Abstract

Asset forfeiture is a solution to the problem asset forfeiture when a person cannot be criminally prosecuted on the grounds of death or cannot follow the criminal prosecution process as referred to in Article 77 and Article 83 of the Criminal Code of Indonesia. NCB Asset Forfeiture wants the seizure of assets resulting from corruption crimes without having to wait for a criminal verdict and is an alternative if a corruptor can’t criminally prosecuted. The regulation of asset seizure resulting from corruption by mechanism without criminalization in Indonesian law is stipulated in Article 32, Article 33, Article 34, and Article 38C of the Law of the Republic of Indonesia Number 20 of 2001 concerning Amendments to Law No. 31 of 1999 concerning the Eradication of Corruption Crimes while the arrangement of asset forfeiture resulting from corruption crimes by mechanism without criminalization to UNCAC is stipulated in Article 54 chapter (1) letter c UNCAC. The application of NCB Asset Forfeiture in Indonesia in addition to being implemented based on the Law on the Eradication of Corruption Crimes, the State Attorney must be able to prove there has been a real loss of state finances, financial losses of the country due to corruption crimes and there are guarantees from corruptors to facilitate the application of asset seizures resulting from corruption without criminalization. Keywords: Asset Forfeiture, Proceeds of Corruption, Without Criminalization, United Nations Convention Against Corruption.

Abstract

Background: Pengabdian kepada Masyarakat (PkM) ini dilaksanakan di desa Tanjung Rejo, Kecamatan Percut Sei Tuan Kabupaten Deli Serdang Provinsi Sumatera Utara. Tujuan pengabdian ini adalah untuk meningkatkan pengetahuan dan keterampilan manajemen para pelaku usaha mikro kecil (UMK) supaya mereka lebih mampu beradaptasi dengan perkembangan bisnis. Berdasarkan studi pendahuluan, tim pengabdi mengidentifikasi bahwa para pelaku UMK di desa Tanjung Rejo banyak yang memulai usaha tapi dengan kemampuan manajemen yang kurang baik, sehingga para pelaku UMK perlu meningkatkan pengetahuan dan keterampilan manajemen. Metode: Pengabdian ini terdiri dari sosialisasi/penyuluhan, tutorial dan diskusi (FGD). Materi yang disampaikan meliputi konsep dasar Manajemen dan urgensinya dalam pengelolaan bisnis. Hasil: Dampak langsung yang diperoleh mitra dari pelaksanaan PkM ini adalah meningkatnya pengetahuan dan keterampilan mitra dalam bidang Manajemen Produksi, Manajemen Keuangan dan Manajemen Pemasaran serta manajemen Sumber Daya Manusia. Kesimpulan: Hasil PkM ini juga diharapkan dapat memotivasi para pelaku usaha untuk mempelajari dan mengimplementasikan materi pengabdian yang disampaikan supaya usaha yang digeluti dapat berkembang dan meningkatkan pertumbuhan ekonomi di desa Tanjung Rejo.

Abstract

The transfer of inherited assets is only for people who have rights and obligations over the assets. It will be different when a couple or family is destined not to be able to have children and they adopt a child, then the transfer of inheritance can be done by means of a gift or mandatory will. Gifts can be in any form, one of which is donating land to an adopted child. The aim of this research is to determine the legal aspects of the transfer of land ownership rights due to a grant in Gampong Sagoe, Glumpang Baro District. This research is a type of empirical juridical research, namely field research by collecting data through secondary data by studying related books, journals and scientific works and for primary data by interviewing respondents and informants. The results of this research show that the legal aspect of the transfer of land ownership rights due to a grant in Gampong Sagoe, Glumpang Baro District is by checking the authenticity of the land certificate by PPAT. The PPAT in charge is obliged to request important documents that must be provided by the grantor and potential grantee, such as data relating to the land and personal identity of each party. Once the required documents are complete, the Notary/PPAT can execute the land grant contract, and the parties agree on the agreement and the PPAT signs the grant deed and the grant deed that has been issued by the PPAT must be registered at the Land Office. Advice, it is hoped that the public will understand and study more deeply about religious knowledge and the rules regarding grants in the Compilation of Islamic Law, so that undesirable things do not happen to givers and recipients of grants.

Abstract

This study aims to analyze the legal regulation of criminal offenses against religion and belief under Indonesia’s 2023 Penal Code (KUHP) and to assess the effectiveness of the corrective justice approach in preventing legal misuse. The old Article 156a of the previous KUHP was often criticized for its vague interpretation and misuse against religious minority groups. The 2023 Penal Code introduces significant reforms, including more detailed provisions under Chapter VII and alternative sanctions such as community service. Using a normative legal method with statutory, conceptual, and case study approaches, the research finds that the 2023 Penal Code provides a more systematic and proportional framework for religion-related offenses. Furthermore, the adoption of corrective justice enables more restorative outcomes through mediation, restitution, and the avoidance of excessive criminalization. However, several challenges remain in its implementation, including overlaps with Law No. 1/PNPS/1965, limited understanding among law enforcement of corrective justice, and the absence of clear technical guidelines. The study concludes that the 2023 Penal Code marks a progressive step toward a more humane and modern criminal justice system. Its success, however, depends on a paradigm shift among law enforcement officials and regulatory harmonization. Future research should adopt an empirical approach to evaluate the practical application of corrective justice in religious diversity contexts.

Abstract

The Society 5.0 era requires human resource development that goes beyond technical competence to include strong moral integrity and sustainability principles. Local wisdom, such as the Poda na Lima philosophy from the Sipirok community, offers potential as a foundation for holistic HR development. This study examines the relevance of Poda na Lima’s philosophy to HR development among Sipirok migrants living in Medan City. Using a descriptive qualitative approach, the study involved 12 informants from various professional backgrounds selected through purposive and snowball sampling techniques. Data collection was carried out through in-depth interviews, participatory observation, and documentation, and then analyzed using the Miles, Huberman, and Saldana data analysis model with support from the source, method, and theoretical triangulation. Results show that the five principles of Poda na Lima—Paias Rohamu (Cleansing the Soul), Paias Pamatangmu (Cleansing the Body), Paias Parabitonmu (Cleansing Clothing), Paias Bagasmu (Cleansing the House), and Paias Pakaranganmu (Cleansing the Environment)—have strategic relevance to modern HR development concepts. This philosophy works as an operational framework for building professional competence, character, and performance, while offering solutions to globalization challenges. This research confirms that Poda na Lima can be positioned as an Indigenous Management Framework that provides a competitive advantage by integrating noble local wisdom values with contemporary management principles
