Abstract

The Covid-19 pandemic has become one of the most unexpected problems, and has had a significant impact on all sectors. Not only the health sector, but also education. The pandemic is forcing all parties to change the pattern and method of education, as well as forcing them to adapt quickly. Various learning process activities are carried out online, but various research results show the weaknesses of this method. Starting from the effectiveness of the learning process, dependence on communication devices (cell phones and laptops), to various legal problems faced by teachers, students, and parents of students. This service program aims to provide reinforcement in terms of protection for teachers and students during the pandemic by involving multi-sectors (Universities-Legal Aid Institutions-Teachers' Union). The partner in this activity is the Indonesian Teachers Association (PGRI) in Mirit District, Kebumen Regency, Central Java. The implementation method in this service uses several things, namely: (1) socialization, (2) education, (3) legal assistance, (4) partner networks. Through this service program, it is hoped that in addition to realizing collaboration between institutions: the Faculty of Law UNNES-LBH-PGRI, it is also hoped that this activity can provide encouragement for teachers in increasing the capacity of legal assistance.

Abstract

Employees are one of the most important elements in an organization. This study aims to determine the effect of rewards on employee performance through job satisfaction of non-PNS employees at the Kediri District Transportation Office. This research is included in qualitative research with 3 variables which are Reward, Performance, and Job Satisfaction. The sample used was 48 people with a sample determination using saturated non-probability sampling technique. The measurement scale used is the ordinal scale through the Likert scale with the respondent's answer score 1 to 5. The hypothesis testing in this study uses Partial Least Square Structural Equation Modeling (SEM) statistical analysis and descriptive analysis. The results of the study concluded that reward had no significant effect on employee performance. However, through job satisfaction, rewards have a significant influence on performance.

Abstract

Indonesia merupakan sebuah negara kepulauan dimana mayoritas penduduknya bekerja di sektor perikanan, dalam hal ini bekerja sebagai anak buah kapal (ABK). Bekerja sebagai seorang ABK tentunya memiliki resiko tinggi yang harus diambil utamanaya menyangkut keselamatan. Banyaknya fenomena ABK yang menjadi objek pelanggaran HAM yang bervariasi mulai dari eksploitasi, korban tindak pidana perdagangan orang, korban perbudakan di atas kapal asing, membuat pemerintah disini perlu untuk memberikan upaya perlindungan bagi para ABK. Namun, masih minimnya kebijakan serta pengawasan tata kelola berakaitan dengan perekrutan ABK saat ini menjadi permasalahan yang harus diperhatikan oleh pemerintah. Penelitian ini akan menganalisis tentang berbagai aspek hukum, khususnya aspek pemenuhan hak para ABK dalam memperoleh perlakuan dan pekerjaan yang layak sebagaimana tertuang dalam Konvensi ILO 188 Tahun 2007. Tujuan dari penelitian ini adalah mengetahui kebijakan apa yang seharusnya diambil oleh pemerintah dari segi peraturan hukum bagi para ABK yang rentan mengalami pelanggaran HAM. Metode yang digunakan adalah yuridis normatif. Penelitian ini menegaskan bahwa penting untuk segera melakukan ratifikasi Konvensi ILO 188 Tahun 2007 sebagai bentuk tanggung jawab pemerintah dalam mengisi kekosongan hukum dan regulasi nasional untuk mencapai kepastian hukum sebagai upaya mencegah dan mengatasi permasalahan ketenagakerjaan di dunia perikanan dan kelautan.

Abstract

   Bekerja merupakan hak konstitusional bagi setiap warga negara, sehingga setiap manusia diberikan hak untuk bekerja serta bebas memilih pekerjaan yang sesuai dengan kemampuan yang dimiliki. Akan tetapi penerapan klausul non-kompetisi dalam sebuah perjanjian kerja dapat membatasi seorang pekerja atas kebebasan memilih pekerjaan setelah pemutusan hubungan kerja. Penelitian ini bertujuan untuk membandingkan pengaturan terkait klausul non-kompetisi dalam perjanjian kerja di Indonesia, Malaysia, dan Singapura guna menganalisis kelebihan dan kelemahan dalam pengaturan klausul non-kompetisi di Indonesia sekaligus memberikan rekomendasi alternatif bagi perlindungan tenaga kerja terkait pencantuman klausul non-kompetisi dalam perjanjian kerja. Penelitian ini menggunakan jenis penelitian normatif dengan pendekatan perundang-undangan dan pendekatan komparatif. Adapun hasil dari penelitian ini adalah pengaturan terkait larangan penggunaan klausul non-kompetisi di Malaysia dan Singapura diberikan pengecualian terbatas. Indonesia sendiri belum secara tegas mendefinisikan dan mengatur penggunaan klausul non-kompetisi ke dalam hukum positif. Terhadap perjanjian kerja yang berisi klausul non-kompetisi dan memberatkan pihak pekerja dapat melakukan upaya-upaya hukum demi tercapainya kepastian hukum bagi pekerja seperti permohonan penetapan pembatalan perjanjian serta pengajuan keberatan kepada Pengadilan Negeri.

Abstract

The implementation of the decisions of the State Administrative Court (PTUN) in positive law has been strengthened by using administrative and civil coercive measures in the form of imposition of forced money. However, in the decision execution mechanism, the Administrative Court does not have an executive body, so that the State Administration Officer is often disobedient and does not implement the Administrative Court decisions. Thus, citizens' constitutional rights to justice that have been decided by the State Administrative Court can be threatened. This study aims to compare the PTUN system in Thailand and Indonesia and analyze the urgency of contempt of court action. This research uses normative research with a statutory approach and a comparative approach. The results of this study are that there is no regulation regarding the contempt of court and the executorial institutions of the Administrative Court decisions in Indonesia. Meanwhile, Thailand already has a contempt of court regulation and an executive body that functionally carries out the execution of litigants. Therefore, the regulation and implementation of contempt of court to State Administration Officials who do not implement the Administrative Court decisions is an urgency to increase the effectiveness of the execution of Administrative Court decisions in Indonesia.
