Abstract

Tujuan dari penelitian ini untuk menganalisis tanggung jawab hukum pemerintah di bidang kesehatan terkait belanja wajib. Metode penelitian menggunakan penelitian normatif dengan pendekatan konseptual dan pendekatan undang-undang yang berkaitan dengan materi yang dipelajari. Hasil penelitian ini bahwasanya Penghapusan Mandatory Spending sangat berpengaruh terhadap pelaksanaan kewajiban negara di dalam UUD 1945 yang berakibat pada ketiadaan kewajiban pemerintah dalam bertanggung jawab melaksanakan pemenuhan hak konstitusional warga negara seperti meningkatnya kasus dalam program unggulan, menurunnya kasus AHH, dan mislokasi anggaran dana ke daerah-daerah. Kemudian, terkait dengan tanggung jawab hukum pemerintah dalam pemenuhan hak konstitusional warga negara terdapat dalam UU Kesehatan yang lama yaitu adanya kegiatan mandatory spending. Penghapusan kegiatan mandatory spending mempengaruhi tanggung jawab pemerintah. Tak terlaksananya kewajiban tersebut berhubungan dengan hukum administrasi negara yang apabila kewajiban tersebut tidak dilaksanakan dengan baik, hal tersebut termasuk dalam kategori perbuatan melawan hukum oleh penguasa (PMHP). PMHP dapat diadili di dalam pengadilan tata usaha negara. The aim of this research is to analyze the government's legal responsibilities in the health sector regarding mandatory spending. The research method uses normative research with a conceptual approach and a legal approach related to the material studied. The results of this research are that the abolition of mandatory spending has had a significant impact on the implementation of state obligations in the 1945 Constitution, which has resulted in the absence of the government's responsibility to implement the constitutional rights of citizens, such as increasing cases in superior programs, decreasing cases of AHH, and misallocating budget funds to regions. area. Then, related to the government's legal responsibility in providing citizens' constitutional rights contained in the old Health Law, namely the existence of a mandatory spending program. Elimination of mandatory spending activities that affect government responsibilities. Failure to carry out these obligations is related to state administrative law, which if these obligations are not carried out properly, this falls into the category of unlawful acts by the authorities (PMHP). PMHP can be tried in state administrative courts.

Abstract

The right to lactation is part of human rights that naturally belongs to a woman, including female health workers who are protected by the state.In carrying out their duty to fulfill the rights of patients, they often face conflicts with the fulfillment of lactation rights that they should get. As a legal country, Indonesia provides protection for the fulfillment of lactation rights in several lawsand regulations. This study uses the type of normative juridical law research, namely library law research, with statutory approaches, and conceptual. The problems and objectives of this study are to analyze the conflict between the lactation rights of health workers and the rights of patients in health services and the government's legal responsibility for fulfilling the rights of lactation for health workers. The results showed that the biggest clashes experienced by health workers in fulfilling lactation rights was as welthe disharmony of laws and regulations between the Labor Law or the Job Creation Law and the Government Employees Management Government Regulations with the Health Law and the Government Regulationson Exclusive Breastfeeding. The government is responsible for fulfilling the right to lactation. The government can be seen as a legal subject and legal object, which means that the government supervises as well as was upervised the implementation of the provisions for fulfilling the right to lactation for health workers.

Abstract

Legal protection for partners of persons living with HIV (PLHIV) is the subject of this study. This study employs a form of normative juridical research that combines conceptual and statutory methodologies. A literature review was conducted to collect and analyze all legal materials utilized in this research. Deductive legal materials were employed for analysis. These are the outcomes of this research: 1) The relationship between health law and human rights in couples comprising people living with HIV (PLHIV) is reciprocal. Human rights violations frequently lead to health disruptions, and conversely, infringements upon the right to health constitute human rights violations. In the same way that health services must be universal and not discriminatory in accordance with the right to health, it is impermissible to deny access to health services to patients, including those who are partners of people living with HIV (PLHIV). 2) Legal protection for partners of persons living with HIV (PLHIV) is governed by the ICESCR, the ICCPR (Human Rights Law), and health-related legislation, including Health Law No. 17 of 2023. Human rights legislation is a reflection of societal values, specifically tolerance and nondiscrimination. Nonetheless, this legislation has yet to manifest empathy due to the absence of a concern-filled attitude towards the partners of individuals living with HIV.

Abstract

This research aims to analyse the basic legal ratio of the authority of the Indonesian Medical Council in issuing Registration Certificates for medical personnel and to analyze the legal consequences of issuing Registration Certificates for medical personnel by the Indonesian Medical Council after the issuance of Law Number 17 of 2023 concerning Health. The research approach used was normative juridical research. The legal materials used were primary and secondary legal materials. The technique for collecting legal materials in this research was by conducting a literature study. The research results showed that after the issuance of Law 17/2023, the central government through the Minister of Health is simplifying the practice requirements for medical personnel by introducing lifetime STR and SIP with the SKP system which is assessed directly by the Minister of Health and Regional Government. The legal consequences are not only a shift in norms, but also the formation of a new council with the latest structure, the SKP requirements shifted from the issuance of STR to SIP, and also the emergence of SKP management authority by the Regional Government c.q. Head of the Regency/City Health Service or Head of the Regency/City Regional Investment and One-Stop Integrated Services

Abstract

The Advocates are the only law enforcers who can be involved in all law enforcement processes. Advocates can also intersect and conflict with all other law enforcers in the law enforcement process. Therefore, harmonization of advocates with other law enforcers in the law enforcement process is essential. This study aims to determine the urgency of such harmonization and the factors that influence it. This research is a normative juridical research using a statutory and conceptual approach. Primary and secondary legal materials were collected through literature study and analyzed qualitatively. This research found that harmonizing advocates and other law enforcers in the law enforcement process is essential because without harmonization, the law enforcement process cannot run well, thus harming the interests of the people involved in the case. Three factors influence the harmonization of advocates with other law enforcers in the law enforcement process: statutory, authority, and interest factors.

Abstract

This study examines the welfare of medical personnel serving as Civil Servants (PNS) under the Indonesian civil service system, particularly those assigned to remote areas. Employing a normative juridical method with both a statute approach and a conceptual approach, this research explores the government’s responsibility to guarantee fair welfare and evaluates the adequacy of the existing legal framework. Legal materials were collected through literature study and analyzed using prescriptive legal analysis. Statistical data indicate an uneven distribution of health workers, with more than 60% concentrated in Java–Bali, whereas remote, border, and island regions continue to face critical shortages. Relevant legal instruments, including Law Number 20 of 2023 on the State Civil Apparatus and Law Number 17 of 2023 on Health, establish the legal basis for civil servant welfare. Nevertheless, normative gaps remain, particularly regarding technical arrangements such as incentive amounts, distribution mechanisms, and employment security guarantees. The findings reveal that current welfare protections for medical civil servants in remote areas are not yet fully effective, underscoring the need for more detailed derivative regulations to ensure legal certainty, distributive justice, and equitable deployment. The research contributes to legal scholarship by identifying shortcomings in the existing framework, offering policy recommendations for more comprehensive and enforceable welfare protections, and highlighting the importance of aligning normative guarantees with operational realities to strengthen the welfare state in Indonesia. However, this study is limited to normative legal analysis and does not include empirical data on implementation or the lived experiences of medical staff.

Abstract

Penelitian ini akan membahas bagaimana perbandingan perlindungan hukum terhadap hak laktasi antara Indonesia dan Jerman. Hak laktasi atau hak menyusui merupakan hak kodrati yang diperoleh seorang perempuan, termasuk pada perempuan pekerja. Oleh karenanya, hak laktasi harus mendapatkan perlindungan hukum dari negara. Metode penelitian yang digunakan adalah metode penelitian yuridis normatif, yaitu penelitian hukum kepustakaan, dengan pendekatan peraturan perundang-undangan, pendekatan perbandingan dan pendekatan konseptual. Tujuan penelitian ini adalah untuk mengetahui perbandingan perlindungan hukum hak laktasi pada perempuan pekerja di Indonesia dan di Jerman. Hasil penelitian menunjukkan bahwa Indonesia dan Jerman yang sama-sama menganut Civil Law System, telah memberikan perlindungan hukum terhadap hak laktasi, baik pada pekerja perempuan swasta maupun pegawai negeri. Indonesia menjamin hak laktasi pada perempuan pekerja dengan memberikan cuti melahirkan selama 6-12 minggu, tanpa ada pengaturan kerja paruh waktu maupun cuti tanpa gaji untuk mendukung pelaksanaan pemberian ASI Eksklusif selama 6 bulan. Sementara Jerman mengatur cuti melahirkan selama 8-12 minggu, diperkenankan mengambil cuti tanpa gaji selama 6 bulan menyusui ataupun mengambil kerja paruh waktu dengan tetap mendapatkan upah.

Abstract

Primary healthcare clinics are among the healthcare facilities that generate medical waste. This medical waste is classified as hazardous and toxic waste (B3), which poses significant risks to human health and the environment if not properly managed. Therefore, primary healthcare clinics are legally required to manage their medical waste in compliance with the applicable laws and regulations. This study aims to analyze the legal framework and forms of legal responsibility of primary healthcare clinics in managing medical waste. A normative juridical method is employed, utilizing statutory and conceptual approaches. The findings reveal that medical waste management in primary healthcare clinics still relies on general provisions regarding B3 waste management and on regulations applicable to healthcare facilities in general. To date, there are no specific legal provisions governing detailed procedures for medical waste management in primary healthcare clinics, creating a legal gap that may contribute to non-compliance in waste management practices. Such non-compliance may lead to legal consequences in the form of administrative, civil, and criminal sanctions. Legal responsibility may be imposed on individuals or legal entities, depending on the organizational form of the primary healthcare clinic.
