Abstract

Akses layanan kesehatan di Indonesia masih menjadi suatu permasalahan yang memerlukan solusi nyata sehingga dalam hal ini pemerintah merumuskan berbagai kebijakan guna terlaksananya akses kesehatan yang merata bagi penduduk. Solusi atas kemudahan akses layanan kesehatan dengan hadirnya telemedicine yang di dalamnya terdapat layanan penyelenggara sistem elektronik farmasi. Pedoman pelaksanaan legal compliance keberadaan penyedia layanan elektronik farmasi yang telah terdaftar di Indonesia dan penerapan tanggung jawab hukum penyedia layanan elektronik farmasi. Pendekatan penelitian menggunakan yuridis normatif, dengan pendekatan perundang-undangan (statute approach). Keberadaan penyelenggara layanan elektronik farmasi telah melaksanakan legal compliance hingga memperoleh izin dari Kementerian Kesehatan dan tanggung jawab hukum yang diberikan oleh penyedia layanan tertuang dalam syarat ketentuan pada laman situs.

Abstract

The purpose of this research is to determine the process of formation and legal consequences of Kradenan Village Regulations, Kaliwungu District, Semarang Regency No. 11 of 2022 concerning Village Market Levies. The research subjects were traders at Kradenan Village's Firm Market. The research method used is an empirical juridical approach. Data collection techniques are literature study, interviews, observation and documentation. The qualitative descriptive data analysis technique is in the form of an interactive analysis model. The results of the research show that the process of forming village regulations regarding village market levies is 1) village regulations are determined by the village head with the BPD, 2) hamlet deliberation 3) village deliberation, 4) village head conveys village regulations to the regent or mayor through the subdistrict head as a supervisory control or coaching, 5) Village government and BPD disseminate information regarding Kradenan Village regulations, Kaliwungu District, Semarang Regency No. 11 of 2022 concerning village market levies on the community and stakeholders. The legal consequences of village regulations regarding village market levies are warning sanctions and administrative sanctions for violations and non-compliance with these regulations. The conclusion of the research is that the impact of village regulations regarding village market levies is very significant in increasing PAD, empowering village-owned assets, prospering and improving the economy of village communities. To optimize PAD, it needs to be determined and regulated in village market levies

Abstract

The imported used clothing trade was found in Sukoharjo and has penetrated into modern markets such as the Hartono Trade Center (HTC). The import and trading activities of used clothing are prohibited by law because Imported used clothes have the potential to carry diseases. The purpose of this study was to determine law enforcement by the Department of Cooperatives, Small and Medium Enterprises and Trade in Sukoharjo Regency regarding the trading of imported used clothing in HTC and factors that affect the effectiveness of law enforcement. The research method used is empirical law with a sociological juridical approach while the data analysis technique is in the form of qualitative descriptive. The results obtained are law enforcement on the trade of imported used clothing carried out by the Office of Cooperatives, Small and Medium Enterprises and Trade of Sukoharjo Regency is not running optimally because monitoring and providing outreach activities related to imported used clothing and its dangers have never been carried out. Factor that affect the effectiveness of law enforcement on imported used clothing are internal factors, namely limited human resources and external factors, namely the legal awareness of traders and consumers who are still lacking in complying with laws and regulations.

Abstract

The aim of this research is to determine the mechanisms and obstacles to managing village property, as mandated in Article 77 paragraph (1) of Law Number 6 of 2014. The research method used is empirical juridical. The type of data, namely primary data, was obtained through interviews and discussions (group discussion forum) with several parties to provide information related to the management of village property. Secondary data is data obtained from library literature. Data collection techniques commonly used are literature studies, interviews, observations. Qualitative descriptive data analysis techniques. The results of the research show that the mechanism for managing village property as mandated by Article 77 paragraph (1) of Law Number 6 of 2014 is planning, procurement, use, utilization, security, maintenance, deletion, transfer, administration, assessment, guidance, supervision and control. . Inventory village assets in the SIPADES application, check the depreciation in the value of goods, including land, buildings and other assets. Providing information about village asset management to the general public so that village asset management is reported annually. Obstacles to managing village-owned assets include lack of knowledge of human resources regarding village asset management, SIPADES officers being disorganized in inputting data, the community not caring about maintaining village assets, lack of communication regarding the implementation of village asset management regulations. The conclusion of this research is that the village's wealth management mechanism is to inventory its assets in the SIPADES application and can reduce problems.

Abstract

The development of business entities by utilizing technology in this case digital startups makes it necessary to see the problems of legal aspects faced by partners in this case digital startups business entities at the incubation stage. The purpose of community service is to provide an understanding of the fulfillment of legal aspects for digital startups business entities. The service method is carried out by selecting partners, determining the title of the service, conducting preliminary research, preparing an activity proposal and applying for a license to carry out the service. The results of this community service have found that there are still obstacles related to the legality process for business entities in this case determining the form of business entity that will be used in running their business, so it is necessary to provide further legal aspects assistance related to taxation and intellectual property in the form of brands owned by business entities.

Abstract

The development of technology utilization in terms of the business sector in various fields makes its own challenges in providing consumer protection. then it is necessary to know that the Personal Data Protection of telemedicine service users provides consumer protection accommodation. There are aspects of protection for consumers as service users of personal data. Control of personal data should be carried out by companies that use technology in their business activities, in this case the organizers of electronic systems as required by existing regulations. The protection of consumers has been accommodated in the Consumer Protection Law (1999). Problems with data leaks that occur in Indonesia are problems experienced by consumers as users of digital services. Protection of personal data is a basic right of citizens and therefore the role of the State as the competent authority in the management and regulation of personal data. To ensure accommodation of personal data protection in the business development of digital start-up companies, it is necessary to study the accommodation of personal data protection as a form of protection for consumers in the Consumer Protection Law ( 1999) by Digital Start-up Companies as service providers. Normative research method with conceptual and legal approach is used to explain the facts. The results of this study show that the Consumer Protection Law (1999) on Consumer Protection has not provided regulatory accommodation that provides data protection for consumers of telemedicine. Output from this research can be a guideline for consumer protection practices in digital start-ups as required by the Consumer Protection Law (1999) and recommendations for relevant stakeholders in digital start-up services.Keywords: Consumer Protection; Personal Data Protection; Start-Up.

Abstract

The purpose of this research was to find out what the legal analysis about processing land certificates in Sidomulyo Village, Ampel District, Boyolali Regency and the process was in processing land certificates at the National Land Agency (BPN) Boyolali Regency in the Sidomulyo Village area, Ampel District. This research was a type of normative legal research. From an etymological perspective, normative legal research is also called legal research, normative legal research, or normative juridical onderzoek. Normative legal research is legal research, which legal analysis through concepts, norms, or rules that exist in society and became a reference for everyone's behavior. When viewed from the legal aspect, the implementation of land certification in the Sidomulyo village area refered to UUPA no. 5 of 1960 which is the most basic legal basis regarding land certification to date, and PP No. 24 of 1997 concerning Land Registration which regulates the process of land registration/certification by government bodies whose task is to record mapping of community land and its ownership status. The process of issuing land certificates in Sidomulyo Village, Ampel District, Boyolali Regency carried out by the National Land Agency (BPN) of Boyolali Regency was considered smooth and controlled. Abstract

The Ministry of Industry of the Republic of Indonesia is committed to increasing the competitive position of industry globally from 41st to 39th in the world out of 138 countries recorded by the 2016-2017 Global Competitiveness Report. Sustainability requires careful planning, namely assessment. The herbal medicine and medicine industry is an industry with significant development, absorbing a workforce of 15 million people and continues to grow along with developments in the direction of food, beverages, cosmetics, spas and aromatherapy. This research aims to develop industrial sustainability assessment indicators implemented in the herbal medicine and medicine sector in the city of Surakarta. The method used is the Delphi method to validate indicators, then MCDM to support the decision making process. The MCDM method used is AHP, which assesses and determines the level of industrial sustainability. Respondents in this study are companies with the criteria for a workforce of more than 100 people and are registered with the Ministry of Industry.

Abstract

The business sector can never escape intellectual property. Every business conducted must have intellectual property contained therein. Intellectual property in question can be in the form of trademarks for business actors. In order to protect the economic value of business actors which is a priority value for business actors. For this reason, it is important to socialize and provide guidance to the community of business actors in Surakarta City which is adjusted to the provisions of Law Number 30 of 2000 concerning Trade Secrets and Law Number 20 of 2016 concerning Trademarks and Geographical Indications. The output of the activity is in the form of scientific publications, integration in intellectual property law. courses and uploading videos of activities on the YouTube platform.

Abstract

The existence of digital start-up growth in the existence of digital start-ups that are still looking for a business model so that it can be possible to make changes to the business model in the acceleration process, this affects the funding agreement made by the accelerator. So it is necessary to know the funding scheme for the establishment of digital start-ups and the impact of changing business models on investment contracts. The purpose of this paper is to determine the legal relationship of accelerators, in this case venture capital, to digital start-up in Indonesia, funding schemes and the legal consequences of changing business models by digital start-ups. The research method used is normative juridical, the research specification used is descriptive-analytical. The results showed that funding by Venture capital using convertible notes instrument, against investment contracts if digital start-ups do pivot. It is concluded from the results of the research that the implementation of funding by Ventures Capital will re-do the agreement with the assessment indikator. The implementation is carried out based on the Law of BUMN the Law of Limited Liability Company, the Law of Investment and the Venture capital Head Company Articles of Association.
