Abstract

Produk yang terdaftar dalam Indikasi Geografis merupakan potensi nasional yang dapat menjadi komoditas unggulan, baik dalam perdagangan domestik maupun internasional. Kurangnya perlindungan optimal terhadap suatu produk menjadi suatu masalah yang harus diperhatikan dan segera diselesaikan, karena Indonesia memiliki banyak potensi ekonomi terkait Indikasi Geografis. Salah satu produk pertanian yang potensial mendapat Indikasi Geografis adalah Ase Lapang yang merupakan produk pertanian dari daerah kabupaten Pangkep, Sulawesi Selatan. Ase Lapang ini memiliki karakteristik karena mempunyai aroma harum dan rasanya yang enak/pulen. Meskipun Indonesia kaya akan produk potensi indikasi geografis dan memiliki peraturan perundang-undangannya, namun hanya sedikit yang didaftarkan. Metode penelitian yang digunakan yaitu yuridis normatif dengan mengunakan pendekatan perundang-undangan. Pendekatan tersebut terhadap berbagai aturan hukum yang berkaitan dengan masalah perlindungan hukum terhadap Indikasi Geografis. Kesimpulan dari penelitian ini yaitu Ase Lapang dapat memperoleh perlindungan hukum melalui Indikasi Geografis, sebagaimana unsur-unsur indikasi geografi yang diatur dalam ketentuan dalam UU Merek dan Indikasi geografis yaitu terdapat tanda yang menunjukkan asal tempat dihasilkan barang akan dimohonkan pendaftarannya; dan terdapat karakteristik dan kualitas yang diakibatkan karena adanya faktor alam, faktor manusia, atau kombinasi dari faktor tersebut. Untuk memperoleh perlindungan Ase Lapang sebagai produk potensi Indikasi Geografis maka perlu dilakukan permohonan pendaftaran Indikasi Geografis dengan memenuhi persyaratan dan pendaftaran sebagaimana ketentuan yang berlaku. Apabila Ase Lapang terdaftar dalam Indikasi Geografis, maka akan memperoleh berbagai manfaat perlindungan hukum indikasi geografis.

Abstract

Sidrap Regency, as the rice barn of South Sulawesi, faces serious problems in the form of social diseases (PEKAT) such as gambling, drug abuse, and prostitution. Operation PEKAT Lipu 2024 is a strategic initiative taken by the Sidrap Police Criminal Investigation Unit to combat crime and improve public security. This study aims to: 1) To find out what functions and responsibilities are carried out by the Sidrap Police Criminal Investigation Unit in the PEKAT Lipu 2024 operation. 2) To find out the obstacles and strategies implemented by the Sidrap Police Criminal Investigation Unit in making the PEKAT Lipu operation a success. This research is empirical legal research with a case study approach. The research was located at the Sidrap Police Criminal Investigation Unit during the period August 2024 to February 2025. This qualitative data was obtained through interviews with related parties, namely the leaders and members of the Sidrap Police Criminal Investigation Unit who were actively involved in the PEKAT Lipu 2024 operation. The data obtained in this study were analyzed through content analysis and qualitative descriptive analysis. The results of the study show that: 1) The functions and responsibilities carried out by the Sidrap Police Criminal Investigation Unit in Operation PEKAT Lipu 2024 include law enforcement against criminal acts, prevention of social diseases, and increasing public awareness and participation in maintaining environmental security. 2) Obstacles faced in implementing this operation include social stigma, limited access to remote areas, and adaptation of criminals to police tactics. Strategies implemented to overcome these obstacles include increasing the number of personnel, training for members, a humanistic approach to the community, and developing a more accessible reporting system.

Abstract

Introduction: The treatment of children as perpetrators of criminal acts has become a significant issue in the development of modern law, particularly with regard to the protection of children’s rights and the integration of local values. Indonesia and the Philippines, as countries with different legal traditions, present an important dynamic for study.Purposes of the Research: The purpose of this research is to analyze the differences in the legal politics of Indonesia and the Philippines in addressing juvenile offenders, focusing on the implementation of diversion in Indonesia and the juvenile justice system in the Philippines, while also examining the integration of customary or community-based mechanisms and the protection of children’s rights in both jurisdictions.Methods of the Research: This study employs normative legal research with comparative and conceptual approaches. Data were collected through literature review of statutory provisions, academic doctrines, scholarly literature, and relevant international instruments on children’s rights. The analysis was conducted qualitatively and descriptively to compare norms, practices, and the implications of legal politics in both countries.Results of the Research: The findings of this study demonstrate that the legal politics of both countries, through the integration of customary law and the protection of children’s rights, serve as a fundamental basis for the normative framework in addressing children as perpetrators of criminal acts. In Indonesia, customary law is implicitly integrated through the mechanism of diversion as regulated in Laws of the Juvenile Criminal Justice System. In contrast, in the Philippines, customary or community-based law is explicitly integrated by involving the barangay tanod in handling juvenile offenders during the diversion process under the Juvenile Justice and Welfare Act of 2006 (RA 9344). These findings contribute to advancing Indonesia’s legal policy toward a more humane, inclusive, and internationally aligned juvenile justice system.
