Abstract

Domestic violence is a critical issue affecting many individuals and families in Indonesia, with varied impacts across urban and rural areas. This study examines the implementation of the Restorative Justice approach in resolving domestic violence cases in these contexts and identifies factors influencing its effectiveness. Using a mixed-methods approach, the research combines quantitative analysis through surveys and qualitative insights from in-depth interviews. Data were collected from 300 respondents, including victims, offenders, and mediators, from urban and rural settings, alongside interviews with key stakeholders. The findings reveal significant differences in acceptance and satisfaction with Restorative Justice processes between urban and rural populations. In urban areas, higher legal awareness and access to trained mediators contribute to a 70% satisfaction rate, reflecting better participation and understanding of the process. In contrast, rural areas exhibit a lower satisfaction rate of 50%, hindered by cultural norms, limited legal knowledge, and a shortage of qualified mediators. Despite these challenges, Restorative Justice shows promise in addressing domestic violence by fostering dialogue, accountability, and reconciliation, emphasizing victim empowerment and offender rehabilitation. This study underscores the necessity of adapting Restorative Justice practices to local socio-cultural contexts to enhance effectiveness. Recommendations include developing tailored mediator training programs, increasing public awareness, and integrating community leaders into the process to build trust and legitimacy. The research contributes to the discourse on legal reform by highlighting the potential of Restorative Justice to create a more inclusive, responsive, and sustainable mechanism for resolving domestic violence cases in Indonesia. These findings are pivotal for policymakers in designing adaptive strategies to bridge the urban-rural divide and strengthen the justice system.

Abstract

This study analyzes the legal challenges and opportunities surrounding cryptocurrency regulation in Indonesia. With the rising popularity of digital assets, the Indonesian government has introduced a regulatory framework through the Commodity Futures Trading Regulatory Agency (BAPPEBTI), Bank Indonesia (BI), and the Financial Services Authority (OJK) to manage cryptocurrency trading and mitigate associated risks. The research uses a qualitative descriptive-analytical approach, examining primary data from regulatory documents and secondary data from international regulatory frameworks, to highlight the complexities of implementing an effective regulatory structure. Findings reveal that while Indonesia's restrictive regulations protect financial stability, they limit broader adoption and innovation in the digital economy. Comparisons with Japan and the European Union suggest that a more flexible regulatory approach could balance consumer protection with digital innovation. This study recommends public education and regulatory adaptation to respond dynamically to the fast-evolving cryptocurrency market.

Abstract

Konsumen dalam transaksi e-commerce mempunyai posisi tawar yang lemah, sehingga konsumen perlu mendapatkan perlindungan hukum dari tindakan pelaku usaha atau penjual yang merugikan konsumen. Artikel ini bertujuan untuk menganalisis perlindungan hukum bagi konsumen dalam perjanjian jual beli pada e-commerce di Indonesia. Penulisan ini mengunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Menurut penelitian ini bahwa hak-hak konsumen dalam transaksi e-commerce memerlukan perlindungan dari tindakan pelaku usaha atau penjual, di antaranya dalam Undang-Undang Perlindungan Konsumen Undang-Undang Informasi dan Transaksi Elektronik, dan Peraturan Pemerintah Penyelenggaraan Sistem dan Transaksi Elektronik yang memberikan jaminan hukum bagi konsumen dan mengatur tanggung jawab atas kerugian yang dialami oleh konsumen jika penjual melakukan wanprestasi

Abstract

Violence today does not only occur in the real world, but with the development of internet technology, it opens up opportunities for perpetrators to commit acts of violence by utilizing the internet, known as online gender-based violence (GBV). KBGO is more vulnerable to women and children, which not only causes suffering for victims physically, psychologically and even economically. The rights of victims have been deprived and their interests have been harmed by the perpetrators, so victims really need legal protection so that their rights are restored and their interests can be protected. Legal protection for victims of violence is provided by considering the losses suffered by victims, namely in the form of material and immaterial losses. Legal protection for women victims of online gender-based violence (KBGO), not only imposes punishment on the perpetrators of violence in the form of imprisonment and/or fines, but also provides the rights of victims who have been deprived and whose interests have been harmed by the actions of the perpetrators. The punishment that can be imposed on the perpetrators of violence has been regulated in Law Number 12 of 2022, including in the provisions of Article 14 and Article 15, with imprisonment and/or fines, even restitution, imposition of additional punishment or measures in the form of rehabilitation for the perpetrators, as stipulated in Article 16 and Article 17 of Law Number 12 of 2022. For legal protection of the rights of victims of violence, among others, it is regulated in Article 66 to Article 70 of Law Number 12 of 2022, which includes the right to handling, the right to protection and the right to recovery.Keywords:KBGO, Legal Protection, Victims, Women
