Abstract

This study aims to analyze the gap between civil law norms and social practices in the implementation of agricultural sharecropping agreements between landowners and cultivators in Tranjang Village, Siman District, Ponorogo Regency. The study employs a juridical- empirical approach by combining normative legal analysis of statutory provisions with empirical field research through observation and in- depth interviews with 15 informants consisting of landowners, cultivators, and village authorities. The findings reveal that most sharecropping agreements in Tranjang Village are conducted verbally based on mutual trust between landowners and cultivators, without written contracts or official authorization by village authorities. Such practices are rooted in agrarian social values emphasizing kinship and mutual cooperation, but do not fully comply with formal legal standards stipulated in Law No. 2 of 1960. This gap is caused by low legal awareness, complex and costly administrative procedures, social and cultural values that prioritize trust over formal rules, and the passive role of village government in facilitating contract registration. The study recommends revitalizing the role of village authorities in facilitating agricultural contracts through the provision of simple contract formats that can be legalized quickly and affordably, legal socialization with participatory local cultural approaches, and revision of Law No. 2 of 1960 to be more adaptive to the social realities of agrarian communities while ensuring legal protection for cultivators.

Abstract

The development of digital technology has driven the emergence of a new modus operandi in human trafficking crimes, namely technology-based human trafficking through online scam schemes. This phenomenon is marked by the recruitment of victims through social media, fake job advertisements, and messaging apps, who are then coerced into committing online fraud under threats, violence, and technological control. The main issue of this research is how Indonesian positive law responds to online scam-based human trafficking practices and to what extent law enforcement can protect victims who experience digital exploitation. This study aims to analyze the adequacy of the national legal framework, the dynamics of crime modus operandi, and the obstacles in cross-border handling. The research method uses a qualitative approach with a socio-legal research type through literature review of regulations, news, and academic research. The research findings show that the online scam practices carried out by the victims fulfill the elements of human trafficking according to Law No. 21/2007 through the concept of forced criminality. However, law enforcement faces challenges such as cross-border jurisdiction, digital evidence, and miscategorization of victims as perpetrators. This study emphasizes the need to strengthen technology-based regulations, improve international cooperation, and establish comprehensive protection mechanisms for the identity and recovery of victims.

Abstract

The widespread circulation of illegal cigarettes in Indonesia causes significant economic, legal, and social losses, highlighting a persistent gap between strict excise regulations and weak field enforcement. This study aims to analyze the legal framework governing tobacco excise and examine the key factors that undermine law enforcement against illegal cigarettes. Using a normative legal method, the research analyzes secondary data from legal documents and the literature. The findings reveal that the regulation-enforcement gap is driven by limited supervisory capacity, the complexity of illegal distribution networks, persistently high market demand fueled by price disparities, poor interagency coordination, and inconsistent enforcement of sanctions. Consequently, the study concludes that strengthening law enforcement capacity, enhancing coordination among Customs, police, and local governments, using information technology for surveillance, and increasing public participation are essential strategies. The research recommends that future policies adopt a multidisciplinary approach that integrates legal, economic, and social dimensions and that further empirical studies be conducted to measure enforcement effectiveness more comprehensively, thereby ensuring more sustainable excise law enforcement in Indonesia. Peredaran rokok ilegal di Indonesia menimbulkan kerugian ekonomi, hukum, dan sosial yang signifikan, sekaligus menunjukkan kesenjangan persisten antara regulasi cukai yang ketat dan lemahnya penegakan hukum di lapangan. Penelitian ini bertujuan menganalisis kerangka hukum cukai tembakau dan mengkaji faktor utama penyebab ketidakefektifan penegakan hukum terhadap rokok ilegal. Dengan metode hukum normatif melalui pendekatan perundang-undangan dan konseptual, penelitian ini menganalisis data sekunder dari dokumen hukum dan studi pustaka. Temuan menunjukkan bahwa kesenjangan regulasi dan penegakan hukum disebabkan oleh kapasitas pengawasan yang terbatas, kompleksitas jaringan distribusi ilegal, tingginya permintaan pasar akibat perbedaan harga, koordinasi antarlembaga yang lemah, serta penerapan sanksi yang tidak konsisten. Penelitian ini menyimpulkan bahwa penguatan kapasitas aparat penegak hukum, peningkatan koordinasi antara Bea Cukai, kepolisian, dan pemerintah daerah, pemanfaatan teknologi informasi untuk pengawasan, serta peningkatan partisipasi publik merupakan strategi esensial. Rekomendasi penelitian adalah bahwa kebijakan masa depan harus mengadopsi pendekatan multidisiplin yang mengintegrasikan aspek hukum, ekonomi, dan sosial, serta perlunya studi empiris lebih lanjut untuk mengukur efektivitas penegakan hukum secara komprehensif demi terwujudnya penegakan hukum cukai yang berkelanjutan di Indonesia.
