Abstract

Narcotics is a serious Nation problem and must be resolved immediately by the state and government. Considering that narcotics users are increasingly difficult to overcome, and most of the users are teenagers, so analyzing a study (Case Study) is needed. This study aims to understand and analyze the results of decision No.178 / Pid Sus / 2018 / PN MR against narcotics users in the Mojokerto District Court. The method used in this study uses normative legal research methods to test so that there is a theoretical relevance to the research methods needed. The approach taken by researchers is the Normative Approach and the Concept Theory Approach. Adjusting to the scope and identification of the problems that exist in this study, researchers used Primary Legal Materials obtained directly from the object of field research on the results of decision No. 178 / Pid Sus / 2018 / PN MR in the Mojokerto District Court, law books, Law no. 35 of 2009, the Criminal Code and the Criminal Procedure Code, Secondary legal material in the form of literature and Tertiary studies as a guide and explanation of Primary and Secondary legal sources. After conducting research it was found that the decision No.178 / Pid Sus / 2018 / PN MR which was decided by the judge against narcotics users with the weight of evidence less than 1 gram should be rehabilitated instead of being convicted.

Abstract

The study aims to find out and analyse what qualifications for criminal acts of Macar and to know and analyze when the perpetrators of the matter convey public opinion can be categorized as Makar crime. The methods of study used are normative juridical, based on the principles of the law, the rules of the law and the legislation or books/literature relating to Makar action. Normative legal research is a study that examines prevailing norms including laws that have relevance to the problem as the source of legal material. Based on the results of the study can be concluded that communicating in public is permissible because it is part of human rights, namely the right of freedom to convey opinion as stipulated in article 28 CONSTITUTION of the Republic of Indonesia year 1945. Expressed opinion may be categorized as a criminal offence if it meets the provisions of article 88 of KUHAP. In article 88 the criminal CODE stated that there is an evil agreement, if two or more people have agreed to commit the crime, continued in article 88 of the bus with the overthrow of the government is negating or changing the form of unauthorized government under the Constitution. Therefore, presenting opinions in public can be categorized as Makar action if it is evident that in the implementation there is an indication or that has an intention to overthrow the government, with the intention to kill, or seize independence, or negate the ability of the President or vice President ruled.

Abstract

Tujuan penelitian ini untuk menganalisis dan mengetahui kewenangan Penyidik Pengawai Negeri Sipil (PPNS) Kehutanan terkait dengan TPPU sebagai upaya pencegahan pemberantasan TPPU. Hasilnya diharapkan bisa memberikan masukan terhadap lembaga terkait dan penyelenggara negara khususnya penyidik dalam upaya pemberantasan kejahatan illegal logging terkait dengan TPPU, sehingga kejahatan dibidang kehutanan bisa dijerat dengan Undang-Undang TPPU. Mendorong legislatif (Dewan Perwakilan Rakyat) merevisi apa yang kurang khususnya perluasan penyidik TPPU serta Langkah baik penanganan TPPU dengan memberikan adanya kepastian hukum dan keadilan didalam penegakan hukum secara nasional. TPUU adalah kejahatan lanjutan dari tindak pidana asal. Pada intinya Pencucian uang ialah mengejar harta hasil dari kejahatan dimana jenis kejahatan yang disebut dalam Pasal 2 Ayat (1) UU No. 8/2010 TPPU. Didalam kewenangannya PPNS Kehutanan untuk melakukan penyidikan kejahatan hanya terbatas dibidang kehutanan sebagaimana diatur dalam UU kehutanan.

Abstract

”Article 4 of the Child Protection Act that every child has the right to live, grow and participate properly and participate in accordance with human dignity and dignity, and get protection from violence and discrimination . The problem in this study is how the characteristics of children in conflict with the law can be detained. The research method used is normative legal research. "Legal research is a process to find the rule of law, legal principles, and legal doctrines in order to answer the legal issues at hand". The legislative approach method is used to understand the hierarchy of laws and principles contained in legislation. The law approach is carried out by examining all laws and regulations relating to the legal issues being addressed. The results of the study are an argument to solve the issue at hand. The conceptual approach is carried out when it does not depart from existing legal rules. This was done because there was indeed no or no legal rules for the problems faced "Against the perpetrators of child crime, which was detained by the police is a violation of human rights by depriving the freedom of children in conflict with the law. Children should get special treatment, not detention detention, but house arrest. Thus making children able to overcome their mistakes without feeling pressured by law enforcement.

Abstract

The absence of provisions regulating Judicial Pardon (Rechterlijk Pardon) in the current Indonesian Penal Code and Criminal Procedure Code has created a legal vacuum. Judges are normatively bound to issue one of three verdicts: conviction, acquittal, or dismissal. This limitation excludes the possibility for judges to apply discretionary forgiveness in cases involving minor offenses or mitigating circumstances. Although Article 54 paragraph (2) of Law No. 1 of 2023 concerning the Penal Code introduces the concept of Rechterlijk Pardon, it fails to provide clear parameters regarding what constitutes “minor severity of the act,” as well as the personal background of the offender or contextual factors surrounding the offense. This vagueness raises concerns over legal uncertainty and inconsistency in judicial interpretation. The purpose of this study is to examine the normative foundation and interpretive scope of the Judicial Pardon doctrine under Article 54 paragraph (2) and to formulate a legal construction that harmonizes substantive and procedural criminal law. This research is normative in nature, using a combination of statutory, conceptual, philosophical, case, and comparative approaches. The findings demonstrate that Judicial Pardon must be explicitly regulated through clear interpretive guidelines to ensure its implementation does not conflict with the principles of justice and legal certainty. Moreover, the integration of Judicial Pardon into the Draft Criminal Procedure Code is necessary to provide formal procedural legitimacy for judges to refrain from sentencing in specific circumstances, thus ensuring the penal system accommodates fairness, humanity, and proportionality in the enforcement of criminal justice.

Abstract

This article aims to discuss and analyze the nature of justice-based compensation payments to victims of fraud, the problem approaches used are a conceptual approach, a statutory approach, a comparative approach, a case approach and finally a philosophical approach. This research uses normative research by studying and understanding law as norms or positive legal rules. Sources of legal materials are obtained from legislation, literature books, theory and legal journals. Where later it will be used to find out what the essence of compensation payments should be that provides justice for victims of criminal acts of fraud to obtain their rights, namely through the reconstruction of regulations by adding sanctions in the form of criminal compensation for losses experienced as a result of the criminal act, due to criminal witnesses who were present. This applies only to giving prison sentences without paying attention to the victims.
