Abstract

Hasil Muktamar NU ke 34 di Lampung tahun 2021 menghasilkan sebuah rekomendasi besar dalam tubuh NU. Setidaknya terdapat dua agenda besar yang diusung dan ditawarkan oleh Gus Yahya. Pertama, NU akan menghidupkan kembali pemikiran-pemikiran Gus Dur. Pemikiran-pemikiran Gus Dur tersebut diantaranya adalah mengembalikan NU ke Khittah seperti NU tidak akan terlibat dalam politik praktis. Kedua, NU akan menjadi motorik terhadap perdamian dunia. Mengingat NU saat ini adalah organisasi keagamaan terbesar di dunia. Sudah sewajarnya NU mengambil peran dalam kancah dunia internasional. Politik praktis NU memang pernah dilakukan dan NU terlibat dalam kepartaian di tahun 1955 dan ketika kepemimpinan Gus Dur NU mengembalikan fungsi dan peranan NU pada fungsi awal pada saat didirikan. Keputusan Gus Yahya dengan menawarkan dan mengambil langkah tegas bahwa NU dalam pemilihan Presiden dan Wakil Presiden di NU periode mendatang secara institusional tidak akan memberikan rekomendasi secara kelembagaan. Akan tetapi secara personal warga NU sebagai warga negara Indonesia memberikan hak sebebas – bebasnya untuk memilih dan memutuskan pilihannya kepada salah satu calon tertentu.

Abstract

In the context of Maqasid Al-Syariah, justice and balance are considered as the fundamental pillars in the formation and implementation of Islamic law. This helps prevent the misuse of the law and ensures that it aligns with Islamic values that promote peace, justice, and social welfare. Maqasid Al-Syariah is a key concept in Islamic law that advocates for justice and balance. By adhering to these principles, Islamic law strives to achieve broader objectives such as safeguarding individual rights, promoting societal well-being, and maintaining a balanced relationship with God. Therefore, Maqasid Al-Syariah plays a crucial role in shaping a fair and equitable Islamic legal system. Keywords: Islamic Law, Justice and Balance

Abstract

Interpreting and developing Islamic law in the context of evolving times is a crucial issue within the realm of Islamic jurisprudence. This article delves into how Islamic law has undergone transformation and adaptation over time to address the challenges faced by the Muslim community in the modern society. The interpretation of Islamic law has become the primary focus of scholars and theologians, aiming to understand Islamic teachings and apply them in a relevant manner within contemporary circumstances. Confronting the changes of the times, it is imperative to consider the fundamental principles of Islamic law, such as ijma' (consensus), qiyas (analogy), and ijtihad (personal interpretation), as tools for developing Islamic law to remain pertinent and in line with the demands of the era. This article also examines various approaches and methods employed in the effort to interpret and develop Islamic law, including the roles of fatwa institutions and Islamic legal bodies in this process. By comprehending how Islamic law can adapt to the evolution of time, we can establish a more inclusive and responsive framework to meet the needs of the modern Muslim society while upholding the core values and principles of the Islamic faith.
