Abstract

Pengabdian masyarakat bertujuan untuk membantu masyarakat lokal memahami dan mengatasi sengketa tanah waris yang kerap terjadi di wilayah mereka. Program ini dimulai dengan observasi lapangan untuk mengidentifikasi pola-pola konflik dan pendekatan penyelesaian yang ada, diikuti oleh penyuluhan hukum yang melibatkan dosen fakultas hukum dan tokoh adat. Metode dialog interaktif digunakan untuk mendorong partisipasi aktif dari 40 peserta, termasuk pemerintah desa, masyarakat, dan mahasiswa. Selain itu, pendampingan langsung diberikan kepada warga yang terlibat dalam sengketa tanah waris untuk membantu mereka memahami proses hukum formal dan mediasi adat. Monitoring dan evaluasi menggunakan aplikasi Google Forms dilakukan untuk mengukur tingkat kepuasan dan pemahaman masyarakat, yang hasilnya menjadi bahan evaluasi untuk perbaikan program di masa depan. Dengan pendekatan yang menggabungkan hukum formal dan kearifan lokal, program ini berupaya menciptakan solusi yang berkelanjutan dan harmonis dalam penyelesaian sengketa tanah waris. Solusi berkelanjutan dalam penyelesaian sengketa tanah waris di Desa Popaya didasarkan pada penguatan pemahaman masyarakat terhadap hukum agraria dan nilai-nilai adat yang berlaku. Dengan memberikan penyuluhan yang komprehensif, masyarakat diharapkan dapat mengenali hak-hak mereka sebagai ahli waris serta memahami langkah-langkah hukum yang perlu diambil untuk menyelesaikan konflik secara damai

Abstract

This study analyzes the legal protection of coastal boundary land within the framework of people-based economic management in Tomini Bay. Based on normative legal research methods, the study examined the 1945 Constitution Article 33, the 1960 Law, the Spatial Planning Law, Law 27/2007 jo. Law 1/2014, Presidential Regulation 51/2016 on coastal boundary boundaries, and Law 32/2009 on PPLH, to map the gap between norms and practices. The results of the analysis show three main problems: (1) weak implementation and enforcement of the law on violations of border utilization; (2) conflicts of control and ownership due to unclear land status, lack of mapping, and certification; and (3) unsustainable exploitation of resources that damages coastal ecosystems and threatens livelihoods. This study recommends strengthening legal certainty through participatory mapping and social certification, integrating national law with local wisdom (customary deliberation/mediation), and co-management models involving the government, community, and private sector. Thus, the Indonesian border land can be managed fairly, provide certainty of rights, and sustainably support coastal welfare.

Abstract

Border Land Management in coastal areas often presents juridical and social problems, including in Dembe I Village, Gorontalo City. Communities in this region face uncertainty about the legal status of the boundary land they occupy, although some have pocketed title certificates. The lack of legal understanding, the absence of village mediation institutions, and overlapping land administration add to the complexity of the problem. The thematic real work lecture (KKN) Program Phase II of Gorontalo State University was implemented to respond to these problems through a participatory and collaborative approach. The methods taken include legal counseling with the National Land Agency and the Faculty of law, citizen dialogue forums, participatory mapping, and the preparation of operational standards for land mediation procedures. The results of the activity showed an increase in Community Legal Literacy, the birth of critical awareness about the differences in formal rights and functions of space, as well as the drafting of mediation SOP documents as a local instrument for non-litigation dispute resolution. The conclusion of this activity confirms that the law can be presented in a communicative way to bridge the interests of the state in maintaining protected areas with the rights of communities in maintaining living space. This finding also implies that the model of service based on participatory legal education can be replicated in other coastal areas facing similar problems
