Abstract

Artikel ini bertujuan untuk menganalisis relevansi pemikiran Mohammad Natsir dalam merespons tantangan pendidikan Islam kontemporer. Masalah utama yang dikaji adalah bagaimana pemikiran Natsir mengenai pendidikan Islam dapat menjadi solusi atas problem dualisme ilmu, krisis moral, dan lemahnya orientasi spiritual dalam dunia pendidikan saat ini. Fokus penelitian ini diarahkan pada tiga aspek utama: gagasan Natsir tentang integrasi antara ilmu agama dan ilmu umum, urgensi pendidikan karakter berbasis nilai-nilai tauhid, serta pentingnya kemandirian lembaga pendidikan Islam. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kepustakaan (library research). Data diperoleh dari sumber-sumber primer berupa karya tulis Mohammad Natsir dan sumber sekunder berupa buku, artikel jurnal, serta dokumen ilmiah lain yang relevan. Teknik pengumpulan data dilakukan melalui telaah dokumen, sedangkan analisis data dilakukan dengan teknik analisis isi (content analysis) untuk menggali substansi pemikiran Natsir secara mendalam. Hasil kajian menunjukkan bahwa pemikiran Mohammad Natsir tetap kontekstual dan relevan sebagai landasan konseptual dalam pengembangan pendidikan Islam yang integratif dan holistik. Gagasan-gagasannya dapat dijadikan rujukan dalam merumuskan sistem pendidikan Islam yang berakar kuat pada nilai-nilai keislaman serta mampu beradaptasi dengan tantangan zaman.

Abstract

This study aims to deconstruct and conduct an in-depth analysis of legal protection for medical personnel, particularly doctors, within the framework of therapeutic agreements through the mechanism of informed consent. This study specifically evaluates the implementation of two fundamental principles in civil law, namely the principle of consensualism and the principle of pacta sunt servanda, in the Emergency Department of Ibnu Sina Islamic Hospital Bukittinggi. The main challenge identified is the complexity of medical decision-making in emergency situations, where formal procedures are often constrained by limited time and the critical condition of patients. The research method employed is normative juridical with a qualitative approach, utilizing primary data from interviews and secondary data from legal literature and recent regulations, including Law Number 17 of 2023 concerning Health. The findings reveal that in emergency situations, doctors apply the doctrine of implied consent as a manifestation of the principle of consensualism. The legal relationship formed is subsequently binding based on the principle of pacta sunt servanda as an obligation of effort (inspanningverbintenis) in accordance with professional standards. Legal protection for doctors is both preventive and repressive in nature. Preventive protection is achieved through compliance with Standard Operating Procedures (SOP) and proper medical record documentation, while repressive protection is realized through the use of such documentation as valid evidence to counter allegations of malpractice.

Abstract

This study aims to analyze the dysfunction of the juvenile criminal justice system in reducing juvenile crime rates in Pesisir Selatan Regency, identify the factors contributing to this dysfunction based on the theory of law enforcement effectiveness, and formulate strategies to strengthen the system in accordance with the socio-cultural characteristics of the Minangkabau community. Data were collected through document analysis of legislation, official institutional documents, and relevant scholarly literature, and were analyzed using descriptive qualitative methods. The findings indicate that diversion has been implemented in accordance with Law Number 11 of 2012 concerning the Juvenile Criminal Justice System and has successfully resolved several juvenile cases through a restorative justice approach. However, these procedural achievements have not significantly reduced overall juvenile crime rates due to persistent dysfunctions in preventing recidivism, coordinating between the formal legal system and traditional nagari institutions, and limitations in facilities, personnel, and integrated data management. Analysis based on Soerjono Soekanto's theory of law enforcement effectiveness reveals that the effectiveness of the juvenile criminal justice system is influenced by legal, institutional, infrastructural, societal, and cultural factors that remain inadequately integrated. Therefore, strengthening the juvenile criminal justice system requires the development of local policies integrating nagari institutions into diversion and post-diversion supervision, enhancing inter-agency coordination, improving the capacity of law enforcement personnel, establishing an integrated data management system, and optimizing the Minangkabau philosophy of adat basandi syarak, syarak basandi Kitabullah as the foundation for sustainable restorative justice.
