Abstract

ABSTRACTIndonesian supremacy of law principle is the ground rule to control the democracy flow in society. In order to do so, Pretrial institution is introduced. Pretrial, under Constitution Court Session Number 21/PUU-XII/2014, also has a jurisdiction in examining suspect naming procedure by investigator. Despite being regulated, there was found in which judge made decision to name a suspect, whereas the provision instructed the judge to only take measure and examine suspect naming by investigator, therefore undermining given regulation. This conceptual research conducted under normative method. Historical, grammatical, concept and case approach also applied. The result demonstrates that evaluating suspect naming could support and undermine Pancasila simultaneously.Keywords : pretrial, Pancasila, suspect naming, democracy  INTISARIPraperadilan hadir sebagai bentuk pengawas terhadap peran penyidik dan penuntut umum, dalam hal ini, berdasarkan putusan Mahkamah Konstitusi Nomor 21/PUU-XII/2014 menambahkan kewenangan salah satunya untuk menguji keabsahan penetapan tersangka. Wujud kontrol yang demikian ternyata tidak sepenuhnya diterapkan oleh hakim dengan baik. Peristiwa yang menjadi bukti luputnya penerapan pemeriksaan keabsahan tersangka salah satunya dimana hakim Praperadilan memerintahkan menetapkan tersangka, dengan demikian melampaui batas kewenangan. Metode penelitian yang dilakukan adalah normatif dengan pendekatan filosofis, gramatikal, konsep dan kasus. Hasil menunjukkan bahwa wewenang Praperadilan dalam menentukan keabsahan tersangka dapat mendukung, tetapi sekaligus dapat juga menjadi alat peruntuh demokrasi Pancasila.Kata kunci : praperadilan, Pancasila, penetapan tersangka, demokrasi

Abstract

This research aims to describe and explain the International Criminal Court’s jurisdictions in an effort to prevent impunity. Additionally, this research provides answer to the question of ICC’s effectiveness in upholding justice over international crimes. This research is a normative law research. The research results shows, under Rome Statute of the International Criminal Court 1998, the purpose of a trial is to end impunity over serious crimes. To implement such a purpose, ICC exercise their jurisdictions conform to Rome Statute. However, the exercise of ICC’s jurisdictions are still ineffective, such phenonemon could arise by many factors.

Abstract

Corona Virus Disease 2019 (COVID-19) has been declared by President Joko Widodo to be a National Disaster with Presidential Decree No. 12 of 2020 concerning the Determination of Non-Natural Disasters for the Spread of Corona Virus Disease 2019 (COVID-19) as a National Disaster, where this is the reason for delays or cancellations. In a contract related to force majeure. This study aims to analyze whether the Covid-19 pandemic cannot be said to be a force majeure that can cancel an engagement. This research contains a diagnostic form with a sociolegal or socio-legal research approach. The result of the discussion is that the Covid-19 pandemic, which has been designated as a national disaster by the Government, does not necessarily become the basis for changing or even canceling an engagement because the event is casuistic, which requires a comprehensive study and approach as well as evidence regarding the impact of the Covid-19 pandemic. This results in the parties being hindered in carrying out or fulfilling their achievements. Then, the Covid-19 pandemic, which is said to be force majeure, can only be used as the basis for a relative force majeure reason because the situation or event is only temporary, meaning that the Covid-19 pandemic as force majeure can only delay the implementation of achievements without canceling the engagement.

Abstract

Indonesia, like other countries in the world, struggles as pandemic strikes. Such condition force every subject involved in the criminal justice system to administer technology to suppress the spread of the virus by social distancing. However, the sudden turn to employ modern technology has made the justice system moved into a new place called the virtual court. This pandemic situation also forces the shift of the conventional criminal court to the virtual criminal court paradigm. This article discusses the history of virtual criminal court in Indonesian Criminal Justice. This research employs a descriptive-normative method. The information collected by applying a historical approach and theoretical approach.  Relevant data then studied and evaluated. The result then explained and described clearly. Indonesia is ready to implement virtual criminal justice. The shift from formal criminal court proceeding into virtual criminal court proceeding is applicable in Indonesia since 2002.Indonesia, seperti negara di dunia lainnya, mengalami pandemi yang memaksa para pihak dalam sistem peradilan pidana untuk social distancing dalam rangka menekan persebaran virus dan menggunakan teknologi. Satu sisi, Indonesia dapat dikatakan belum siap menghadapi elaborasi antara teknologi dan aplikasi hukum yang masih perlu perbaikan. Hukum Acara Pidana di Indonesia telah mengalami rangkaian perkembangan begitu juga dengan peraturan perundang-undangan lainnya yang sangat sinergis dengan teknologi seperti Undang-Undang Informasi dan Transaksi Elektronik yang mampu memperluas alat bukti. Kini hampir setiap asas dalam hukum acara pidana mengalami perubahan, khususnya proses beracara yang dari model tradisional menjadi daring. Artikel ini membahas mengenai sejarah perkembangan hukum acara pidana yang fokus utamanya mengenai pergeseran paradigma berperkara pidana luring menjadi daring. Metode penelitian yang digunakan adalah normatif deskriptif, hasil pengumpulan informasi dan data kemudian dianalisis dan dijabarkan secara eksplanatoris. Kesimpulan penelitian ini antara lain, Indonesia telah menghadapi persidangan daring jauh sebelum pandemi yakni pada saat mantan Presiden BJ Habibie memberikan kesaksian pada sebuah kasus korupsi Bulog tahun 2002 silam sehingga dapat dikatakan Indonesia telah siap menerapkan proses peradilan pidana yang bersifat daring.

Abstract

Dalam bidang hukum pidana, media massa adalah pendukung dari kebijakan hukum pidana, yaitu memberikan peran pencegahan kejahatan. Pencegahan melalui media massa sangat disarankan karena kebijakan hukum pidana tidak selamanya dapat digunakan sebagai sarana utama menekan kejahatan. Meski demikian, peran tersebut harus disertai dengan pengamalan nilai-nilai Pancasila dalam kesadaran diri masing-masing manusia Indonesia. Penelitian ini dilakukan secara normatif yakni penelitian yang mendasarkan pada kajian norma yang ada pada sistem hukum. Hukum ditelaah asas-asasnya, dijabarkan dari undang-undang, peraturan yang terkait media massa. Norma-norma terkait media massa disandingkan dengan asas-asas serta doktrin mengenai kontrol sosial oleh media massa untuk dianalisis berdasarkan penanaman nilai-nilai Pancasila pada kehidupan masyarakat Indonesia. Hasil penelitian menunjukkan bahwa pengamalan nilai-nilai Pancasila dalam peran media massa memberitakan informasi belum terlaksana. Masih banyak terdapat berita yang tidak teruji kebenarannya yang dapat merusak tatanan sosial. Media massa hanya memuat berita sebagai pemuas informasi saja tanpa menanamkan pembentukan pribadi sosial yang berjiwa Pancasila.The mass media is an essential support for the criminal policy, namely providing the role of crime prevention. Whilst penal policy is still available as solution, prevention through mass media is highly recommended because penal policies should not employed as the only way of suppressing crime. Nevertheless, the mass media must  carries the values of Pancasila as the fundamental way of life of each Indonesian citizen. This is a legal normative research which studies norms in the legal system. The law is examined by its principles, analysed thoroughly particulary any regulations regarding mass media. Norms that correspond to mass media are juxtaposed with the principles and doctrines related to social control of the mass media to be analysed based on the inculcation of Pancasila values in the lives of Indonesian citizen. The results showed that the practice of Pancasila values in the role of the mass media had not been implemented. There are still many untrustworthy news that detrimental to social order. The mass media only contains news as a satisfactory to the society without instilling the importance of Pancasila values.

Abstract

Abstract Campus as an educational institution should be a comfortable place for students to study, but gender-based violence that occurs on campus makes campus not a safe place for students. Moreover, this violence is carried out by parties who are supposed to be protectors for students, such as lecturers. The unequal power relation between lecturers and students makes students have no power to fight the violence that occurs to themselves. Furthermore, this study aims to increase awareness of gender equality and anti of gender-based violence for students, as well as provide knowledge to students in attitudes to avoid gender-based violence through organizing special classes, such as weekend classes, which are as an effort to prevent gender-based violence in campus. This research is empirical-normative legal research. The results of this study state that: Firstly, in crime prevention, the efforts that can be made are not only using criminal law (penal efforts), but also using non-penal efforts, such as through education, both formal and non-formal education. Secondly, the implementation of special classes as a non-formal education has been able to increase students' awareness and knowledge regarding gender-based violence in campus. Abstrak Kampus sebagai institusi pendidikan seharusnya menjadi tempat nyaman bagi mahasiswa untuk menempuh studi, akan tetapi kekerasan berbasis gender yang terjadi di kampus menjadikan kampus bukanlah ruang aman bagi mahasiswa untuk belajar. Bahkan, kekerasan ini dilakukan oleh pihak yang seharusnya menjadi pengayom bagi mahasiswa, seperti dosen. Relasi kuasa yang timpang antara dosen dengan mahasiswa ini menjadikan mahasiswa tidak memiliki kuasa untuk melawan kekerasan yang terjadi pada dirinya. Lebih lanjut, penelitian ini bertujuan untuk meningkatkan kesadaran kesetaraan gender dan anti-kekerasan berbasis gender bagi mahasiswa, serta memberikan pengetahuan kepada mahasiswa dalam bersikap agar terhindar dari kekerasan berbasis gender melalui penyelenggaraan kelas khusus, seperti weekend class, yang mana sebagai upaya pencegahan kekerasan berbasis gender di kampus. Penelitian ini merupakan penelitian hukum empiris-normatif. Hasil penelitian ini menyatakan bahwa dalam penanggulangan kejahatan, upaya-upaya yang dapat dilakukan tidak hanya menggunakan sarana hukum pidana (upaya penal) saja, namun juga dapat menggunakan sarana di luar hukum pidana (upaya non-penal), yang mana salah satunya melalui pendidikan, baik pendidikan formal maupun non-formal. Lebih lanjut, penyelenggaraan kelas khusus sebagai pendidikan non-formal telah dapat meningkatkan kesadaran serta pengetahuan bagi mahasiswa terkait kekerasan berbasis gender di lingkungan kampus.

Abstract

This community service project explores the vital role of Civics Education at SMA N 9 Yogyakarta in introducing students to legal concepts and general studies. Civics Education equips students with a fundamental understanding of law, citizenship, and democracy. The study employed a direct approach, revealing that Civics at SMA N 9 Yogyakarta significantly prepares students for their academic pursuits in law and general studies. This subject imparts a deep comprehension of essential legal principles, the rights and responsibilities of citizens, and democratic attitudes, guided by Civics teachers. The curriculum encompasses topics like the struggle for independence, constitutional matters, the political system, and human rights, fostering a sense of democracy, tolerance, and pluralism among students. Beyond academics, Civics hones vital social skills such as public speaking, debating, and collaboration, skills invaluable not only in legal courses but also in daily life and future careers. In summary, this community service emphasizes the critical role of Civics at SMA N 9 Yogyakarta as a strong foundation for students pursuing law and higher education.

Abstract

Socialization on making business logos and copyright registration was carried out because many SMEs shaded by the Hargo Manunggal Yogyakarta SME Communication Forum did not yet register their copyright. Furthermore, there are several SMEs that don't have a business logo at all. This happened due to a lack of education and outreach regarding the importance of logos and copyrights in business. This community service activity was attended by 26 SMEs consisting of the culinary and craft sectors. The program is carried out using a discourse, consultation and demonstration method of how to create an attractive logo and register copyright. The benefit of having a logo and copyright is that SMEs have an attractive identity, add value to the business, are legal and valid so that they cannot be imitated by other businesses. The PKM results show an increase in understanding and awareness of SMEs in creating logos and managing the legality of copyright.
