Abstract

The parliamentary threshold is the minimum vote requirement for political parties in the general election to be included in determining the seats of the DPR-RI in Senayan. Problems arise when the parliamentary threshold is unable to simplify political parties so that it affects the stability of the presidential government. This study aims to determine how the design of the simplification of the parliamentary threshold is in strengthening the presidential system and to determine the relationship between the simplification of political parties and the presidential system. This type of research is normative research that uses secondary data sources. Based on the results of the study, it is known that the parliamentary threshold always changes in every election, starting from the first election to the 2024 election. The design to achieve the goal of simplifying parliamentary political parties to strengthen the presidential system is to increase the parliamentary threshold. Furthermore, there is a relationship between the simplification of political parties and the presidential system. If the number of political parties that win seats in parliament is small, then the presidential system becomes effective and government stability is maintained. However, if the number of parties that exceed the threshold is large, policy making will affect government stability, so that there will be many conflicts of interest, and government stability becomes unstable.

Abstract

Child violence is an urgent legal issue in Indonesia, including in North Labuhanbatu Regency, which still faces institutional capacity limitations in handling such cases. This study aims to analyze the authority of local governments in handling child violence cases based on applicable legislation, as well as to examine the forms of legal accountability applicable to local governments in cases of negligence or inaction. The research employs a normative juridical method with statutory, case-based, and comparative approaches. Data were obtained from literature studies, legal documents, and interviews with stakeholders in North Labuhanbatu Regency. The findings indicate that local governments possess authority derived from Law Number 23 of 2014 on Regional Government, Law Number 35 of 2014 on Child Protection, and Presidential Regulation Number 101 of 2022 concerning the National Strategy for the Elimination of Violence against Children.However, implementation remains hampered by overlapping regulations, budgetary constraints, and weak inter-agency coordination. Legal accountability of local governments can be constructed through administrative law and civil law mechanisms on the basis of onrechtmatige overheidsdaad. This study concludes that strengthening regional regulations, enhancing institutional capacity, and integrating unified reporting systems are strategic measures for advancing child protection at the local level.

Abstract

The determination of state financial losses is a fundamental element in corruption law enforcement. Current judicial practice indicates a tendency among law enforcement officials to utilize public accountant audit results as the primary basis for establishing the element of state losses, which constitutionally falls within the domain of authority of the Audit Board of Indonesia (Badan Pemeriksa Keuangan - BPK). This study aims to dogmatically analyze the legal standing of public accountant audit results within the administrative law system and to examine the juridical implications of their use as an evidentiary instrument through an examination of the Medan District Court Decision Number 58/Pid.Sus.TPK/2022/PN.Mdn. This study employs a normative juridical method with a statutory approach (statute approach) and a case approach (case approach). The findings conclude that from an administrative law perspective, public accountants lack attribution, delegation, or mandate authority to issue state administrative decisions. Public accountant audit results are characterized by reasonable assurance, which is subject to a professional standards regime rather than constituting final legal truth. The utilization of public accountant opinions as the basis for determining state losses by the court in the a quo decision constitutes a category error that reduces the principles of legal governance to the supremacy of technical expertise. Furthermore, the analysis of trial facts and the Constitutional Court Decision Number 003/PUU-IV/2006 demonstrates a failure to disentangle the causality of criminal liability, which proportionately results in a distortion of the application of substantive criminal law against private legal subjects.

Abstract

The Regional Revenue and Expenditure Budget (Anggaran Pendapatan dan Belanja Daerah - APBD) constitutes a legal instrument and a financial management guideline aimed at fulfilling public services in accordance with the principle of regional autonomy. This study examines the drafting process of the APBD, the legal standing of the Regional House of Representatives (Dewan Perwakilan Rakyat Daerah - DPRD), and the mechanism for establishing joint approval between the Regional Head and the DPRD within the Government of Labuhanbatu Regency. This research is a normative legal study employing a statutory approach with a descriptive-analytical specification. Data collection was conducted through library research of primary and secondary legal materials, which were subsequently analyzed using a qualitative juridical method. The findings indicate that the formulation of the APBD constitutes a governmental legal act executed through progressive stages, commencing from the Regional Government Work Plan (Rencana Kerja Pemerintah Daerah - RKPD), the General Budget Policy and Temporary Budget Priority and Ceiling (Kebijakan Umum Anggaran dan Prioritas Plafon Anggaran Sementara - KUA-PPAS), to the Budget Work Plan (Rencana Kerja Anggaran - RKA). The legal standing of the DPRD is manifested through its function of channeling public aspirations, executing the budgetary function, and acting as a co-equal element alongside the Regional Head in regional administration. The enactment of joint approval in determining the APBD serves as a formal validity requirement for regional legal instruments, while simultaneously manifesting the division of authority. The implementation of the APBD in Labuhanbatu Regency necessitates more precise planning synchronization and the capacity strengthening of the DPRD’s budgetary function to prevent budget deficits and discrepancies within planning documents.

Abstract

Sistem kepartaian yang baik sangat menentukan bekerjanya sistem ketatanegaraan berdasarkan prinsip checks and balances dalam arti yang luas. Partai politik sebagai corong demokrasi telah bergeser pada sebuah institusi yang lebih berorientasi pada politik pragmatisme dan dikhawatirkan akan berwujud oligarki partai politik. Efektif bekerjanya fungsi-fungsi kelembagaan negara itu sesuai dengan prinsip check and balances berdasarkan konstitusi juga sangat menentukan kualitas sistem kepartaian dan mekanisme demokrasi yang dikembangkan di suatu negara. Metode analisis dalam tulisan ini yuridis normatif dengan menggunakan pendekatan undang-undang dan pendekatan konseptual. Rekrutmen politik yang adil, transparan, dan demokratis pada dasarnya adalah untuk memilih orang-orang yang berkualitas dan mampu memperjuangkan kepentingan rakyat dalam mewujudkan mensejahterakan dan menjamin kenyamanan dan keamanan hidup bagi setiap warga negara. Seleksi calon yang melibatkan anggota partai begitu penting dalam demokrasi karena seleksi calon merupakan salah satu fungsi khas partai dalam demokrasi.

Abstract

This study examines the application of civil law to a case of default in the Rantauprapat District Court Decision Number 9/Pdt.GS/2022/PN Rantauprapat. The research method uses a normative juridical approach with literature review and decision analysis. The results show that the judge has applied the provisions of the Civil Code, specifically Articles 1243 and 1250, by imposing a debt repayment obligation, a 6% per annum moratorium interest, and seizing collateral on the defendant's assets. This decision reflects legal protection for creditors and the application of the principle of pacta sunt servanda. However, obstacles to the execution of the decision and the slow judicial process remain major obstacles. This study recommends improving regulations related to the execution of decisions and the application of dwangsom to ensure legal certainty.

Abstract

Transformasi pelayanan publik digital menjadi agenda penting dalam reformasi administrasi pemerintahan Indonesia. Perubahan ini ditandai oleh implementasi Sistem Pemerintahan Berbasis Elektronik (SPBE), percepatan keterpaduan layanan digital nasional, dan penguatan GovTech melalui INA Digital. Penelitian ini bertujuan menganalisis tantangan regulasi dan akuntabilitas pemerintahan dalam transformasi pelayanan publik digital di Indonesia. Penelitian menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa digitalisasi dapat memperkuat efisiensi, transparansi, keterlacakan tindakan pemerintahan, dan akses masyarakat terhadap layanan. Namun, hasil penelitian terdahulu juga menunjukkan bahwa fragmentasi regulasi, tumpang tindih kewenangan, kesenjangan kapasitas daerah, risiko pelindungan data pribadi, rendahnya interoperabilitas, dan mekanisme keberatan digital yang belum kuat masih menghambat akuntabilitas pemerintahan. Penelitian ini merekomendasikan harmonisasi regulasi, penguatan standar interoperabilitas, pembagian kewenangan yang jelas, audit hukum teknologi, serta jaminan perlindungan hak warga negara dalam layanan digital.
