Abstract

AbstrakTradisi maddoassalama merupakan sebuah tradisi yang dilakukan sebagai bentuk rasa syukur kepada Allah swt. Atas yang telah diperoleh atau sesuatu yang telah dicapai maka dilakukan tradisi maddoassalama. Metode pengumpulan data dilakukan dengan cara observasi, wawancara dan dokumentasi. Metode pengolahan dan analisah data yaitu, metode induktif, metode deduktif dan metode komperatif. Hasil penelitian ini menunjukkan bahwa tradisi maddoassalama yang dilakukan oleh masyarakat Desa Lallatang, Kecamatan Dua Boccoe Kabupaten Bone merupakan suatu kebiasaan yang biasa dilakukan masyarakat ketika mendapatkan sesuatu seperti hasil panen atau suatu niat yang sudah tercapai biasa dilakukan tradisi maddoassalama. Jadi tradisi maddoassalama  ini dalam artian sesuatu yang dilakukan dalam ungkapan rasa syukur kepada Tuhan yang Maha Esa. Tradisi tersebut biasa dilakukan pada kalangan keluarga maupun kalangan masyarakat untuk mengungkapkan rasa syukur kepada Tuhan. Dalam pelaksanaan tradisi tersebut biasanya tuan rumah menyiapkan berbagai makanan sesajian yang kemudian dibacakan oleh pa’baca atau Imam. Waktu pelaksanaan biasanya pada malam senin, rabu, kamis dan jum’at. pandangan Islam tradisi maddoassalama boleh saja dilakukan tanpa merusak akhidah seseorang tanpa adanya sebab yang lain, makanan yang diletakkan pada wadah tertentu  sebagai simbol tetapi apabila makanan tersebut bertujuan sebagian sesajian untuk arwah  yang telah meninggal maka itu tidak sesuai dengan syariat Islam.Kata Kunci : Maddoassalama, Proses Pelaksanaan, Hukum IslamAbstractThe Maddoassalama tradition is a tradition that is carried out as a form of gratitude to Allah SWT. For what has been obtained or something that has been achieved, the Maddoassalama tradition is carried out. The type of research used is qualitative by using various aspects of the approach, namely historical, sociological, and anthropological approaches. Furthermore, the data collection method is carried out by means of observation, interviews and documentation. Data processing and analysis methods are inductive method, deductive method and comparative method. The results of this study indicate that the maddoassalama tradition carried out by the people of Lallatang Village, Dua Boccoe District, Bone Regency is a habit that is usually done by people when they get something like a harvest or an intention that has been achieved is usually done by the maddoassalama tradition. So this maddoassalama tradition means something that is done in an expression of gratitude to God Almighty. This tradition is usually carried out among families and communities to express gratitude to God. In the implementation of this tradition, the host usually prepares various food offerings which are then read by the pa'baca or Imam. The implementation time is usually on Monday, Wednesday, Thursday and Friday nights. The Islamic view of the maddoassalama tradition is permissible to do without damaging one's faith without any other reason, food that is placed in a certain container is a symbol, but if the food is intended as part of the offering for deceased spirits then it is not in accordance with Islamic law.

Abstract

The Mappasikarawa tradition is a unique tradition carried out after the marriage ceremony by the Bugis Makassar community, this practice has become a polemic in society because it is considered only a tradition with no foundation in Islamic law. This study aims to discuss the Mappasikarawa tradition in the marriage of the Bugis Makassar community from the perspective of Islamic legal philosophy. This research is an empirical legal study using an Islamic legal philosophy approach. There are two ways used in collecting data, namely; in-depth interviews and literature studies. The research was conducted in five regions in South Sulawesi namely; Makassar, Maros, Pangkep, Gowa, and Wajo, while the informants interviewed were traditional leaders, religious leaders, academics, women's leaders and wedding couples. This study concludes that the Mappasikarawa tradition practiced by the Bugis-Makassar people has a historical basis that is rooted in Islamic law, especially a tradition of 'urf. The philosophical values contained in touching certain parts of the wife's body do not contain polytheism because touching the wife's body is always preceded by blessings on the prophet and accompanied by good prayers. Because of this, the Mappasikarawa tradition which originates from local Bugis-Makassar values can actually be said to be part of sunnah-hashanah and has relevance to Islamic law where both are manifestations of benefit for married couples.

Abstract

To be fair in a variety of activities in the social life is an absolute must for the creation of peace and harmony, so that the order be fair and equitable  set by  law  is not related to the  position, descent, race, ethnicity or kinship someone. Because they are weak such as orphans, it must also be acknowledged and treated fairly. Commands to be fair, was also strongly emphasized, either when acting as a judge who will decide the law or when acting as a witness.

Abstract

Mencermati pemikiran yang ditulis oleh Muhammad Awwamah bahwa paling tidak ada empat faktor penyebab keragaman pendapat para pakar hukum islam terhadap hadis Rasulullah SAW. Faktor pertama, perbedaan mengenai kriteria hadis yang layak untuk diamalkan. Faktor Kedua, Keragaman pendapat para pakar hukum Islam dalam memahami hadis Rasulullah karena adanya dua masalah yaitu: 1. Perbedaan intenlegensi mereka disebabkan oleh perbedaan naluri (bakat), lingkungan soial, budaya, politik dan sebagainya; 2. Lafal itu sendiri mengandung makna musytarak. Faktor ketiga,  Adanya hadis-hadis yang secara tekstual tampak bertentangan menyebabkan para fuqaha ketika menyimpulkan kandungan hukum berbeda. Faktor keempat, keragaman para pakar disebabkan adanya perbedaan tingkat pengetahuan mereka tentang sunnah.

Abstract

This study examines Ismail Al-Zain's fatwa on tajdīd al-nikāh and its relevance to remarriage practices at the Office of Religious Affairs (KUA) in Walenrang District, Luwu Regency, particularly among serial marriage perpetrators requiring official marriage registration. The research employs a field research method, combining a phenomenological approach to explore individual experiences with tajdīd al-nikāh and a normative juridical approach to analyze the issue through Islamic law, including the Qur'an, hadith, fiqh rules, and scholars' opinions. The findings reveal that while Ismail Al-Zain's fatwa permits tajdīd al-nikāh as jawāz (allowed), it should be avoided unless critically necessary. At the KUA of Walenrang, tajdīd al-nikāh is implemented not only to fulfill marriage registration requirements but also to address doubts about the validity of harmony and conditions in serial marriages. This practice is more accurately termed i'ādah al-nikāh, aiming to ensure compliance with Islamic legal requirements and resolve ambiguities associated with serial marriage legality. This study offers original insights into the practical and legal nuances of tajdīd al-nikāh versus i'ādah al-nikāh in the context of marriage registration. The findings underscore the critical role of legal clarity in protecting the rights of spouses and children and preventing future disputes in family law. The research highlights the importance of ensuring correct and legal marriage processes to address legal and social challenges in contemporary Islamic family practices.
