Abstract

Domestic violence is often referred to as a hidden crime because both perpetrators and victims attempt to hide their offence from public view. According to Article 28 of the 1945 Constitution, which regulates human rights, all forms of violence, especially domestic violence, are violations of human rights and crimes against human dignity. Restorative justice system is one of the approaches used to resolve case of domestic violence. The concept of a restorative justice system is used to resolve violations of the law that occur based on victims and perpetrators’ interests. The objectives of this research is to find out the implementation of restorative justice in managing domestic violence issues in society; and to analyse the restorative justice mechanism in domestic violence cases based on the Indonesian legal system. The approach method used in this research is a normative juridical approach based on laws and regulations related to legal issues. In addition, it is also used conceptual approach based on developed perspective and doctrines in legal sciences. The settlement of domestic violence cases using penal mediation method with a restorative justice approach was succesfully resolved the criminal cases occurred in community.

Abstract

Indonesia sebagai negara yang multikultural memiliki sistem hukum yang bersifat pluralistik, di mana hukum adat tetap hidup dan berkembang di tengah masyarakat, khususnya di daerah-daerah yang masih memegang kuat nilai-nilai tradisional. Salah satu wilayah yang menampilkan peran signifikan hukum adat dalam menyelesaikan tindak pidana adalah Timor Tengah Utara, Nusa Tenggara Timur. Tulisan ini bertujuan untuk mengkaji bagaimana optimalisasi peran hukum adat dapat dilakukan dalam penanganan tindak pidana, dengan tetap mempertahankan prinsip keadilan dan tidak bertentangan dengan hukum positif. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan studi literatur, serta dianalisis secara kualitatif. Hasil kajian menunjukkan bahwa hukum adat di Timor Tengah Utara memiliki mekanisme penyelesaian pidana berbasis rekonsiliasi sosial dan keadilan restoratif. Namun, terdapat tantangan seperti potensi pelanggaran hak asasi manusia, khususnya terhadap kelompok rentan, dan minimnya integrasi hukum adat dengan sistem hukum formal. Kesimpulannya, optimalisasi peran hukum adat dalam penanganan tindak pidana memerlukan sinergi antara negara dan masyarakat adat melalui pengakuan hukum, pendampingan, dan pengawasan agar prinsip keadilan substantif tetap terjaga.

Abstract

Restorative Justice, as a transformative legal concept, aims to restore relationships and repair the damage caused by criminal acts through reconciliation between victims, perpetrators, and communities. This study employs two primary normative juridical research approaches: the Statute Approach, focusing on the analysis of laws and regulations, and the Conceptual Approach, emphasizing the understanding of legal concepts and doctrines. The integration of these approaches reveals that conventional criminal proceedings often neglect active participation in mediation and problem-solving outside the court, unlike Restorative Justice. The study underscores the importance of restoration, which extends beyond mere compensation to a broader rapprochement, facilitating mutual agreements between the victim and the perpetrator. This paradigm shift towards Restorative Justice has profound implications for legal practice, emphasizing the need for inclusive, humane, and empathetic legal processes that align with social realities and human rights.Highlights: Restorative Justice's Emphasis: Prioritizes restoration over retribution, facilitating mutual agreements between victims and perpetrators, extending beyond mere compensation. Abstract

Purpose: This study analyzes the legal framework, enforcement, and contemporary challenges of consumer protection law in Indonesia, focusing on Law No. 8 of 1999 (the Indonesian Consumer Protection Law) in the digital economy era. Methodology/approach: Normative juridical research using a literature review and comparative analysis of legislation, court decisions, and scholarly articles. Tools include Mendeley for reference management and Turnitin (no repository) for plagiarism checks. Results/Findings: This study finds that Indonesia has a strong normative consumer protection framework; however, enforcement is fragmented. Digital transactions, fintech, and e-commerce create risks that are not fully addressed by existing laws. Weak institutional coordination and low consumer awareness limit effective protection, causing many violations to remain unresolved. Conclusions: This study concludes that Indonesia’s consumer protection framework is normatively strong but faces challenges in the digital economy. The emerging risks from e-commerce and fintech have not been fully addressed, while fragmented enforcement, weak institutional coordination, and low consumer awareness limit their effectiveness. Therefore, improvements in regulatory adaptation, institutional integration, and legal literacy are required to ensure better consumer protection. Limitations: This study is limited to a normative legal analysis based on the literature and statutory review. It does not include empirical field surveys, interviews, or primary data from consumers, regulators, or business actors. Contributions: Provides updated insights for regulators, academics, and practitioners on improving consumer protection in the digital economy.

Abstract

Purpose: This study examines the legal approval of copyright over Son Horek, a traditional cultural expression originating from indigenous communities in East Java, and analyzes its socio-cultural and legal implications. The research focuses on how the transformation of Son Horek into a commercial product has triggered ownership claims that marginalize indigenous communities as the original collective custodians. Methodology/Approach: This study adopts a juridical-normative and sociological approach. It analyzes Indonesian Copyright Law No. 28 of 2014 and examines its application to traditional cultural works. The research also incorporates socio-legal perspectives to assess the impact of copyright recognition on indigenous communities and their cultural practices. Results/Findings: An imbalance exists between individual legal rights and collective indigenous rights, causing unfair recognition, cultural distortion, and the risk of criminalization. Conclusions: The study reveals a mismatch between individual-based copyright law and the collective nature of Son Horek, thereby marginalizing indigenous communities. Limitations: This study is normative and socio-legal in nature and does not include empirical field surveys or quantitative measurements. Future studies may strengthen the analysis through ethnographic research and participatory methods involving indigenous stakeholders. Contributions: This study contributes to legal and cultural scholarship by offering a critical perspective on the protection of traditional cultural expressions. It emphasizes the need for an inclusive, contextual, and justice-oriented legal framework that integrates the principle of interlegality and strengthens the role of customary institutions in recognizing collective cultural rights.

Abstract

Football, as a highly popular sport, involves the attendance of thousands of supporters who may potentially face various risks related to security, comfort, and the fulfillment of their rights as consumers. Although consumer rights are regulated under Law Number 8 of 1999 on Consumer Protection, their implementation in practice remains suboptimal, particularly with regard to the responsibility of match organizers toward supporters who suffer losses at Atletik 17 December Stadium in Mataram City. This study aims to analyze the legal protection afforded to football supporters under the Consumer Protection Law, as well as the obligations of match organizers toward supporters at Atletik 17 December Stadium. This research employs a normative legal research method with a library-based approach, utilizing primary and secondary legal materials collected through both online and offline literature studies and analyzed qualitatively. The findings indicate that significant issues persist in the provision of consumer protection for football supporters, particularly concerning aspects of security, comfort, safety, and complaint-handling mechanisms. These issues are influenced by the low level of awareness among match organizers regarding their legal obligations, weak supervision by the relevant authorities, and the lack of active participation by supporters in asserting their rights. As a result, the overall comfort and sense of security experienced by supporters while attending matches at Mangemaci Stadium remain inadequate. Therefore, strengthening consumer protection is necessary to ensure the safe and comfortable organization of football matches and to foster a harmonious relationship among supporters, match organizers, and stadium management.

Abstract

Fenomena kenaikan harga makanan dan minuman yang tidak wajar di destinasi wisata saat musim liburan menimbulkan keprihatinan publik dan mencerminkan ketidakseimbangan antara kepentingan pelaku usaha dan konsumen. Pelaku usaha sering memanfaatkan tingginya permintaan dengan cara yang mengabaikan prinsip keadilan dan transparansi dalam transaksi. Penelitian ini mengkaji disharmoni antara prinsip kebebasan berusaha, yang memberi hak kepada pelaku usaha untuk menetapkan harga berdasarkan mekanisme pasar, dan prinsip perlindungan konsumen, yang menjamin harga yang adil serta informasi yang benar. Dengan metode yuridis normatif melalui pendekatan perundang-undangan dan konseptual, penelitian ini menelaah dasar hukum penetapan harga di sektor pariwisata. Hasil penelitian menunjukkan belum adanya regulasi khusus mengenai batas kewajaran harga, meskipun prinsip dalam Undang-Undang Nomor 8 Tahun 1999 dan Undang-Undang Nomor 10 Tahun 2009 memberikan dasar normatif yang kuat bagi kebijakan hukum yang seimbang.
