Abstract

The integration of blockchain technology in stamp duty administration requires a clear legal framework to ensure effective implementation. This study evaluates the benefits and challenges of using blockchain in stamp duty imposition and provides regulatory framework recommendations. Using a normative legal approach and analysis of relevant legislation, the research shows that blockchain can significantly enhance efficiency, transparency, and security in the stamp duty process. The immutable nature of blockchain records ensures data integrity and reduces the risk of fraud. Moreover, smart contracts can automate and streamline the transaction process, minimizing human error. However, the adoption of blockchain faces challenges such as high initial costs and the need for regulatory adjustments. In conclusion, the adoption of blockchain in stamp duty administration necessitates comprehensive regulations to ensure the legality and validity of recorded transactions, providing a robust and reliable tax system for the digital age.

Abstract

Ministerial Regulation PPPA No. 6 of 2023 concerning Gender Equality Parameters in Legislation and other Legal Instruments, which is normatively expected to eliminate existing gender inequality in the state, is not necessarily effective when implemented at the local agrarian community level. The inherent masculinity of patriarchal culture in coffee plantations still makes women coffee farmers have unequal access and control with male coffee farmers. This research examines the effectiveness of Permen PPPA No. 6 of 2023 in the context of local agrarian communities, namely, women coffee farmers in Tirtoyudo Village, Malang Regency. This research uses a juridical-sociological approach with Lawrence Friedman's theory of legal effectiveness. The results of this study show that the implementation of Permen PPPA No. 6 of 2023 is not maximally effective due to the patriarchal culture that is strongly embedded in the community. The lack of gender awareness in the coffee farming community is a major obstacle in the realization of gender equality as regulated in Permen PPPA No. 6 of 2023. Formal recognition alone does not automatically result in equality to the substantive level. So from this research, there is still a gap between legal norms and social reality.

Abstract

The film is part of the intellectual property rights attached to the creator. Nowadays, it is commonly agreed that violation of intellectual property rights portrays in film piracy for personal gain is inevitable, with illegal streaming services. This study aimed to examine film protection, conduct a study of film institutions, and find concepts to protect films in Indonesia. The study used a juridical method with the statute and conceptual approaches. In so doing, it used secondary data processed using library research techniques. The study showed that illegal movie streaming rampant in Indonesia practiced illegal streaming movies. It violated the intellectual property rights inherent in the creator, resulting in enormous losses for the creators. There are further problems in the laws and regulations, and the government must accommodate preventive actions. This study suggested three components: correctional, supervision, and copyright protection against illegal movie streaming in Indonesia; and these components were to maximize the role of stakeholders. Abstract

Pancasila, as the foundation of the Indonesian state, upholds social justice for the people with the aim of equality in all areas, especially public income. However, recent research has found that the income gap between the Indonesian Legislative Institution and the Indonesian public is significantly different from that in Malaysia. This can certainly affect the welfare of the people of those countries. Therefore, the author analyzes and examines in more depth the income gap between the Legislative Institution and the public in Indonesia and Malaysia related to public welfare. This study uses a normative legal research type with a statutory and comparative approach, data sources are primary legal materials and secondary legal materials from books, journals, and legal dictionaries. The income gap between the legislative institution and the public in Indonesia reaches 10x-14x, while in Malaysia it is 4x-5x. This gap creates social injustice and hinders public welfare. Therefore, the values ​​of social justice in Pancasila do not function well in practice. It is necessary to strengthen Pancasila from an early age in shaping the character of the Indonesian people.Civic Awareness and Social Justice.

Abstract

Not only limited to individual decisions, it turns out that there are several things that can make female victims of domestic violence reluctant to report the violence they experienced. This study aims to analyze the causes why women victims of domestic violence are reluctant to report their cases. This literature study research found that cultural, gender, and social structure factors are one of the causes of women victims of domestic violence who are reluctant to report gender-based violence problems in the domestic sphere. In addition,  problems of legal culture and institutional capacity that are not yet gender-sensitive, such as limited training of apparatus, lack of integrated assistance services, and the risk of secondary victimization during the legal process strengthen the vulnerable position of victims of domestic violence, making women victims of domestic violence make the decision not to report the domestic violence they experience.
