Abstract

The research aims to explain and analyse the views of the Muhammadiyah central leadership assembly and its relevance to religious moderation. The method used in this research is a literature study that examines legal products produced by the Tarjih Council and in-depth interviews with Muhammadiyah's central and regional leaders regarding their views on religious moderation. This research shows that the Muhammadiyah central leadership tarjih council has provided moderate and flexible legal thinking. The legal products produced by the tarjih assembly have provided much knowledge to the public about how to act pretty, not easily blame others for differing opinions, be open to giving input, live side by side, be non-violent and prioritise the power of reason in looking at problems. This research concludes that the Muhammadiyah Tarjih Council's views align with the concept of moderation currently being developed by the Ministry of Religion.

Abstract

One of the issues in Islamic law that is often debated is the case of polygamy that occurs in society in Indonesia. The perception of people in Makassar City, South Sulawesi about polygamy is still very taboo. This assumption arises because of their erroneous understanding of polygamy. This article aimed to discuss the underlying factors of polygamous marriages in Makassar.  The research used empirical methods with survey techniques, analyzed with Islamic law theory. The current research was designed as a survey which involved 80 participants, who consisted of 30 polygamous actors and 50 people from monogamous relationships. Instruments used in this study were a close-ended questionnaire and an open interview guideline with polygamists. The results showed that among the Makassarian community members who agreed with the practice of polygamy, there was a group of people who considered polygamy as a disgrace to the family or an act of demeaning women. It was reported that many polygamous actors conducted polygamy without any consent from their first wives. The survey also uncovered several factors that provoked polygamy practices in Makassar. These factors include female infertility, men’s sexual needs, the Prophet’s Sunnah, incurable diseases, and ignorance. Moreover, the majority of polygamous actors in Makassar chose not to register their second marriage at the Civil Registry office due to the state's convoluted bureaucracy and the law that prohibits government employees from being polygamous.

Abstract

The management of the Orphanage that does not obey the law results in the Orphanage being unable to meet the needs of food, drink, education, health and Safety. Meanwhile, the Orphanage is an action-oriented charity that doesn't just collect orphans and abandoned children. The problem of managing the Orphanage has become a worldwide concern because many research results have found that the Orphanage does not carry out child development activities and that the orphanage children experience criminal acts. This study aims to reveal orphanage managers' legal compliance in meeting the foster children's needs. This study uses a descriptive legal analysis method, field data sourced from empirical studies at a philanthropic institution, namely the Orphanage in Palopo, totalling eight institutions. Data analysis was carried out with a legal approach. Data were collected through observation and in-depth interviews. The study found legal compliance in meeting the needs of facilities, food, education and health; security looks very good at orphanages managed by religious, community or boarding school-based organisations, while the lack of legal compliance in meeting the needs of orphanages that are managed at home or individually because only meet the needs of housing and food. The lack of legal compliance that occurs in home-based orphanages is due to a lack of management resources, including funds, lack of government participation in coaching and supervision.

Abstract

The purpose of this research is to understand the Principles of Economics in Islam and the Concept of Decent Living in Islam. The results of this research show: 1) The definition of Islamic economics in the scientific literature includes several perspectives from experts, but substantively, Islamic economics is a science that studies human behavior in efforts to meet needs with limited resources within the framework of Sharia. Another definition formulates that Islamic economics is a science that studies the behavior of a Muslim in an Islamic society framed by Sharia. The principles of Islamic economics, which form the structure of Islamic economics, are based on five universal values, namely: tauhid (faith), 'adl (justice), nubuwwah (prophethood), khilafah (government), and ma'ad (result); 2) Islamic economics, which is part of Islamic law, naturally has goals that cannot be separated from the main objectives of Islamic law. The main goal of Islamic economics is to achieve human objectives of attaining happiness in this world and the hereafter (falah) and a good and honorable life (al-hayah al-thayyibah). This is the definition of welfare in the Islamic approach, which is certainly different from the concept of welfare in traditional secular and materialistic economics.

Abstract

Larangan memakan harta anak yatim merupakan prinsip fundamental dalam hukum Islam yang bertujuan untuk melindungi hak-hak anak-anak yang kehilangan orang tua. Penelitian ini bertujuan untuk mengkaji larangan memakan harta anak yatim dalam perspektif hukum Islam, serta dampak sosial dan psikologis yang ditimbulkan dari penyalahgunaan hak-hak mereka. Metode yang digunakan dalam penelitian ini adalah pendekatan kualitatif dengan analisis literatur dari Al-Qur'an, Hadis, dan kajian akademis terkait. Hasil penelitian menunjukkan bahwa pengelolaan harta anak yatim sebagai amanah harus dilakukan dengan transparansi dan bertanggung jawab. Selain itu, masyarakat memiliki peran penting dalam mendukung kesejahteraan anak yatim, yang dapat mengurangi ketidakadilan sosial dan meningkatkan kualitas hidup mereka. Penelitian ini juga mengungkapkan bahwa ketidakadilan yang dialami anak yatim berpotensi menimbulkan dampak psikologis yang negatif, sehingga perlindungan dan perhatian terhadap mereka menjadi sangat krusial.
