Abstract

Kemunculan Covid-19 pada bulan Maret tahun 2020 di Indonesia membuat para inventor mengembangkan inovasi, salah satunya yaitu pembuatan vaksin Covid-19. Para inventor sudah selayaknya diberikan hak ekonomi atas pemanfaatan vaksinnya, terutama karena vaksin ini digunakan bagi kepentingan masyarakat luas. Mengacu pada dasar pemikiran tersebut, penelitian yang dilaksanakan oleh penulis bertujuan untuk menentukan status kepemilikan paten terhadap invensi vaksin Covid-19 dan mekanisme perlindungan hak ekonomi bagi pemegang paten atas vaksin Covid-19 agar tetap dapat terpenuhi berdasarkan Undang-Undang Nomor 13 Tahun 2016 tentang Paten. Penulis menggunakan metode deskrisptif-analitis dengan memakai pendekatan yuridis normatif serta menganalisis data dengan metode kualitatif. Pengumpulan data yang digunakan oleh penulis ialah mengumpulkan studi pustaka berupa data sekunder baik dari perundang-undangan, buku, maupun pustaka daring. Hasil penelitian menunjukkan bahwa berdasarkan Pasal 10 Undang-Undang Nomor 13 Tahun 2016 tentang Paten, invensi atas vaksin Covid-19 diberikan kepada inventor atau orang yang diberikan hak untuk mendapatkan paten tersebut dengan izin dari inventor. Pada hubungan pekerjaan, hak ekonomi akan diberikan kepada pihak yang memberikan pekerjaan sebagaimana tercantum dalam Pasal 12. Inventor dapat memperoleh imbalan yang wajar dengan ketentuan sebagaimana tercantum dalam Pasal 4 Peraturan Menteri Keuangan Republik Indonesia No.72/PMK.02/2015. Kata kunci: Covid-19, hak ekonomi, inventor, paten, vaksin Mechanism to Gain Economic Rights for Covid-19 Vaccine Patent Holders in Indonesia Abstract The emergence of Covid-19 on March 2020 in Indonesia made inventors develop several innovations, one of the inovation is Covid-19 vaccine. Inventors should be given economic righ over the use of vaccines, especially because these vaccines are used for the benefit of the public. Based on this background, this study aims to determine the status of patent ownership for the invention of Covid-19 vaccine and the mechanism for protecting patent holder’s economic right against the Covid-19 vaccine so that it can be fulfilled, based on Law Number 13 of 2016 concerning Patents. The author used descriptive-analytical method that use a normative juridical approach and analyzes data using qualitative methods. The accumulation of data used by the author is to collect literature studies in the form of secondary data from legislation, books, and online libraries. The results shows that based on Article 10 of Law Number 13 of 2016 concerning Patents, the invention of the Covid-19 Vaccine given to the inventor or to the person who is granted the right to obtain the patent with permission from the inventor. On the employment relation, economic right will be given to the party that giving the job as stated in Article 12. The inventor can get a reasonable reward with the provision as listed on Article 4 of Regulation of The Minister of Finance of The Republic of Indonesia No.72/PMK.02/2015. Abstract

Prinsip-prinsip hukum yang terkait dengan penggunaan nama orang terkenal sebagai nama domain (cybersquatting) perlu dilakukan sebagai acuan dasar penyusunan konsep perlindungan bagi orang terkenal tersebut dalam rezim hukum merek di Indonesia serta Undang-undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Nama orang terkenal dalam perkembangan Teknologi Informasi dan Komunikasi mengalami perubahanpendekatan dalam perlindungannya. Pada awalnya nama orang terkenal adalah hak pribadi telah menjelma menjadi hak kebendaan dalam praktik nama domain. Beberapa prinsip hukum merek juga dikaji relevansinya dengan praktik cybersquatting terhadap nama orang terkenal mengingat keduanya bersumber dari adanya reputasi yang harus dilindungi oleh hukum. Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif, dengan spesifikasi penelitian deskriptif analitis. Metode perbandingan hukum dan futuristik juga digunakan dalam penelitianini.Data dianalisis secara yuridis kualitatif guna memperoleh kesimpulan atas permasalahan yang dikaji. Hasil penelitian memperlihatkan bahwa, prinsip nemo plus, droit de suit, itikad baik, prinsip persamaan, dan prinsip penggunaan dalam kegiatan perdagangan atau bisnis dapat digunakan dalam melindungi orang terkenal dari penggunaan namanya sebagai nama domain.Konsep pengaturan merek yang lebih memadai dalam melindungi orang terkenal dari penggunaan namanya sebagai nama domain adalah konsep pengaturan yang mengandung hal-hal sebagai berikut, pertama, penetapkan ruang lingkup hak ekslusif merek adalah juga mencakup pendaftaran dan penggunaan nama orang terkenal sebagai namadomain di internet. Kedua, pelarangan penggunaan nama orang terkenal sebagai nama domain oleh pihak lain secara tanpa hak dan dengan itikad buruk. Ketiga, pemberian hak kepada orang terkenal untuk mengajukan gugatan ganti rugi perdata terhadap cybersquatter.Keempat, pemberian kewenangan kepada pengadilan niaga untuk memeriksa dan mengadili perkara cybersquattingterhadap orang terkenal

Abstract

Kemunculan teknologi Non-Fungible Token (NFT) dinilai dapat menjadi salah satu potensi untuk melindungi Karya Cipta di ranah digital. Fasilitas berupa kode token unik yang tercantum pada setiap aset digital NFT, membuatnya tidak dapat diduplikasi oleh pihak lain. Pada praktiknya ternyata penulis masih menemukan tindakan pembajakan NFT dengan objek potret yang merupakan para terpidana. NFT tersebut kemudian dikomersialisasikan oleh pihak ketiga ke dalam marketplace OpenSea. Penulis menggunakan metode penelitian Yuridis Normatif. Tujuan dan Hasil dari penulisan ini adalah untuk mengkaji bagaimana aspek hukum atas tindakan pelaku komersialisasi potret tanpa izin dan tindakan hukum apa yang dapat diambil oleh pihak yang dirugikan atas tindakannya. Dasar hukum yang digunakan untuk menganalisis permasalahan tersebut adalah Undang-undang Hak Cipta dan Undang-undang Informasi dan Transaksi Elektronik di Indonesia.

Abstract

The emergence of tax disputes as a consequence of differences in interests between tax authorities and taxpayers is a normal thing to happen. However, if an excessive number of tax disputes occur, this has the potential to create legal uncertainty, both for taxpayers and tax authorities. In theory and practice, a dispute resolution mechanism has developed as an implementation of law enforcement outside of court (non-litigation), namely a form of dispute resolution using the services of a neutral third party without going through a court process agreed upon by the parties. Indonesia already has provisions regarding dispute resolution outside of court, as stated in Law Number 30 of 1999, concerning Arbitration and Alternative Dispute Resolution, but this is only limited to civil and business cases or disputes. However, there is an opportunity to apply ADR in resolving public disputes, especially tax disputes, provided that ADR is limited to administrative efforts and does not conflict with legislation, as well as legal updates at the level of the Act regarding the implementation of ADR. The opportunity to apply ADR to tax (administrative) disputes can be carried out during the discussion of audit results by the Quality Assurance (QA) team when there is no common ground between the tax auditor and the Taxpayer. The QA team can act as an independent and impartial mediator whose decisions are binding. The decision of the QA team as a mediator is also a preventive effort to prevent tax disputes from arising.

Abstract

This study investigates the impact of service quality, product quality, and delivery punctuality on customer satisfaction in Lazada’s e-commerce platform. Using a quantitative approach with purposive sampling, data were collected from 333 Lazada users. Validity, reliability, and multiple linear regression analyses were applied. Results show that service quality and product quality significantly influence customer satisfaction (p = 0.001), while delivery punctuality does not (p = 0.778). Simultaneous testing indicates a significant combined effect of all variables (p = 0.000). The R² value of 0.139 suggests that 13.9% of satisfaction variance is explained by the studied variables. The study highlights the importance of service and product quality, and recommends further exploration of other influencing factors such as pricing and user experience.

Abstract

The development of information technology has influenced various sectors, including cinematography, which is protected by copyright law, especially in the context of broadcasting football matches. Despite copyright protection, many parties engage in unauthorized rebroadcasting, causing a breach of economic rights for the relevant rights holders. This research analyzes the legislative regulations protecting football broadcasting rights in Indonesia and the financial rights protection related to rebroadcasting. This research aims to understand the legal rules about football broadcasting rights and the safety of economic rights for broadcasting rights holders. A mixed legal study method combines normative and empirical legal research. The research results indicate that the Copyright Law provides adequate protection for the economic rights of football broadcasting rights holders. These exclusive rights are acquired by legal entities authorized to broadcast audiovisual works through radio media. Although criminal judgments cannot fully restore economic losses, mainly because they are penal, further steps are necessary to ensure compliance with these exclusive rights

Abstract

The commercialization of songs through music concerts organized by third parties is a form of commercial exploitation of works. However, this practice often harms creators because songs are used without the payment of royalties. The case of Agnez Mo against Ari Bias is a clear example of the neglect of copyright as the exclusive right of the creator, while singers only have a position through related rights. This study aims to analyze the legal status and relationship between creators and singers, including the responsibilities of singers in music concerts based on Law Number 28 of 2014 concerning Copyright. The methods used are normative and empirical legal methods, with data collection from primary, secondary, and tertiary legal materials, as well as interviews, which are then analyzed normatively and qualitatively. The results of the study show that the legal relationship between creators and singers is reciprocal, but creators have a higher position in accordance with the alter ego principle and personality theory. Singers, based on the principle of good faith, the theory of responsibility, and the principle of suum cuique tribuere, are obliged to respect the rights of creators.
