Abstract

This article discusses digital transformation as an effective and efficient paradigm in court services in Indonesia. The Supreme Court has used digital transformation in court administration by developing an electronic court system or e-Court since 2018. However, procedural law has no legal basis related to electronic trials. The development of online dispute resolution is very fast, while procedural principles regarding due process and neutrality must remain the court's main task. In addition, establishing Internet courts involves three fundamental legal ethical principles: restoring the ceremonial aspects of litigation and creating risk management mechanisms between the legal and technological systems. This study aims to analyze the court's efforts to create an effective and efficient trial in Indonesia. A normative legal method was employed, incorporating various approaches such as the statute, conceptual, and comparative approaches. The research results show that the digital transformation policy was incorporated into the 2010-2035 blueprint of the Supreme Court of the Republic of Indonesia, which has brought about the need to accelerate digital transformation in the justice system. Settlement of civil disputes is carried out using an electronic court (e-court) application with an electronic litigation (e-litigation) mechanism. Meanwhile, the criminal trial was conducted through teleconference media. Still, they have encountered obstacles: limited facilities and infrastructure in conducting the trial, such as internet stability in various regions and limited courtrooms with electronic trial equipment. Need to improve infrastructure and improve the quality of human resources.

Abstract

With the development of digital technology, creators can now use e-commerce platforms to sell digital design works. The ease of access and digital nature of these design works raises concerns about potential copyright infringement. Digital intellectual property, such as logos, illustrations and icons must be protected. The research aims to find out and examine the legal protection of digital design works so as not to be misused by other parties on digital e-commerce platforms and the legal efforts of copyright holders of digital designs to be protected. The research was conducted using normative method. The results show that digital designs sold on e-commerce platforms get protection against ownership of intellectual property rights both from economic rights and moral rights as stated in Article 8 to article 19 and articles 21 and 22 of Law Number 28 of 2014 concerning Copyright and article 25 of Law Number 19 of 2016 amending Law Number 11 of 2008 concerning ITE. Preventive efforts to protect a digital design creation can be done by inserting a watermark on the digital design and registering the digital design copyright at the Directorate General of Intellectual Property. E-commerce platforms can act decisively against individuals who infringe copyright by giving warnings, imposing penalties, removing and stopping products to closing the accounts of copyright infringers. Repressive efforts to resolve digital design copyright disputes can be resolved through temporary injunctions, civil remedies, criminal remedies and arbitration.

Abstract

Article 33 paragraph (1) of the 1945 Constitution and its Explanation which refers to the notion of a typical corporate structure because of the definition of cooperatives in Law Number 17 of 2012 concerning Cooperatives, it turns out that the philosophy is not in accordance with the nature of the economic structure as a joint venture and the kinship-based principle contained in Article 33 paragraph (1) of the 1945 Constitution. Similarly, this understanding has apparently been elaborated in other articles in Law Number 17 of 2012 concerning Cooperatives, thus making the rights and obligations of members by making the supervisory authority too extensively and a capital scheme that prioritizes material and financial capital that overrides social capital which is precisely the fundamental characteristic of cooperatives as a distinct entity of economic actors based on the 1945 Constitution. On the other hand, cooperatives are the same and no different from limited liability companies. This has made cooperatives lose their constitutional soul as an entity of typical economic actors for a nation with a mutual cooperation philosophy.Keywords: Cooperatives, Constitutional Court Verdict, Economy

Abstract

Kasus antara Once Mekel dengan Dewa 19 terjadi karena Once membawakan lagu-lagu Dewa 19 pada konser komersial tanpa izin dari penciptanya yaitu Ahmad Dhani. Penelitian ini bertujuan untuk menganilisis bagaimana penegakan hukum di Indonesia dalam memerangi pelanggaran hak cipta musik dalam konteks pertunjukan komersial dan mengetahui hambatan dalam menegakkan hukum hak cipta musik. Penelitian ini menggunakan metodologi normatif dengan pendekatan perundang-undangan, kasus, dan konseptual untuk meneliti permasalahan pelanggaran hak cipta musik.Hak cipta berlandaskan pada Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dan Peraturan Pemerintah Nomor 56 Tahun 2021 tentang Pengelolaan Royalti atas Hak Cipta Lagu dan/atau Musik. Disebutkan pada Pasal 9 UUHC bahwa setiap pihak yang ingin membawakan lagu milik orang lain harus mendapatkan izin dari penciptanya dan jika melanggar akan dikenai sanksi sesuai Pasal 113 UUHC. Hambatan dalam implementasi penegakan hukum, seperti kerjasama lembaga penegak hukum yang buruk, kurangnya keahlian teknologi, dan kurangnya pemahaman masyarakat tentang pentingnya hak cipta. Penelitian ini juga menjabarkan penyelesaian melalui jalur litigasi maupun non litigasi, serta menunjukkan keunggulan mediasi sebagai upaya penyelesaian sengketa. Diperlukan adanya penguatan struktur hukum, sosialisasi peraturan, dan peningkatan pengetahuan masyarakat, dikarenakan masih banyaknya hambatan pada budaya hukum seperti kepatuhan masyarakat yang buruk dan toleransi terhadap pelanggaran hak cipta. Penegakan hukum hak cipta musik dapat dilakukan secara lebih efektif dan adil dengan menggunakan pendekatan yang terpadu.

Abstract

Lending and borrowing agreements secured by movable objects owned by third parties have become a complexlegal phenomenon,especially when there is a default by the debtor. In practice,many creditors suffer losses dueto ignorance or negligence in verifying the legal status of the collateral object. This research aims to analyze theform of legal protection for creditors and the legal procedures that can be taken in the event of default in theagreement. The method used is normative legal research with a statutory approach and legal literature.Theresults of the study show that legal protection for creditors in this case is regulated in several legal provisions,including Article 1320 and Article 1365 of the Civil Code (KUHPerdata), as well as Article 15 paragraph(2)ofLaw Number 42 of 1999 concerning Fiduciary Guarantees, which gives executorial rights to creditors with thesame power as court decisions that have been legally enforceable (inkracht). the importance of the principle ofprudence, the validity of documents, and the involvement of notaries in strengthening the legal position ofcreditors. Alternative dispute resolution such as mediation, subpoena, and execution of collateral through legalchannels are important means of protection for creditors. Article 29 of Law Number 42 Year 1999 on FiduciaryGuarantee. Every form of settlement must be based on the principles of legality, good faith, and prudence(prudential principle), and payattention to the rights of third parties in good faith. Efforts taken by creditors dueto default in a loan agreement with movable object collateral are carried out through two channels,namelylitigation and non-litigation. The litigation path is a settlement taken through the court, this path is formal,procedural, and the results are binding aind have permanent legal force. Non-litigation settlement is a legal effortoutside the court that is valid according to positive law and based on the principles of freedom of contract andgood faith. Abstract

The judiciary is a mechanism provided by the state to resolve disputes. However in practice, dispute resolution in court is not in accordance with the principles of justice, namely effective and efficient judicial institutions. This research aims to analyze the legality and development of mediation in court. The research method used is library research with secondary data sources in the form of laws and regulations, research results and literature. One of the progressive ideas of the Supreme Court of the Republic of Indonesia in order to realize effective and efficient courts, among others, is to strengthen the institution of mediation in the Court for the settlement of civil disputes. However, it seems that the efforts of the Supreme Court institutions need to be further refined through improving the quality and quantity of human resources, improving supporting infrastructure and court institutions are consistent in supporting the mediation development programs in the Court.

Abstract

The settlement of fraud cases with restorative justice is an innovative step to follow the dynamics of the development of the legal world which began to shift from positivism to progressive. Restorative justice is an approach that focuses more on the conditions for the creation of justice and balance for the perpetrators of criminal acts and the victims themselves. The research method used is empirical juridical, namely legal research on the implementation of restorative justice in action in the settlement of fraud cases by the Banyumas Police Criminal Investigation Unit. The purpose of this research is to analyze the settlement of fraud crimes through restorative justice and to find out the obstacles in the settlement of theft crimes through restorative justice at Satreskrim Polresta Banyumas. The results showed that the Banyumas Police Criminal Investigation Unit resolved fraud cases using a restorative justice approach based on Police Regulation Number 8 of 2021 concerning Handling Crimes Based on Restorative Justice, namely by bringing together the perpetrator and victim and seeking to restore the losses suffered by the victim. The obstacles faced by Satreskrim Polresta Banyumas are that the victim does not want the involvement of outside parties in resolving his case and the inability of the perpetrator to fulfill the compensation requested by the victim, causing the settlement of fraud cases through restorative justice to fail.

Abstract

Kekerasan terhadap perempuan dan anak, terutama di Banyumas, merupakan masalah yang semakin muncul ke permukaan. Akhir-akhir ini banyak peristiwa terkait yang terjadi, seperti kasus anak usia 12 tahun yang dirudapaksa oleh empat kakek di mana mereka adalah tetangga anak tersebut, maupun anak yang dilecehkan oleh ayahnya sendiri sampai melahirkan 7 bayi hasil inses yang kemudian bayi tersebut pun dibunuh dengan cara dikubur. Sementara itu, berdasarkan data “Banyumas dalam Angka” yang diterbitkan oleh Badan Pusat Statistik Kabupaten Banyumas, pada tahun 2023 telah tercatat 37 kasus kekerasan terhadap Perempuan di mana pada tahun sebelumnya adalah 35 kasus. Sedangkan kasus kekerasan terhadap anak pada tahun 2022 sebanyak 76 kasus di mana pada tahun sebelumnya sebanyak 81 kasus. Jumlah kasus yang dipaparkan menandakan perlunya edukasi dan pendampingan bagi masyarakat dan dalam hal ini ‘Aisyiyah dapat mengambil peran.Mitra kegiatan pengabdian ini adalah PDA Banyumas yang berada di Jalan Masjid Gang II nomor 1 Purwokerto. PDA Banyumas melalui Majelis Hukum dan Hak Asasi Manusia (HAM). Pengabdian ini dilaksanakan melalui koordinasi dengan mitra untuk mengetahui permasalahan yang dihadapi dan solusi yang dibutuhkan. Berdasarkan kesepahaman bersama dalam koordinasi, mitra dan tim IbM sepakat untuk melaksanakan penyuluhan hukum dengan materi mencakup hukum positif terkait topik tersebut dan perspektif hukum Islam. Peserta teridir dari pengurus MHH Pimpinan Cabang ‘Aisyiyah (PCA di Banyumas) yang berjumlah 28 cabang. Masing-masing cabang mengirimkan minimal 2 pengurus MHH, maka total peserta yaitu 56 orang.Peserta mengetahui melalui media masa bahwa tren kekerasan terhadap perempuan dan anak meningkat. Mitra tidak pernah mengakses informasi resmi yang diterbitkan oleh Komnas Perempuan dan Anak maupun data statistik yang diterbitkan oleh Badan Pusat Statistik khususnya Kabupaten Banyumas yang menyoroti jumlah kasus kekerasan terhadap perempuan dan anak. Mitra sebelumnya juga tidak memahami bahwa eksploitasi dengan cara memanfaatkan seseorang secara sewenang-wenang atau berlebihan demi keuntungan ekonomi merupakan salah satu jenis tindakan kekerasan. Eksploitasi semacam ini adakalanya terjadi di tempat kerja di mana korban tidak dipertimbangkan mengenai kepatutan, keadilan, sampai kompensasi kesejahteraan. Guna mengukur tingkat pemahaman peserta terhadap materi penyuluhan, maka dilakukan pre-test dan post-test yang melibatkan 45 responden dari total 56 peserta dan diperoleh hasil post-test yaitu 78,5% responden menjawab dengan benar dan 21,5% responden menjawab dengan salah. Sementara hasil pre-test diperoleh 61,3% responden yang menjawab benar. Hal tersebut menunjukkan bahwa 78,5% responden telah menguasai dan memahami upaya pencegahan, penanggulangan, dan penghapusan kekerasan perempuan dan anak dalam perspektif hukum Islam dan hukum positif. Dengan demikian, penguasaan mitra mengenai upaya pencegahan, penanggulangan, dan penghapusan kekerasan perempuan dan anak dalam perspektif hukum Islam dan hukum positif meningkat sebanyak 17,2% setelah mengikuti penyuluhan, yaitu dari 61,3% menjadi 78,5%.

Abstract

Marriage in Indonesia is governed by Law Number 16 of 2019, which sets the minimum legal age for marriage at 19 years for both men and women. Despite this regulation, the marriage dispensation continues in Purbalingga Regency, influenced by social, economic, and cultural factors, including premarital pregnancy and social pressure. Data indicate a decline in the number of marriage dispensation casesfrom 442 in 2022, to 398 in 2023, and 321 in 2024. This legal age stipulation aims to protect children’s rights and improve the quality of education and reproductive health among adolescents. This study analyzes two key aspects: the factors considered by judges when deciding on marriage dispensation requests and the impact of the legal age provision on early marriage practices. The research employs a normative juridical approach supported by field data. Findings reveal that judges at the Purbalingga Religious Court consider the emotional readiness of the prospective spouses, the reasoning behind the request, and the social implications of the decision. Furthermore, the age stipulation has significantly reduced instances of early marriage, with the expectation that individuals who marry at a later age possess greater emotional maturity. This study underscores the importance of child protection and public awareness regarding the appropriate legal age for marriage.
