Amuk. Data analysis was carried out using the SWOT method. Based on the SWOT analysis, alternative strategies were obtained that can be applied to the management of Labuan Amuk Ecotourism, namely (1) Strategy for creating and developing Sustainable Marine Ecotourism products; (2) Strategy for increasing Competitiveness through Digitalization and Diversification of the Tourism Economy; (3) Strategy for Optimizing Infrastructure and Environmentally Friendly Tourism Facilities; (4) strategy for strengthening the distribution channels for marketing ecotourism products to tourists staying in villas and tourist attractions in Labuan Amuk and its surroundings.. Ekowisata Labuan Amuk sedang mendorong jumlah kunjungan wisatawan yang masih dianggap belum optimal. Penelitian ini membahas kondisi eksisting serta mengkaji kekuatan dan kelemahan sekaligus peluang dan ancaman untuk merumusakan strategi dan program pengembangan wisata ekologis sebagai wisata berkelanjutan Labuan Amuk, Antiga secara optimal. Penelitian ini menggunakan pendekatan kuantitatif dan kualitatif. Pengumpulan data dilakukan dengan observasi, wawancara mendalam serta kuesioner terhadap 15 wisatawan yang berkunjung ke Labuhan Amuk; masyarakat, serta pelaku bisnis pariwisata (swasta) di Labuhan Amuk. Analisis data dilakukan dengan metode SWOT. Berdasarkan atas analisis SWOT diperoleh alternatif- alternatif strategi yang dapat diterapkan pada pengelolaan Ekowisata Labuan Amuk yaitu (1) Strategi menciptakan dan mengembangkan produk Ekowisata Bahari Berkelanjutan; (2) Strategi peningkatan Daya Saing Melalui Digitalisasi dan Diversifikasi Ekonomi Wisata; (3) Strategi Optimalisasi Infrastruktur dan Fasilitas Wisata Ramah Lingkungan; (4) strategi penguatan saluran distribusi pemasaran produk ekowisata kepada wisatawan yang menginap di villa-villa dan daya tarik wisata yang ada di Labuan Amuk dan sekitarnya.

Abstract

This paper aims to analyze how the harmonization of land bank law and land law provisions in agrarian reform. This study is a normative legal research that examines the harmonization of land bank law and land law provisions in Indonesia. This research uses a statute approach to find the harmonization of land bank legal rules through Law Number 13 of 2022 concerning the Formation of Legislation. This research uses data from Law No. 63 of 2023 on Job Creation, Government Regulation No. 64 of 2021 on the Land Bank Agency, Law No. 5 of 1960 on Basic Agrarian Principles, and MPR Decree No. IX of 2001 on Agrarian Reform. The data is processed by analyzing the harmonization of the legal rules of the land bank and the provisions of land law in agrarian reform through Law Number 13 of 2022 concerning the Formation of Legislation. The results of this study show that the land bank regulated in the provisions of Law No. 63 of 2023 on Job Creation and Government Regulation No. 64 of 2021 on the Land Bank Agency is disharmonious with the 1945 Constitution, Law No. 5 of 1960 on Basic Agrarian Principles, and MPR Decree No. IX of 2001 on Agrarian Reform.
