Abstract

Wasiat wajibah merupakan salah satu produk ijtihad di bidang fikih Islam kontemporer. Perkara wasiat wajibah juga masuk ke dalam sub pembahasan Kewarisan dalam hukum keluarga atau perdata di beberapa negara dengan mayoritas masyarakat muslim. Ketentuan wasiat wajibah muncul sebagai alternatif atas beberapa problematika kewarisan, seperti hak atas harta warisan bagi kepada ahli waris beda agama, anak dan orang tua angkat. Kondisi ini dihadapkan pada realitas hukum kewaarisan suatu masyarakat yang tidak dapat lepas dari struktur, norma, dan tradisi, masyarakat yang sudah hidup (living law) selama bertahun-tahun. Salah satu praktek wasiat wajibah yang menjadi sorotan di Indonesia adalah kasus wasiat wajibah di dalam Putusan MA Nomor 331 K/Ag/2018. Putusan ini merupakan putusan terpilih Mahkamah Agung (landmark decision) yang mengubah putusan pengadilan Tinggi Agama Banten No. 78 Pdt.G/2017 PTA Btn terkait pembagian warisan bagi suami pewaris yang telah murtad. Melalui putusan ini, Majelis Kasasi menganggap sepantasnya pemohon kasasi yang beragama non muslim (murtad) diberi bagian harta warisan dalam bentuk wasiat wajibah sebesar ¼ dari harta warisan. Putusan MA Nomor 331 K/Ag/2018 merupakan putusan yang dikonstruksi  oleh pertimbangan berbasis perlindungan dan kesetaraan hak, keadilan dan kemanusiaan bagi suami murtad dalam kapasitasnya sebagai subjek yang berhak untuk harta peninggalan pewaris di depan hukum. Putusan ini memberikan gambaran bahwa Indonesia sebagai negara hukum tidak mengabaikan kenyataan bahwasanya terdapat perbedaan agama dalam suatu keluarga atau dalam kehidupan bermasyarakat. Kenyataan tersebut tidak menjadi hambatan bagi keluarga inti yang berbeda agama bahkan murtad untuk bisa saling berwasiat.

Abstract

Human Rights (HAM) are basic rights inherent in every individual since birth as part of human nature. Human rights are universal, cannot be taken away or violated by anyone, and do not depend on recognition from the state, law, or other individuals. The existence of human rights is very important to protect human dignity and serves as a moral foundation in relations between individuals. In its application, every individual is obliged to respect the human rights of others and understand that every right is accompanied by obligations. Law, which is dynamic, plays an important role in regulating and protecting human rights, although there are challenges in its implementation and fulfillment, such as discrimination, persecution, and arbitrary detention. Other global challenges include armed conflict, humanitarian crises, and information technology and climate change. International Criminal Law and Humanitarian Law have been developed to protect humanity from serious crimes such as genocide, which is recognized as a serious violation of international law. Genocide, defined in the Rome Statute and the Genocide Convention, includes acts intended to destroy a particular group. The International Court of Justice recognizes the prohibition of genocide as a norm of international law that must be complied with. The International Criminal Court (ICC), established by the Rome Statute of 1998, is tasked with trying the crimes of genocide, crimes against humanity, war crimes, and the crime of aggression. The ICC aims to eliminate impunity and achieve global justice, operating when national justice systems are unable to prosecute such crimes. Human rights analysis and theories of state responsibility underscore the importance of international legal protection against the crime of genocide, asserting that states have an obligation to protect the fundamental values of the international community

Abstract

This article aims to understand the concept of e-commerce and find a balance point in the constitutional economic framework regarding the prohibition on social media, TikTok shops merging into e-commerce. This research uses a juridical-nornative approach and is designed to be descriptive. The research results show: The concept of e-commerce is basically a "container" for business people who sell and makes it easier for them to connect with consumers online and carry out their activities practically and efficiently. Transactional procession activities through the world of e-commerce involve two parties, namely business actors and consumers. Tiktok shop since this writing has not met the criteria for e-commerce as mandated by PP Number 80 of 2019. On this side, constitutional economic balance is needed to bridge interaction and connectivity between society, the state and the market. This means that the government must ensure healthy business competition and protection for society as a whole for the products offered specifically in e-commerce activities. considering that production from upstream to downstream is a long economic process. This is in line with the will of the Indonesian state as stated in the economic conception of the constitution in Article 33 of the 1945 Constitution of the Republic of Indonesia which is based on the principles of balance, justice and sustainability.

Abstract

The practice of money politics by some parties has been considered normal in elections in Indonesia. The discussion of money politics has been widely discussed in the literature on voter behavior in Indonesia, both from a political, sociological, psychological, and rationale choice (political economy) perspective. There are also studies that pay attention to the influence of money politics in elections. Academic explanations of the electoral impact of money politics are also discussed in several international studies. The problem is how the solution in preventing the occurrence of money politics transactions in the election, the alternative analysis process is to use normative juridical methods with historical empirical data, through socialization, and face-to-face, participant observation and the amount of participation from the context of money politics, the role of institutions in the process of educating mass awareness through party doors and community leaders is an alternative solution to close the path of violation of election law, on the other hand public awareness and political parties and candidates are the ones who really play a role in breaking the chain of the spread of money politics transactions.

Abstract

Abstract: This research aims to provide an explanation of the conception of the Judicial Commission Regulation; whether it falls into the category of legislation or not. Linearly, as a logical consequence of the hierarchical nature of the legislative system, where is the location/position of the Judicial Commission Regulation when analysing its content. This issue arises because the Judicial Commission Regulation does not explicitly appear in the hierarchy of laws and regulations. Therefore, it has implications for what judicial institution has the authority to test the material validity of the Judicial Commission Regulation if it conflicts with the laws and regulations above it. To unravel these legal issues, normative research is used through conceptual approaches and legislation. The data used is secondary data which includes primary, secondary, and tertiary legal materials. Analysis of the data will be presented descriptively qualitatively through the content analysis method. The results of this research found that (1) theoretically, the Judicial Commission Regulation is not included in the category of laws and regulations but falls into the category of internal regulations, but because it is ordered to be formed by law, it is considered to be included in the category of laws and regulations (2) the Judicial Commission Regulation can be equated with the Presidential Regulation in terms of content, so it is equal to the Presidential Regulation in the hierarchical construction of laws and regulations, (3) the Supreme Court is the institution that has the authority to materially examine the Judicial Commission Regulation. This research recommends that improvements should be made by issuing Judicial Commission Regulations that are no longer considered laws and regulations, but rather internal regulations. Abstract

This service has an output to provide an understanding of the formation of nagari regulations. The object of this service is located in the Nagari Tungkar Government, Fifty Cities Regency, West Sumatra Province with the target focused on the Nagari Tungkar Government apparatus. From the initial exploration, it was found that the Nagari Tungkar apparatus still knew little about the formation of nagari regulations. In fact, the draft nagari regulation on the Nagari Tungkar Customary Density was made not in accordance with the principles and guidelines for the formation of laws and regulations. The method of implementing this service consists of 3 (three) stages, namely Phase I of seminars/socialization, Phase II review of draft state regulations, Phase III of discussion and evaluation. The results of the service found that there is not enough literacy to make nagari regulations This contribution of service is able to increase literacy as well as contribute to forming nagari regulations that obey the principles, types, and hierarchy of laws and regulations.

Abstract

Persyaratan khusus remisi narapidana korupsi telah 6 (enam kali) diuji materil ke Mahkamah Agung (MA) karena dinilai diskriminatif. Realitas putusan menunjukan terjadi disparitas tafsir terhadap konsep suatu perundang-undangan  dinyatakan sebagai pengaturan yang bersifat diskriminatif. Artikel ini bertujuan untuk mempurifikasi disparitas  konsep diskriminasi tersebut sesuai dengan kontekstualisasi dan paradigma Hak Asasi Manusia Indonesia. Dengan metode normatif melalui pendekatan filsafat, perundang-undangan, konseptual, perbandingan, dan kasus, penelitian ini menunjukan konsep diskriminasi dalam  pengaturan remisi untuk narapidana Korupsi dikonstruksikan secara berbeda dalam putusan MA. Tidak semua kategori perbedaan perlakuan yang dielaborasi melalui materi peraturan perundang-undangan korelatif dengan aspek diskriminatif. konsep diskriminasi yang direpresentasikan oleh putusan MA terbagi ke dalam  2 (dua) kategori yaitu  (1) diskriminasi evaluatif dan (2) diskriminasi etis. Disparitas konsep disriminasi dipurifiasi melalui 3 (tiga) kriteria yang sifatnya komulatif-simultan yaitu (1) perbedaan perlakuan belum tentu dikategorikan diskriminasi jika mempunyai justifikasi objektif untuk melakukannya, (2) perbedaan perlakuan saja bukanlah diskriminasi, melainkan harus memenuhi  limitasi preferensi tertentu (3) Seluruh unsur tersebut harus menimbulkan akibat terjadinya penyimpangan, pengurangan, dan menderogasi Hak Asasi Manusia (HAM) secara eksistensial.

Abstract

Correctional institutions are undergoing a transformative shift from punitive spaces to acknowledging the humanity of inmates. This study delves into Indonesian correctional facilities' religious-based coaching programs prioritizing inmate protection, reintegration, and dignity. Analyzing these through Islamic law and Maqasid al-sharahprinciples, it explores personality development models and identifies limitations in current approaches. While initial findings showcase positive outcomes—behavioural changes and reduced distress—the study highlights the predominance of lecture-based programs, signalling the need for more comprehensive Islamic law-based models. Different inmate categories, especially those in serious crimes, display varying spiritual indicator weights. Spiritual development correlates positively with behavioural adjustments. Overcapacity issues in certain facilities, like Salemba and Jakarta Women's Correctional Institutions, pose severe challenges—from limited resources to inadequate staff ratios and hindrances in providing proper medical and psychological support, notably impacting drug abuse victims. The study underscores the urgency of restorative justice in sentencing, emphasizing rehabilitation and societal reintegration.

Abstract

Abstract: This study aims to provide an explanation of the legal certainty of the position of the Judicial Commission regulations in the hierarchy of Indonesian legislation. To analyse this legal issue, normative research was used through a conceptual and legislative approach. The data used are secondary data, including primary, secondary, and tertiary legal materials. The analysis of the data will be presented descriptively and qualitatively through content analysis. The results of this research found that, from the perspective of legal certainty theory, the Judicial Commission Regulations do not fall under the category of legislation but rather under the category of internal regulations. The Judicial Commission Regulation, in terms of its substantive content, can be equated with a Presidential Regulation, thus being on par with a Presidential Regulation in the hierarchical structure of legal regulations. It is necessary to improve this by issuing a Judicial Commission Regulation that is no longer considered a legal regulation but rather an internal regulation.Keywords: Legal Certainty; Judicial Commission Regulations; Hierarchy of Legislation; Legislation; Judicial Commission
