Abstract

The purpose of this study: First, to explain the application of furniture production and marketing in CV Indri Jati Furniture in the perspective of antitrust law. Second, to analyze the legal consequences of furniture production and marketing applications on CV Indri Jati Furniture in the perspective of antitrust law. This type of research is sociological law, namely the monopolistic practice of CV Indri Jati Furniture in Pekanbaru based on Law no. 5 of 1999. The results of this study indicate that the application of furniture production and marketing at CV Indri Jati Furniture in the perspective of antitrust law is carried out in order to maintain company efficiency in production. However, the vertical integration in fact resulted in unfair business competition by creating competition barriers, as well as harming the community in this case, Karisma Jati Furniture and Rizki Jati Furniture. The legal consequences of a vertical integration agreement for business actors violating the provisions of Law No. 5 of 1999 is the imposition of sanctions for business actors in accordance with statutory provisions, namely administrative sanctions, principal penalties and additional crimes. If the vertical integration results in unhealthy business competition among business actors, the unavailability of access for business competitors to enter the market, a decrease in the quality of goods / products, a waste of money for companies, and no other choices for consumers to buy goods / products.

Abstract

Harta kekayaan yang dikuasai telah ditentukan dalam undang-undang nomor 40 tahun 2007 tentang Badan Usaha Berbadan Hukum. Hal ini mengharuskan UMKM harus berbadan hukum agar UMKM secara hukum tunduk pada undang-undang nomor 40 tahun 2007 tentang Badan Usaha Berbadan Hukum. Namun kenyataannya tidak demikian, pemerintah melalui perangkat hukum peraturan pemerintah mengeluarkan PP N0 29 Tahun 2016 tentang Perubahan Modal Dasar Badan Usaha Berbadan Hukum, khususnya UMKM mengaturnya sendiri berbeda dengan Harta Kekayaan Dasar dalam Undang-Undang Nomor 40 Tahun 2007 tentang Badan Usaha Berbadan Hukum. Benturan hukum ini telah berdampak pada praktek pembuatan dan pendaftaran Perusahaan Berbadan Hukum. Artinya Badan Usaha Berbadan Hukum bisa berdiri tetapi kelengkapan izinnya tidak bisa dikeluarkan oleh instansi terkait, dalam hal ini Badan Penanaman Modal Terpadu Satu Pintu. Tanpa SIUP, izin SITU membuat UMKM juga kesulitan dalam menjalankan usahanya, tersungkur ketika mengambil izin untuk berhubungan dengan mitra usaha yang memintanya. Abstract

This study analyzes the dynamics of marriage registration implementation in Pekanbaru City through a juridical-sociological approach. The main focus of the research is to examine the implementation of marriage registration regulations, identify inhibiting factors, and formulate an effective model of approach. The findings reveal that the ambivalence of Article 2 of Law No. 1 of 1974 on Marriage creates legal uncertainty, where society tends to perceive marriage registration merely as an administrative formality rather than as a requirement for the legal validity of marriage in the eyes of the state. The study further reveals the significant impact of unregistered marriages, particularly on the legal protection of women and children. Empirical data show that 45% of divorce cases cannot be formally processed due to the absence of a marriage certificate, while 35% of children from unregistered marriages face difficulties obtaining complete birth certificates. At the implementation level, there is a notable geographical disparity, with the highest compliance rate in Pekanbaru Kota (85%) and the lowest in Rumbai Pesisir (68%). The main inhibiting factors include regulatory, socio-cultural, economic, bureaucratic, and infrastructural aspects. The complexity of procedures, limited digital infrastructure (only 45% of Religious Affairs Offices possess adequate facilities for the SIMKAH system), and weak coordination between Religious Affairs Offices and the Civil Registry Office (with data integration only at 65%) further exacerbate the situation. This study recommends a holistic approach encompassing regulatory reform, infrastructure equalization, bureaucratic simplification, and intensive public outreach through multi-stakeholder collaboration to enhance the effectiveness of marriage registration in Pekanbaru City.
