Abstract

The issuance of certificates of overlapping land rights gives rise to land disputes involving the Land Office as the authorized official and also the community who own the land rights. This research aims to examine and analyze dispute resolution over overlapping land title certificates issued based on PTSL using dispute resolution theory (Dean G. Pruitt and Jeffrey Z. Rubin). This research uses a type of normative juridical research with a statutory approach, conceptual approach and case approach. The technique for collecting legal materials is carried out by studying documentation of sources of legal materials regarding the implementation of Complete Systematic Land Registration. The analysis technique for legal materials is carried out using grammatical legal interpretation and analogous legal construction methods. The results of the research can be concluded that resolving disputes over overlapping land title certificates issued based on PTSL can generally be carried out through administrative procedures that refer to Article 66 in the ATR/BPN Ministerial Regulation Number 11 of 2016 concerning Settlement of Land Disputes and court decisions to provide legal certainty of ownership of disputed land rights.

Abstract

This study aims to analyze the legal consequences of electronic registration of mortgage rights to the legal certainty of mortgage deed made in the presence of the land deed officer (PPAT) whose registration passes the specified period. This study examines the impact of the use of electronic mortgage registration system on the validity, validity, and enforceability of deeds carried out under the supervision of PPAT, by raising the issue of how the legal consequences of the deed of Mortgage made before the land deed officer if the electronic mortgage registration past the term and how the legal certainty of the deed. The method used in this research is a normative juridical approach method, namely the fact and legislation approach. The specification of this research is descriptive analysis, namely by describing a condition or position of legal or nonlegal propositions. In this research, the author used primary data types through interviews and observations in the field supported by secondary data in the form of literature studies. Although there is a delay in the registration of the deed of granting mortgage rights (APHT) and the issuance of a Certificate of mortgage rights (HT), it does not cause the cancellation of APHT, as long as it meets the requirements as an authentic deed, because the HT registration process is considered an administrative activity. With the issuance of HT certificate by the Land Office, the creditor obtains legal certainty and preference rights to the HT object in accordance with the provisions of the law. The electronic signing of the HT certificate guarantees the issuance of the HT-EL certificate on the 7th day after receipt of the complete file and payment of non-tax state revenues, even if it falls on a Sunday or holiday. Although the delay in the registration of HT has no legal consequences, it should be noted that in the grace period before the issuance of the HT-EL certificate, the application for confiscation of collateral by the court can potentially harm the creditor because their preference rights may be lost.

Abstract

The notary profession provides legal certainty and maintains legal enforceability in civil law jurisdictions. In the agreement, legal conditions must be met, and the Notary has authority in the civil sphere. Abuse of circumstances can lead to the cancellation of the agreement, and the Precautionary Principle of Notaries prevents it with the practice of identity recognition, data verification, and fulfillment of technical conditions. Although the abuse of circumstances is not directly regulated, the notary must guarantee the correctness of the deed in accordance with the law. This study raises the issue of how the legal consequences of the authentic deed made before the notary in which one party abuses the circumstances and how the responsibility of the notary to the deed made where one party abuses the circumstances of the other party, using the theory of legal consequences and responsibility theory. The method used in this study is the normative juridical method, namely legal research conducted by researching library materials or secondary data only. The research approach used is the approach of legislation, case approach, analytical approach and conceptual approach. The technique of collecting legal materials is carried out by identifying and inventorying positive legal rules, researching library materials (books, scientific journals, research reports) and other sources of legal materials that are relevant to the legal issues under study. For technical analysis of legal material is done by systematic and grammatical interpretation. The result of this study is that the authentic deed made before a notary, if it is in accordance with the legislation, remains valid and binding on the parties. However, if there is an indication of abuse of circumstances by one of the parties, the court can cancel it, provided that it can be proven in a judicial process and the Notary has the responsibility to make the authentic deed honestly and with full precision, according to the legislation. If one of the parties misuses the circumstances and the court invalidates the deed, the notary can be held accountable or demand compensation, provided that it is proven that there was an unlawful act in the creation of the authentic deed.

Abstract

Tugas dan fungsi Notaris meliputi memberikan penyuluhan hukum kepada masyarakat dan melakukan tindakan hukum secara netral. Notaris memiliki kewenangan untuk mengawasi dan menjatuhkan sanksi terhadap pelanggaran yang dilakukan dalam jabatannya, yang diatur oleh Majelis Pengawas Notaris. Penelitian ini bertujuan untuk menganalisis penerapan sanksi oleh Majelis Pengawas terhadap pelanggaran Undang-Undang Jabatan Notaris serta kewenangan pengawasan yang dimiliki oleh majelis tersebut. Metodologi penelitian menggunakan pendekatan yuridis normatif dengan data sekunder dan tersier, serta teknik pengumpulan bahan hukum melalui identifikasi aturan dan literatur. Hasil analisis menunjukkan bahwa Majelis Pengawas Notaris terdiri dari unsur pemerintahan, akademisi, dan notaris itu sendiri, yang berwenang melakukan pemeriksaan dan menjatuhkan sanksi kepada notaris yang melanggar ketentuan. Sanksi yang dapat diterapkan termasuk teguran lisan, teguran tertulis, pemberhentian sementara, atau pemberhentian dengan hormat. Dengan demikian, kewenangan dan tanggung jawab Notaris sangat penting dalam menjaga keabsahan dokumen hukum. Sanksi yang dijatuhkan oleh Majelis Pengawas berfungsi sebagai langkah penegakan hukum untuk memastikan notaris menjalankan tugasnya sesuai dengan peraturan yang berlaku. Hal ini juga menciptakan perlindungan bagi masyarakat dari potensi penyalahgunaan jabatan oleh notaris.

Abstract

Penelitian ini mengkaji pertanggungjawaban hukum pengampu dalam hal pengampu menguasai harta milik terampu tanpa melibatkan pengampu pengawas. Penelitian ini menggunakan pendekatan yuridis normatif dengan analisis terhadap Kitab Undang-Undang Hukum Perdata (KUH Perdata) dan sejumlah kasus hukum terkait. Hasil penelitian menunjukkan bahwa pengampu yang mengabaikan kewajiban pengawasan berisiko melanggar ketentuan hukum dan menyebabkan kerugian materiil bagi terampu. Berdasarkan temuan ini, pengampu dapat dimintakan pertanggungjawaban hukum, baik berupa pengembalian aset, ganti rugi, maupun pertanggungjawaban atas kerugian yang timbul akibat penyalahgunaan wewenang. Perlindungan hukum bagi terampu diatur oleh KUH Perdata, yang memberikan hak bagi terampu untuk mengajukan gugatan meskipun berada di bawah pengampuan. Temuan lainnya menunjukkan bahwa sistem pengawasan terhadap pengampu oleh lembaga terkait, yaitu Balai Harta Peninggalan (BHP), masih lemah dan memerlukan penguatan. Penelitian ini menyarankan reformasi hukum untuk meningkatkan relevansi pengaturan pengampuan dengan kondisi hukum saat ini, termasuk penguatan pengawasan dan transparansi dalam pengelolaan harta terampu. Penelitian ini juga merekomendasikan harmonisasi prosedur pengampuan untuk mencegah penyalahgunaan wewenang. Penelitian selanjutnya disarankan untuk membandingkan sistem pengampuan di Indonesia dengan negara lain dan mengembangkan model pengawasan yang lebih efektif.
