Abstract

Interfaith marriage is an issue that has not been resolved to date. In current practice in Indonesian society, interfaith marriage processions are generally carried out by carrying out the marriage with a religious procession each of which is followed by the prospective husband and wife or in the sense that there are two religious processes being carried out or only carrying out one religious procession or what generally happens is not carrying out religious processions at all so that it does not comply with Article 2 paragraph (1) of the Marriage Law regarding valid marriages. The legal research method used in this research is normative juridical research which is research carried out or aimed only at written regulations with the nature of descriptive analysis research which is a method that functions to describe or provide an overview of the object being studied. The data source used is secondary data with quantitative data analysis. The results of this research are the Hierarchy of Legislation in Indonesia. If it is related to the Civil Admin Law Article 35 with SEMA Number 2 of 2023, the legal force of SEMA has a lower hierarchy than the law. Therefore, it can be concluded that the provisions contained in the Administer Law cannot be changed by SEMA Number 2 of 2023. However, this SEMA still influences the direction for judges not to grant requests for inter-religious marriages.

Abstract

In the current era of globalization, technological advancements are rapidly progressing, especially in the field of information technology, giving rise to the phenomenon of "creators." Creators are individuals or groups who produce creative content, such as videos, photos, or other digital forms, accessible via the internet. This profession demands protection for the Intellectual Property Rights (IPR) generated by creators. This protection is crucial because content uploaded without permission can economically and morally harm the creators. Unauthorized re-uploading creates serious problems for creators, damaging their image and credibility. It also leads to economic losses as creators lose potential income from affiliate links. Copyright, as regulated by Law Number 28 of 2014, provides legal protection for creators, covering both moral and economic rights over their works. This study aims to analyze the impact on the image and economic rights of creators, the factors hindering law enforcement, and the legal efforts made to address copyright violations. The research uses a normative juridical approach with secondary data analysis from written and electronic sources. The results of this study indicate that the government has implemented various measures to protect the copyright of content creators from violations, especially by unauthorized reuploaders. These measures include supervising the content upload process, ensuring content quality meets standards, and monitoring content usage to prevent misuse. The government has also developed secure information systems, monitored user activities, and enforced legal sanctions against copyright violators. The government is expected to strengthen regulations and IPR protection and enhance monitoring of unauthorized content re-uploading.

Abstract

The government, especially the Minister of Agriculture, through the Regulation of the Minister of Agriculture No. 19 of 2023 concerning amendments to the Regulation of the Minister of Agriculture No. 3 of 2022 concerning Human Resource Development, Research and Development, Rejuvenation, and Facilities and Infrastructure for Oil Palm Plantations to ensure the development of sustainable oil palm plantations, has made regulations regarding the development of human resources, research and development, rejuvenation, and facilities and infrastructure for oil palm plantations funded by funds collected from oil palm plantations. The research uses a normative juridical approach with secondary data analysis from written and electronic sources. The results of this study The government must further socialize the regulations on fulfilling the completeness of documents related to the mechanism for rejuvenating oil palm for farmers whose situations and conditions experience difficulties in fulfilling the requirements for rejuvenating oil palm with government assistance. If the completeness of the applicant's documents cannot be fulfilled by the applicant, the applicant will be given an opportunity by the head of the district/city service as stated in Article 25 paragraph (1) letter (b) of the Regulation of the Minister of Agriculture Number 19 of 2023. The solution provided by the government in this case the Ministry of Agriculture for applicants in completing and verifying the validity of the applicant's documents has been stated in Article 17 paragraphs (3) to (5) of the Regulation of the Minister of Agriculture No. 19 of 2023 by providing time for applicants to complete the problem of ownership documents as one of the main requirements for submitting the application for rejuvenation of oil palm.

Abstract

Tujuan penelitian ini adalah untuk mengkaji tentang peranan investasi asing dalam percepatan pertumbuhan ekonomi di Indonesia. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan sifat penelitian deskriptif, teknik pengumpulan data menggunakan data primer, sekunder dan tersier. Analisis data menggunakan analisis kualitatif. Peranan Investasi asing memberikan kontribusi yang nyata bagi perekonomian, perkembangan teknologi, perbaikan infarstruktur serta menciptakan lapangan pekerjaan dan menghasilkan penerimaan Negara. Kendala yang muncul yakni regulasi berbelit, akuisisi lahan yang sulit, infrastruktur publik yang belum merata, pajak dan insentif nonfiskal lain tidak mendukung investasi dan tenaga kerja terampil yang belum memadai. Upaya menarik investasi asing dalam mempercepat pertumbuhan ekonomi nasional diantaranya Inftrastruktur, tenaga kerja terampil, kemudahan perizinan, insentif dari pemerintah, jaminan hukum dan kesejahteraan masyarakat.

Abstract

One of the problems with using digital wallets is that data breaches and account breaches often occur which results in the loss of balances of digital wallet users. The Personal Data Protection Law itself was formed in order to protect people who use digital platforms, in this case digital wallets, from acts of breaching personal data and hacking accounts. The legal research method used in this research is normative juridical research which is research carried out or aimed only at written regulations with the nature of descriptive analysis research which is a method that functions to describe or provide an overview of the object being researched through data or samples and make conclusions that apply to the general public. The data sources used in this research are primary and secondary data and qualitative data analysis which is observations of phenomena obtained from data obtained in the form of written or oral descriptions. The results of this research are that the regulations for the use of electronic wallets that convert the use of cash into electronic money are Bank Indonesia Regulation Number 20/6/PBI/2018 concerning Electronic Money, Protection of personal data in the Personal Data Protection Law includes specific personal data protection. and is general in relation to the use of electronic wallets, so specific data such as financial data is data that is vulnerable to misuse and must be protected when using electronic wallets.

Abstract

Competition law is a combination of two opposing ideologies: ethatism, which promotes state ownership and control over private enterprise, and Free Fight liberalism, which supports unrestricted free competition. As a highly dynamic period develops, laws must be able to address these issues, particularly the conditions of the Indonesian state, by implementing economic theories that serve as the foundation for social life-sustaining politics and laws. For the purpose to stop the cartel phenomena, we utilize applicable rules known as Undang-undang No. 5 Tahun 1999 tentang Larangan Praktek Kartel monopoli dan persaingan usaha tidak sehat (Regulation No. 5/1999 on Prohibition of Cartel Monopolistic Practices and Unfair Business Competition) and normative juridical on the creation of competition legislation in this research. We next examine the prospects and difficulties associated with the cartel phenomena in Indonesia using a new paradigm. As a result, our goal is to adding articles to the competition law regulations on the cartel issue.

Abstract

This research is motivated by the use of notarial deeds in banking practice because notarial deeds have the position of authentic deeds. One form of using a notarial deed in banking practice is the use of a notarial deed in the form of a debt acknowledgment deed. The legal research method used in this research is normative juridical research which is research carried out or aimed only at written regulations with the nature of descriptive analysis research which is a method that functions to describe or provide an overview of the object being studied. The data source used is secondary data with quantitative data analysis. The results of this research are that the legal strength of the executorial title in the debt acknowledgment deed aligns the debt acknowledgment deed with the court decision. The executorial title or irah-irah gives the authority to carry out executions without having to go through a court decision, but the execution is carried out by asking for court assistance or what is called fiat execution. With the existence of an executorial title which aligns the debt acknowledgment deed with a court decision that has legal force permanent (inkarcht van gewidje), the authority of the notary in including the executive title in the debt acknowledgment deed is regulated in Article 57 UUJN, the person with the authority to issue the grosse deed is the notary. The implementation of Executorial Title in Banking Practice is carried out on Debtors who are in default and cannot fulfill their obligations to pay debts according to the time period agreed in the credit agreement and become bad debts, then the bank as creditor has the right to recover its receivables by carrying out fiat execution on collateral objects that have been encumbered with mortgage rights.

Abstract

Titel eksekutorial atau irah-irah memberikan kewenangan untuk melakukan eksekusi tanpa harus melalui putusan pengadilan, akan tetapi eksekusinya dilakukan dengan meminta bantuan pengadilan atau yang disebut dengan fiat execution. Dengan adanya titel eksekutorial yang menyelaraskan akta pengakuan utang dengan putusan pengadilan yang telah mempunyai kekuatan hukum tetap (inkarcht van gewidje), maka kewenangan notaris dalam mencantumkan titel eksekutorial dalam akta pengakuan utang diatur dalam Pasal 57 UUJN, yang berwenang menerbitkan grosse akta tersebut adalah notaris. Pelaksanaan Titel Eksekutorial dalam Praktik Perbankan dilakukan terhadap Debitur yang wanprestasi dan tidak dapat memenuhi kewajibannya untuk membayar utang sesuai jangka waktu yang disepakati dalam perjanjian kredit dan menjadi piutang macet, maka bank sebagai kreditur berhak untuk menagih piutangnya dengan melakukan fiat execution atas objek agunan yang telah dibebani hak tanggungan.
