Abstract

The enforcement of in concreto law refers to the practical implementation of law, transforming it from an abstract concept into a concrete application. Diversion, as an alternative resolution for juvenile cases outside the formal criminal justice system, aims to prevent stigmatization and allows children to reintegrate into their social environment in a balanced manner. This study employs a library research method with a juridical-normative approach, collecting data through documentation and analyzing it descriptively. The findings reveal that restorative justice and diversion focus on restoring losses suffered by victims, providing opportunities for offenders to participate in the recovery process, and involving the community in maintaining equitable peace. However, despite the extensive discussion of restorative justice and diversion in existing literature, there remains a gap in integrating Islamic legal principles, particularly As-sulh, into their application for juvenile cases. This raises two main questions: how can the concept of diversion be aligned with the principles of As-sulh to support the protection of children

Abstract

Digital technology in Indonesia has significantly impacted sectors such as government, finance, education, and healthcare, offering numerous benefits. However, it has also led to increased cybercrime, including hacking, digital fraud, identity theft, and ransomware, posing threats to national security and public welfare. Regulations like the ITE and PDP Laws have been implemented, yet challenges persist in enforcement and technological adaptation. Indonesia faces challenges in cyber law enforcement, including insufficient technical capacity among law enforcement officers. This study employs a qualitative descriptive approach with an exploratory focus. Data were collected from legal documents, government reports, case studies, journal articles, and academic literature. Thematic analysis was used to identify patterns, challenges, and the effectiveness of cybercrime policies. The findings reveal that Indonesia’s cybersecurity policies need reinforcement, particularly in implementation, public education, and technological adaptation. Examples from the United States and the European Union highlight that collaboration between governments and the private sector, stringent data protection regulations, and public education campaigns significantly enhance resilience against cyber threats. This study recommends strengthening the ITE and PDP Laws, promoting digital literacy among the public, enhancing law enforcement capacities, fostering international collaboration, and establishing cyber information-sharing networks to create a robust, effective, and adaptive digital security ecosystem for Indonesia.

Abstract

This article examines Syamsul Anwar's endeavours to promote the unification of the global Hijri calendar, which is essential for aligning Islamic religious observances, including Ramadan, Eid al-Fitr, and Eid al-Adha. Discrepancies in establishing the commencement of the Hijri month, especially in Indonesia, arise from the contrasting methodologies employed by Nahdatul Ulama, which relies on rukyat (moon sighting), and Muhammadiyah, which utilizes hisab (astronomical calculations). Syamsul Anwar's methods aims to amalgamate these techniques via five fundamental principles: acknowledgement of hisab, transference of imkanu rukyat, the cohesion of matlak, worldwide synchronization of days and dates, and acknowledgement of the International Date Line. The study employs qualitative methodologies, such as observation, interviews, and document analysis, to comprehend Anwar's perspectives. Notwithstanding extensive backing from Islamic astronomy professors, obstacles persist in Indonesia owing to the cultural importance of rukyat. This study suggests that additional research and discourse are necessary to reconcile these disparities and establish a worldwide unified Hijri calendar, thereby minimizing inconsistencies in religious rituals throughout the Muslim world.

Abstract

Wakaf merupakan lembaga keagamaan yang mempunyai fungsi religi dan juga fungsi sosial yang mana dengan adanya fungsi sosial ini maka harta benda wakaf merupakan aset yang sangat bernilai dan bermanfaat bagi pembangunan dan kesejahteraan umat manusia. Di antara masjid yang mempunyai aset wakaf cukup besar ialah Masjid Agung Kauman Kota Semarang yang biasa disebut bandha wakaf Masjid Agung Kauman Kota Semarang. Artikel ini membahas tentang implementasi pengelolaan bandha wakaf Masjid Agung Kauman Kota Semarang ditinjau berdasarkan Hukum Islam dan Undang-Undang Republik Indonesia Nomor 41 Tahun 2004 tentang Wakaf. Metode penelitian yang digunakan adalah yuridis empiris. Berdasarkan hasil penelitian, Pertama, pengelolaan bandha wakaf Masjid Agung Kauman Kota Semarang sudah sesuai dengan hukum Islam. Kedua, pengelolaan bandha wakaf Masjid Agung Kauman Kota Semarang ditinjau berdasarkan UU Wakaf adalah sudah cukup sesuai meskipun kurang keterlibatan peran BWI dan kementerian dalam pengelolaan bandha wakaf tersebut. Hal ini didasarkan pada siapa nazhir dan imbalan yang diperoleh dan sistem pengelolaan yang telah memperhatikan potensi bandha wakaf, manfaat ekonomis dan dilakukan secara produktif untuk kepentingan ibadah dan kesejahteraan umat.

Abstract

Tulisan ini menganalisis pembaruan paradigma pemidanaan dalam KUHP Nasional (UU No. 1 Tahun 2023) yang menandai pergeseran dari pola retributif menuju model restoratif–korektif, dengan penekanan pada pencegahan, rehabilitasi, dan reintegrasi sosial. Isu pokok yang dikaji mencakup tujuan pemidanaan (Pasal 51–52), diferensiasi sanksi termasuk pidana kerja sosial dan pidana pengawasan, reformasi pidana denda, sinkronisasi dengan UU Pemasyarakatan (UU No. 22 Tahun 2022), serta pengakuan living law (Pasal 2) beserta paradoks antara keadilan substantif dan kepastian hukum. Tujuan penelitian adalah memetakan desain sanksi dan rasional kebijakan kriminal dalam KUHP 2023, menganalisis konsekuensinya bagi manajemen pemasyarakatan dan reintegrasi, serta mengevaluasi implikasi penerapan bagi sistem peradilan pidana (kebutuhan regulasi turunan dan sentencing guidelines, kesiapan kelembagaan, serta perubahan budaya hukum). Metode yang digunakan adalah yuridis normatif dengan pendekatan statute, conceptual, dan komparatif terbatas, ditopang studi pustaka dan analisis kualitatif. Hasil menunjukkan potensi pengurangan overcrowding dan peningkatan legitimasi sistem, namun keberhasilan sangat bergantung pada konsistensi regulasi pelaksana, penguatan kapasitas institusional (terutama BAPAS dan peradilan), serta internalisasi nilai restoratif di seluruh tahapan penegakan hukum.

Abstract

The absence of a universally accepted Hijri calendar has long generated socio-religious fragmentation across the Muslim world, with recurrent divergences over the start of Ramadan, Shawwal, and Dhu al-Hijjah. This article interprets the 2016 International Hijri Calendar Unity Congress in Istanbul not merely as a technical-astronomical gathering but as a strategic exercise in religious diplomacy orchestrated by Turkey’s Presidency of Religious Affairs (Diyanet). Using a descriptive–analytical qualitative design, the study synthesizes academic, institutional, and media sources to examine how Turkey leveraged agenda-setting, coalition-building, and procedural innovation to advance calendar unification. Historically embedded within a longer OIC-linked process (2005 Yemen resolutions; 2008 Mecca; 2013 Istanbul), the 2016 congress converted protracted deliberation into a vote-backed, criteria-specific decision package. Subsequent diffusion (most clearly the SGHC adoption by Muhammadiyah for full implementation from 26 June 2025) demonstrates Turkey’s capacity to translate scientific-fiqh convergence into transnational policy uptake. Findings indicate that the congress projected Turkey as a modern, rational leader capable of reframing a civilizational problem while subtly contesting traditional Arab religious authorities. Yet universal consensus remains elusive due to sovereignty politics (notably in Saudi Arabia), OIC institutional inertia, and grassroots attachment to local rukyat. The article clarifies both the reach and the limits of Turkey’s faith-based soft power in a polycentric Islamic order.

Abstract

Job crafting merupakan topik dalam bidang industry dan organisasi tentang bagaimana karyawan memaknai pekerjaannya. Tujuan penelitian ini untuk melihat pengaruh antara job autonomy dan burnout terhadap job crafting. Sampel yang digunakan dalam penelitian ini adalah 300 guru yang berdomisili pada wilayah Lampung dan Banten. Alat ukur yang digunakan yaitu Job Crafting Scale (JCS) yang dikembangkan oleh Tims et al, (2012), Job autonomy diukur menggunakan Breaugh Work Autonomy Scale (BWA Scale) yang telah di adaptasi oleh Saragih (2011), dan The MaslachBurnout Inventory yang telah di adaptasi oleh Nassar et al, (2020) yang selajutnya dilakukan pengujian validitas konstruk dengan menggunakan CFA. Berdasarkan hasil pengujian hipotesis, diperoleh bahwa job autonomy dan burnout memiliki pengaruh yang signifikan terhadap job crafting.

Abstract

This study analyzes the risk of delays in the construction of the Perawang Bridge in Tasik Putripuyu District using Monte Carlo Simulation. Risk identification highlights several key factors that could cause delays, including design changes, delayed document approvals, and contractor financial issues. The Monte Carlo Simulation estimates a potential project delay of more than 30 days and a cost increase of up to 15% from the initial budget. To address these issues, the study proposes several mitigation strategies, such as improving stakeholder coordination, more effective project planning, and managing weather and safety risks. Implementing these strategies is expected to reduce the risk of delays and enhance the success of future infrastructure projects. The findings provide practical guidance for better project management and can be applied to similar infrastructure projects
