Abstract

Indonesia is one of the most significant palm oil contributors in the world. Palm oil is one of the leading commodities supporting the running of Indonesia's national economy. The high influence of the economic growth of oil palm in Indonesia has caused a shift in the cultivation of rubber and other conventional cash crops at the community level, changing to oil palm regardless of the role of oil palm in the nation's economy. The oil palm plantation industry is not welcomed by some Indonesian people affected by oil palm plantations. This is because the practice of oil palm plantations in Indonesia is suspected as one of the triggers for various environmental and social problems, such as deforestation, clearing of peatlands, forest fires, loss of biodiversity, and tenure conflicts. The issues to be discussed are, first, how the permits are granted to the palm oil industry in forest areas by the government; second, what control strategy must be carried out against the palm oil industry in Indonesian forest areas. This research was conducted using the socio-legal research method. Without an accountable and strict control system in the licensing process, it will impact the large number of oil palm plantation permits issued that tend to violate spatial regulations. Apart from that, further regulation of policies regarding palm oil in the work copyright law will increase the length of conflicts that occur and complicate reforming palm oil governance. Applying the "whitewash smell" model as a settlement effort will only reduce the chances of settlement, ignore permits, not be transparent, and ultimately harm the community.

Abstract

Undang-Undang Nomor 6 Tahun 2023 disahkan untuk menetapkan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja, tentunya didasari atas Putusan MK No 91/PUU-XIII/2020 yang menyatakan “cacat secara formil” dan “inkonstitusional bersyarat” terhadap UU Cipta Kerja lama. Pengesahan tersebut sekaligus menambahkan ketentuan baru terkait penetapan upah minimum bagi para pekerja, seperti penegasan syarat penetapan upah minimum kabupaten/ kota, formula penghitungan upah minimum yang berubah menjadi tiga variabel, yaitu pertumbuhan ekonomi, inflasi, dan indeks tertentu, dan penambahan kewenangan pemerintah dalam kondisi tertentu untuk bisa menetapkan formula perhitungan upah minimum yang berbeda dari formula perhitungan upah minimum. Eksistensi perubahan haruslah dimaknai sebagai wujud perlindungan yang adaptif untuk menghindari terlalu rendahnya upah yang diterima para pekerja. Upah minimum yaitu upah terendah yang meliputi gaji pokok dan tunjangan tetap dengan tujuan memberikan jaringan pengaman di sektor tenaga kerja serta menjaga pekerja agar memperoleh upah yang layak. Penetapan upah minimum juga guna menghindari para buruh/pekerja dari kesewenang-wenangan pengusaha dalam memberikan upah. Perubahan kebijakan upah minimum yang semula termuat dalam UU No. 13 Tahun 2003 tentang Ketenagakerjaan, UU No. 11 Tahun 2020 tentang Cipta Kerja, dan terakhir dalam UU No. 6 Tahun 2023 perlu diidentifikasi sejauh pembaharuan hukum dapat berperan sebagai jaring pengaman sosial bagi pekerja, atau justru sebaliknya menciderai hak-hak pekerja demi kepentingan pelaku usaha dan pemerintah. Penelitian ini akan dilakukan secara normatif dengan mengkaji peraturan perundang-undangan yang berkaitan dengan kebijakan upah minimum bagi para pekerja, disertai dengan analisis komparatif dengan membandingkan aturan lama dengan yang baru untuk dapat lebih menjamin kesejahteraan para pekerja.

Abstract

The policy for completing honorary workers in government agencies is carried out based on PP Number 49 of 2018 concerning PPPK Management, where Government Agencies are given 5 years until 2023 to complete them. Based on the data collection process, the data for non-ASN personnel came from 66 central agencies and 522 regional agencies where honorary employees reached 2,113,158 as of September 30, 2022 AND there were 152,803 non-ASN data who did not meet the non-ASN data collection requirements. Therefore, non-ASN personnel who have been recorded or who do not meet the data collection requirements are the responsibility of the government and local governments to find a solution that satisfies a sense of justice. This article uses a normative approach and a comparative-descriptive analysis.The conclusions in this article include that the settlement of honorary workers in Indonesia can be pursued through three strategies, including: First, appeals and directions for non ASN workers to take part in CPNS and PPPK recruitment; Second, the obligation not to re-recruit non-ASN workers as well as imposing strict sanctions on the heads of central and regional agencies if they are indicated to be recruiting; Third, The need for synergistic cooperation between the Government, Regional Government, BUMN/BUMD, and the private sector, among others, through revising the provisions regarding the deadline for eliminating honorary workers and providing additional skills through Job Training Centers which then Non ASN workers can be allocated as BUMN/BUMD Employees as well as private employees with an outsourcing mechanism.

Abstract

Reforma agraria merupakan kebijakan strategis yang ditujukan untuk memperbaiki struktur penguasaan tanah dan mendorong keadilan sosial di sektor agraria. Di Indonesia, ketimpangan distribusi lahan yang tinggi telah menjadi salah satu faktor penghambat pengembangan sektor pertanian yang inklusif dan produktif. Artikel ini bertujuan untuk menganalisis hubungan antara kebijakan reforma agraria dengan potensi peningkatan keterserapan angkatan kerja di sektor pertanian. Penelitian ini menggunakan pendekatan yuridis normatif-empiris dan didukung oleh data sekunder dari sumber resmi seperti Badan Pusat Statistik dan kementerian terkait. Temuan menunjukkan bahwa pelaksanaan reforma agraria yang efektif, terutama dalam aspek redistribusi tanah dan legalisasi aset, dapat menciptakan peluang kerja baru di pedesaan, meningkatkan pendapatan petani kecil, serta memperkuat ketahanan pangan nasional. Namun, tantangan implementatif seperti tumpang tindih kebijakan, konflik agraria, dan lemahnya kelembagaan masih menjadi hambatan utama. Oleh karena itu, keberhasilan reforma agraria tidak hanya bergantung pada aspek hukum formal, tetapi juga pada integrasi kebijakan sektoral dan keberpihakan politik terhadap petani kecil. Artikel ini merekomendasikan perlunya reformulasi kebijakan yang holistik dan penguatan tata kelola agraria agar reforma agraria benar-benar menjadi instrumen pembangunan yang berkeadilan dan mampu menyerap tenaga kerja secara optimal di sektor pertanian.
