Abstract

Di era digital, konsumen bertransformasi dalam entitas-entitas baru seperti influencer, youtubers atau content bloger yang membawa perubahan dalam bentuk penyampaian pendapat dan keluhan konsumen berupa konten yang dapat dimonetisasi. Fenomena ini tidak sepenuhnya mampu diakomodir oleh Undang-Undang Perlindungan Konsumen (UUPK) dikarenakan konsumen yang dimaksud UUPK merupakan konsumen akhir yang aktivitas konsumsinya tidak untuk kepentingan komersial. Dengan demikian, review seorang konsumen yang juga merupakan influencer, youtubers, dan content blogger memungkinkan untuk tidak memperoleh perlindungan hukum. Hal ini semakin problematik dengan hadirnya beberapa preseden buruk berupa gugatan pencemaran nama baik yang dilakukan oleh pelaku usaha kepada konsumen sekaligus influencer yang menyampaikan ulasan di platform media sosial. Penelitian ini bertujuan untuk menjawab distorsi kedudukan konsumen atas hak untuk didengar di era digital, baik kedudukannya sebagai konsumen akhir dan konten yang dibuatnya sebagai influencer. Penelitian ini menggunakan penelitian yuridis normatif dengan menggunakan metode studi kepustakaan, baik bahan hukum primer dan sekunder. Asas lex consumen derogate legi consumte dapat digunakan untuk melihat kedudukan hukum lebih khusus dalam memberikan perlindungan atas ulasan konsumen. Konsumen yang mengulas atau memberikan review di media sosial tetap dapat memperoleh perlindungan hukum berdasarkan UUPK sepanjang ulasan didasarkan oleh pengalaman transaksinya dalam kegiatan konsumsi dan bukan semata-mata demi kepentingan konten yang bersifat komersial.

Abstract

This study aims to explore the urgency and relevance of the ratification of the Singapore Mediation Convention (SMC) in the context of international arbitration settlement in Indonesia. Using the juridical-normative method, this study analyzes various primary, secondary, and tertiary legal documents. Data collection was conducted through literature studies, which were then analyzed using descriptive methods and content analysis. This study highlights the substantial similarities between the SMC and the 1958 New York Convention, especially regarding the procedural aspects in international settlement settlements. However, this study found that the SMC focuses more on mediation as a non-adjudicative settlement method. The urgency of this study lies in the question of whether Indonesia needs to ratify the SMC considering the existing legal infrastructure, including the New York Convention. The results of the study state that Indonesia does not need to ratify the SMC, because the provisions in the SMC do not make a significant contribution to the dispute settlement system in Indonesia which has been accommodated by the New York Convention. This study provides a new perspective by underlining that the administrative application of the SMC is not relevant to the practical needs of dispute resolution in Indonesia. In conclusion, ratification of the KMS will not provide significant additional benefits for Indonesia, given its similarities with the New York Convention and the KMS’s more limited focus on mediation. This study provides a new contribution to understanding the role of the KMS and its relevance to the Indonesian legal system, and emphasizes the importance of considering specific needs before ratifying a new international convention. Penelitian ini bertujuan untuk mengeksplorasi urgensi dan relevansi ratifikasi Konvensi Mediasi Singapura (KMS) dalam konteks penyelesaian sengketa arbitrase internasional di Indonesia. Dengan menggunakan metode yuridis-normatif, penelitian ini menganalisis berbagai dokumen hukum primer, sekunder, dan tersier. Pengumpulan data dilakukan melalui studi pustaka, yang kemudian dianalisis menggunakan metode deskriptif dan analisis isi. Penelitian ini menyoroti adanya persamaan substansial antara KMS dan Konvensi New York 1958, terutama terkait aspek prosedural dalam penyelesaian sengketa internasional. Namun, penelitian ini menemukan bahwa KMS lebih berfokus pada mediasi sebagai metode penyelesaian sengketa non-ajudikatif. Urgensi penelitian ini terletak pada pertanyaan apakah Indonesia perlu meratifikasi KMS mengingat infrastruktur hukum yang sudah ada, termasuk Konvensi New York. Hasil penelitian menyatakan bahwa Indonesia tidak perlu meratifikasi KMS, karena ketentuan dalam KMS tidak memberikan kontribusi signifikan terhadap sistem penyelesaian sengketa di Indonesia yang sudah diakomodasi oleh Konvensi New York. Penelitian ini memberikan perspektif baru dengan menggarisbawahi bahwa implikasi administratif KMS tidak relevan dengan kebutuhan praktis penyelesaian sengketa di Indonesia. Kesimpulannya, ratifikasi KMS tidak akan memberikan manfaat tambahan yang substansial bagi Indonesia, mengingat adanya kesamaan dengan Konvensi New York serta fokus KMS yang lebih terbatas pada mediasi. Penelitian ini memberikan kontribusi baru dalam memahami peran KMS dan relevansinya bagi sistem hukum Indonesia, serta menekankan pentingnya mempertimbangkan kebutuhan khusus sebelum meratifikasi konvensi internasional baru.

Abstract

The aim of this research is to provide an understanding regarding strong and weak binding Sale and Purchase Agreement deed in terms of buying and selling houses or land carried out by the community as buyers and developers as sellers. Especially when in his journey the developer is in trouble until it occurs that the developers are declared bankrupt and and all his wealth at that time and during the process of pailit will go into the bankrupt boedel. This type of research is normative law using legislative approaches. File on research is secondary data supported by primary and secondary legal materials and obtained from library studies, which are then analyzed by qualitative methods. As for the results of this study, Firstly, the sale and purchase binding agreement is an agreement between the developer and any person to carry out the sale and purchase of a house which can be carried out by the developer before the construction of the house which is made before a notary. Second, there are two deeds of Sale and Purchase Banding Agreement, namely a deed of sale and purchase agreement which has been paid off and Whika has not yet been paid off. If the status of the sale and purchase agreement has been paid in full and was made by a notary before the developer went bankrupt, then the status of the sale and purchase agreement is very strong. On the other hand, if the developer goes bankrupt with the buyer's status still in the installment phase, does not control the object and the sale and purchase agreement was not made by a notary, then the status is weak.

Abstract

One form of business is due to current developments in financial technology (abbreviated as fintech), which means using technology to provide financial solutions. This study aims to see the responsibility of PT. Dana Agung Nusantara as the financial technology (fintech) lending provider due to default by lending recipients in the case of Central Jakarta Commercial Court Decision Number 113/Pdt.Sus-PKPU/2021/PN Jkt.Pst. This research is normative juridical research. In this study, the source of legal materials used consisted of 3 (three) legal materials, namely primary, secondary and tertiary legal materials. The technique of collecting data on legal materials is by using a literature study model using analysis of legal materials, which is used in descriptive qualitative content analysis. The results showed that the responsibility of PT. Dana Agung Nusantara as the financial technology (fintech) lending provider due to default by loan recipients by the case of Central Jakarta Commercial Court Decision Number 113/Pdt.Sus- PKPU/2021/PN Jkt.Pst that according to an OJK spokesperson, the party is responsible if The fintech collapsed is a P2P lending fintech provider. Meanwhile, if the borrower causes a default, it is the responsibility of the lender or investor.

Abstract

Rencana transformasi digital yang dilaksanakan oleh Otoritas Jasa Keuangan dalam industri perbankan telah memberikan dampak nyata dalam mempercepat evolusi perbankan Indonesia menuju basis teknologi informasi. Digitalisasi di sektor perbankan dengan mengadopsi penggunaan teknologi untuk setiap produk dan layanan terus dikembangkan untuk meningkatkan daya saing di antara para pelaku bisnis. Sementara itu, ada ancaman potensial yang dibawa oleh penggunaan teknologi yang disebut "Deepfake". Deepfake merupakan implementasi kecerdasan buatan (AI) untuk mereplikasi dan menghasilkan gambar palsu, suara, pola, dan/atau kombinasi dari mereka pada suatu subjek tertentu sehingga terlihat seperti aslinya. Teknologi ini berkembang tanpa disadari oleh sebagian besar orang mengenai potensi pencurian dan pemalsuan data identitas yang dapat dilakukan olehnya. Penelitian ini dilakukan untuk mengetahui ancaman potensial dari penyalahgunaan teknologi Deepfake di lembaga keuangan dan kesiapan regulasi serta lembaga keuangan untuk menghadapinya. Penelitian ini merupakan penelitian yuridis-normatif dengan pendekatan normatif dan konseptual. Hasil penelitian menunjukkan bahwa Indonesia perlu memiliki kerangka regulasi yang komprehensif dan implementasi yang akurat dari langkah-langkah pencegahan oleh lembaga keuangan terkait penggunaan teknologi dalam operasional bisnis mereka untuk menghindari bahaya penyalahgunaan teknologi. Penelitian ini dimaksudkan agar penyalahgunaan Deepfake dalam industri perbankan dapat diantisipasi dan dicegah sebelum muncul lebih banyak masalah hukum yang dapat merugikan bisnis dan pengguna.     The digital transformation plan carried out by Otoritas Jasa Keuangan in banking industry has made real impact on accelerating the evolution of Indonesian banking towards an information-technology-basis. Digitalization on banking sector by adapting the use of technology to each line of products and services continues to be developed to increase competitiveness among business actors. At the same time, there is a potential threat brought by the use of technology called “Deepfake”. Deepfake is an implementation of artificial intelligence (AI) to replicate and produce fake images, sounds, patterns, and/or combination of them on a particular subject so that it looks like the original. This technology evolved without being realized by most people regarding the potential for identity data theft and fabrication that can be carried out by it. This research conducted to find out the potential threat of Deepfake technology misuses in financial institutions and the readiness of regulations and financial institutions to deal with it. This study is juridical-normative research using statutory and conceptual approach. The results show that Indonesia needs to have a comprehensive regulatory framework and accurate implementation of preventive measures by financial institutions regarding the use of technology in their business operations to avoid the dangers of technology misuse. This study intended so that the misuse of Deepfake in the banking industry can be anticipated and prevented before more legal issues that can harm businesses and users arise.
