Abstract

Hak Pengelolaan sebagai perwujudan hak menguasai negara atas tanah sebagaimana dimaksud dalam Pasal 33 ayat (3) Undang-Undang Dasar 1945 menempatkan posisi negara untuk mengatur, mengelola, memanfaatkan, kekayaan alam yang terkandung didalamnya, termasuk atas tanah berikut dengan peruntukan dan hubungan hukum sebagaimana dimaksud dalam Pasal 2 ayat (1), (2) dan (3) Undang-Undang Nomor 5 tahun 1960 Tentang Peraturan Dasar Pokok-Pokok Agraria. Kedudukan Hak Pengelolaan, yaitu menempatkan Hak Pengelolaan pada ranah hak publik atau bagian dari hak penguasaan dari negara yang berisi kewenangan publik sesuai dengan tujuan awal pemberian Hak Pengelolaan, sehingga hak menguasai negara atas tanah tidak diarahkan menjadi hak perdata dan dapat dimanfaatkan guna mewujudkan kesejahteraan hukum bagi masyarakat. Melalui peran aktif pemerintah sebagai perwakilan negara yang diberikan kuasa secara hukum oleh masyarakat untuk mengatur, mengelola, memanfaatkan tanah di wilayah teritorial Indonesia, dapat diwujudkan salah satunya melalui pemenuhan atas kebutuhan tempat tinggal dalam rangka penyelenggaraan pembangunan rumah susun bagi masyarakat berpenghasilan rendah. Pembangunan rumah susun diatas Hak Pengelolaan diharapkan dapat menjadi salah satu jawaban dalam rangka memecahkan permasalahan kebutuhan tempat tinggal. Dalam praktiknya saat ini pemerintah mengembangkan pembangunan rumah susun modern dengan konsep Transit, Oriented, Development (TOD) berikut kebijakan-kebijakan melalui peraturan perundang-undangan yang memfasilitasi serta berpihak kepada masyarakat berpenghasilan rendah.

Abstract

The issuance of certificates of overlapping land rights gives rise to land disputes involving the Land Office as the authorized official and also the community who own the land rights. This research aims to examine and analyze dispute resolution over overlapping land title certificates issued based on PTSL using dispute resolution theory (Dean G. Pruitt and Jeffrey Z. Rubin). This research uses a type of normative juridical research with a statutory approach, conceptual approach and case approach. The technique for collecting legal materials is carried out by studying documentation of sources of legal materials regarding the implementation of Complete Systematic Land Registration. The analysis technique for legal materials is carried out using grammatical legal interpretation and analogous legal construction methods. The results of the research can be concluded that resolving disputes over overlapping land title certificates issued based on PTSL can generally be carried out through administrative procedures that refer to Article 66 in the ATR/BPN Ministerial Regulation Number 11 of 2016 concerning Settlement of Land Disputes and court decisions to provide legal certainty of ownership of disputed land rights.

Abstract

Perubahan pembuatan Minuta Akta diatur dalam Pasal 48 ayat (2) Undang-Undang No 2/2014 Tentang Jabatan Notaris, hanya mengijinkan untuk dilakukan penggantian, penambahan, pencoretan dan penyisipan kata atau kalimat ke dalam akta. Perubahan Minuta Akta harus dibuatkan Akta Berita Acara sesuai Pasal 51. Minuta Akta sebagai dasar pembuatan Salinan Akta sehingga keduanya harus Identik, agar tidak menimbulkan suatu akibat hukum berupa terdegradasi, pembatalan dan di batalkan demi hukum dari suatu akta otentik. Notaris harus bertanggungjawab secara hukum atas akta yang dibuat agar tidak menimbulkan sanksi hukum secara administrasi, Perdata dan Pidana atas kerugian yang dari terbitnya suatu akta. Penelitian hukum yang dilakukan penulis menggunakan Analisa hukum normatif dengan berdasarkan peraturan undang-undang yang berlaku sebagai bahan untuk mendapatkan data pendukung terhadap permasalahan. Sumber data pengdukung terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Penelitian ini menggunakan teori Akibat Hukum menurut R. Soeroso dengan Teori Tanggungjawab Hukum menurut Hans Kelsen. Hasil dari penelitian penulis mengenai Tanggungjawab Hukum Notaris Atas Frasa Diberikan Sebagai Salinan Yang Sama Bunyinya dalam Salinan Akta yang tidak sesuai dengan Minuta Akta, dapat mengakibatkan akta tidak memiliki kekuatan sebagai alat pembuktian yang sempurna, hal dapat memberikan suatu tanggungjawab hukum bagi Notaris atas kerugian-kerugian yang timbul baik secara administrasi, perdata dan pidana. Karena baik Minuta Akta dan Salinan Akta merupakan akta yang otentik dan harus identik sesuai Pasal 1888 KUHPerdata, Frasa Diberikan Sebagai Salinan Yang sama Bunyinya dengan Minuta Asli, maka hal ini merupakan peraturan perundangan yang harus dipatuhi, karena bukan berupa suatu klausal baku seperti yang dimaksud dalam Pasal 1 angka 10 Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen

Abstract

Violations of the indigenous peoples' rights to customary land ownership recognized by the state often fail to provide justice and legal certainty to the indigenous communities. For instance, the customary land dispute between the Mansim indigenous community and a third party has yet to find a resolution and offer legal certainty to the parties involved, despite the dispute having gone through judicial settlement. The legal theories applied here include legal certainty and dispute resolution. The method used in this study is normative juridical legal research, conducted by examining library materials or secondary data only, supported by interviews. The approaches in this study include the legislative approach, the conceptual approach, the analytical approach, and the case approach. The sources of legal material in this study are primary, secondary, and tertiary legal sources, with the collection technique involving the identification and inventory of positive legal rules, examination of library materials, and analysis of legal material sources through systematic and analogous legal interpretation.The findings of the study include that the resolution of overlapping customary land disputes with third parties, based on the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Regulation No. 21 of 2020 concerning the Handling and Settlement of Land Cases, can begin with a mediation process. Mediation is implemented in the dispute between the Mansim indigenous community and a third party, using the Yielding and Problem-Solving strategy approach. The legal certainty of the peace deed, which is an authentic act in the context of resolving overlapping customary rights with certificated land, has the binding legal force and becomes the law for those who execute the agreement

Abstract

In the provisions of Article 62 of Law Number 13 of 2003 concerning Manpower, it regulates the provision of compensation for termination of employment contracts. In practice, companies do not provide compensation to workers whose employment relationships are terminated in violation of labor law regulations. This is certainly detrimental to workers. The method used in this research is normative juridical research.  The research results show that legal protection for employees for non-payment of compensation in the termination of employment contracts is in the form of repressive legal protection, namely that workers have the right to take legal action through litigation or non-litigation, namely in the form of Bipatrit, Tripartite and filing a lawsuit with the Industrial Relations Court, workers can even file an execution against the decision of the Industrial Relations Court.

Abstract

Dalam KUH Perdata disebutkan bahwa pewarisan hanya terjadi didahului dengan adanya kematian dan pewaris meninggalkan harta warisan yang akan jatuh kepada ahli waris menurut undang-undang sejauh tidak ditentukan lain dengan suatu surat wasiat. Aturan hak mewaris dari anak luar kawin, diatur tersendiri dalam KUH Perdata. Permasalahan penelitian ini, bagaimana hibah wasiat yang tidak dapat dilaksanakan anak luar kawin yang diakui? dan bagaimana perlindungan hukum anak luar kawin yang diakui terkait tidak dapat dilaksanakannya hibah wasiat? Metode yang digunakan yuridis normatif dengan pendekatan penelitian perundang-undangan, pendekatan kasus, pendekatan analitis, dan pendekatan konseptual. Anak luar kawin yang diakui terkait hibah wasiat yang tidak dapat dilaksanakan dapat melakukan gugatan ke pengadilan berdasarkan akta hibah wasiat yang dibuat di hadapan notaris dengan memenuhi syarat-syarat dari pewarisan serta tidak menyimpang dari batasan-batasan yang ditetapkan, hal ini sejalan dengan asas yang ada di dalam KUH Perdata yaitu hak saisine dan hak heriditas petition bahwa bukti perlindungan hukum yang dimiliki anak luar kawin mempunyai hak mewaris. Dengan demikian pelaksanaan wasiat tersebut memiliki kekuatan hukum yang harus dan wajib dilaksanakan oleh para ahli waris. Notaris dalam membuat akta wasiat harus memberikan penyuluhan hukum kepada pewaris mengenai aturan mewaris menurut undang-undang untuk menghindari sengketa dikemudian hari.

Abstract

This research aims to analyse the legal protection for land rights holders in Indonesia in the face of ownership disputes. Through a normative juridical approach, this research examines the regulation and implementation of legal protection, particularly in terms of land registration and proof of ownership. The findings show that legal protection has not been optimal due to limitations in the implementation of regulations, unclear administrative procedures, and low effectiveness of dispute resolution mechanisms. Reforms in the land registration system and the strengthening of related institutions are expected to improve legal certainty for land rights holders. This research contributes to the development of agrarian law with a focus on the protection of land ownership rights to ensure justice and legal certainty.

Abstract

n general, the execution of collateral objects causes disputes because the creditor wants the right to repay the debt on the collateral object, while the debtor is not willing to have the collateral object executed to pay off the debt. So sometimes in practice, creditors take the law into their own hands in the collateral execution process carried out by creditors as fiduciary recipients, to take over goods controlled by debtors without going through the correct legal procedures. This research discusses 1) How is the execution of fiduciary guarantees withdrawn by leasing companies by force? 2) What is the legal protection for debtors regarding the execution by leasing companies of fiduciary guarantees that are forcibly withdrawn? Constitutional Court Decision Number 18/PUU-XVII/2019 reduces the power of the executorial title of a fiduciary guarantee certificate which means that the ease of execution carried out by creditors cannot be carried out properly. This is not in line with the principles of droit de suite, droit de preference and para executie which are threatened with not being implemented as a result of the Constitutional Court's interpretation which states that the executorial power of a Fiduciary Guarantee Certificate has no legal force if there is no agreement on breach of contract and willingness to surrender the collateral object from the fiduciary guarantee provider (debtor). In the event of a default by the Debtor, the execution of the collateral object must be submitted to court first by the Creditor. If this is not done, the Debtor can file a lawsuit for an unlawful act against the Creditor's actions.Keywords :Fiduciary, Legal Protection, Guarantee Execution Debtors

Abstract

One of the most difficult execution processes for those seeking justice is the execution process based on the Deed of Assignment of Mortgage Rights. Obstacles that arise include when the auction buyer attempts to execute the mortgage but discovers that the mortgaged object has been leased by another party, the collateral object is in dispute with another party, or the object has been sold or transferred without the creditor's knowledge. The research questions are: How is the legal protection afforded to the auction winner for an object that cannot be enjoyed? And what are the legal consequences for the auction winner who cannot enjoy the land as the auction object? This research uses the Legal Protection Theory, which provides protection for human rights harmed by others, and this protection is provided by law. The Legal Consequence Theory, which explains the emergence of rights and obligations arising from legal relationships, whether due to legal acts such as agreements or legal events such as birth or death. The type of research used by the author in this thesis is normative juridical legal research. Research that uses entirely secondary data can be abandoned in developing a tentative theoretical framework, but developing a conceptual framework is absolutely necessary. Therefore, in developing a conceptual framework, formulations contained in statutory regulations are necessary. The theory of protection emphasizes the importance of preventive and repressive legal protection for every legal subject, including auction winners who obtain their rights through a legitimate auction process. However, its implementation in practice still shows inequality. There is still a need to improve the understanding of the community and banking parties regarding their rights and obligations in the implementation of auctions, including the importance of the principle of prudence as tested first in court so that there is legal certainty if the auction winner's application is granted, it will be ne bis in idem if it is sued again, at the time before carrying out the execution so that the legal consequences that arise can run according to the objectives of the law

Abstract

Discussion on legal protection for indigenous peoples regarding the sale of customary land without the consent of the community in Solok Regency. The research was conducted using normative methods supported by interviews with normative juridical research types. The results of the study concluded that the implementation of customary land registration whose ownership is communal/joint in the Minangkabau community has no regulations governing it. This has resulted in obstacles and controversies in customary land ownership in Minangkabau, West Sumatra. It is recommended that the government, especially Solok Regency, issue regulations that can protect customary law communities and provide counseling to indigenous peoples in customary land ownership, so that subsequent customary land sales do not result in losses for indigenous peoples and buyers.
