Abstract

The purpose this study is to identify element of error in trademark infringement based on the Trademark and Geographical Indication Law and the Criminal Law enforcement for trademark infringement based on the Trademark and Geographical Indication Law. In this study, the authors conducted normative legal research. Where in this study using the normative Juridical approach, namely research conducted by examining library materials or secondary data. Research materials used are secondary data, namely data obtained from official documents, books related to the object of research, research results in the form of reports, theses, dissertations and statutory regulations. The result indicated that first, the elements of error in the violation of marks in the Trademark Law and Geographical Indications are seen in the actus reus and mens rea perpetrators of trademark infringement. Where actus reus is manifested as an evil act that is deliberately committed, and mens rea is manifested in the form of evil intent, namely using it without rights. Second, enforcement of criminal law for violation of marks based on the Trademark and Geographical Indication Law is manifested in the imposition of criminal sanctions as stipulated in the provisions of Article 100 and Article 101 of the Trademark and Geographical Indication Law. Where in addition to the form of criminal sanctions there are also fines. Keywords: Industry 4.0, law enforcement, trademark, geographical indication.

Abstract

This Research aim to find the connection between legal awareness UPN “Veteran” Jawa Timur Collegestudent with state defense attitude. Legal awareness is awareness or values contained in man about theexisting law or about laws that are expected to exist. Actually, what is emphasized is the values regardingthe function of the law and not a legal assessment of it concrete events in the community concerned. Legalawareness is very important in measuring the level of state defense attitudes. There are several indicatorsof the problem of legal awareness, namely Knowledge of legal regulations (law awareness); Knowledge ofthe contents of legal regulations (law acquaintance); Attitude towards legal regulations (legal attitude);Legal behavior patterns (legal behaviour). All indicators are related to campus regulations. Legalawareness, especially regarding student compliance in obeying the rules set by the campus. the higher thelevel of violation of campus discipline, the greater the reduction of student defending attitudes. Themethod used in this study begins with identification from various literatures related to the legal awarenessculture of students towards university regulations and policies in terms of the problems that occur and thechallenges that must be faced by the university. Then arranged in such a way as to bring up the rightproblem formulation which later can be comprehensively reviewed through field studies and directobservation, especially related to the problems taken in this study, namely the application of campusregulations to realize the attitude of defending the State in students. The research results in this study areexpected to be able to contribute to the university and the development of students who are expected tohave a spirit and attitude to defend the country.

Abstract

Abstract Media Sosial adalah wujud perkembangan teknologi yang digunakan sebagai sarana berkomunikasi, berinteraksi dan membangun jaringan melalui media online bagi seluruh lapisan kalangan masyarakat. Tujuan dari kegiatan ini adalah memberi pemahaman dan meningkatkan kesadaran dan etika kepada remaja santri didalam menggunakan media sosial diera digital. Pengaruh lingkungan dan keluarga dapat menjadi faktor penting mendorong remaja dan dampak yang didapatkan. Metode yang digunakan adalah Penyuluhan Hukum kepada remaja santri Pondok Pesantren Darul Falah dalam penggunaan media sosial agar dapat dimanfaatkan secara bijak dan cerdas serta menghasilkan suatu yang bermanfaat bagi penggunanya. Hasil dari serangkaian penyuluhan hukum ini yakni meningkatnya pemahaman, kemampuan dan pengetahuan kepada remaja santri Pondok Pesantren darul Falah dalam bermedia sosial dan transaksi lainnya yang berhubungan dengan Informasi Transaksi Elektronik (ITE), sehingga perkembangan teknologi informasi dapat dimanfaatkan secara optimal dan tepat. Serta meningkatkan kewaspadaan terhadap resiko yang akan didapat jika media sosial disalah gunakan. . Keywords: hukum, media sosial, Teknologi, Remaja Pondok Pesantren

Abstract

Morality is a principle of life based on the values of divinity, humanity and justice, as essential values in human life. This behavior can occur by anyone and anywhere, including among students. In Indonesia's positive law, immoral acts are implicitly regulated in the Criminal Code, the Pornography Law. However, because in the aspect of decency concerning ethical rules, placing criminal law as the ultimum remedium is more appropriate, because if it can still be carried out with social sanctions, then restorative justice will be achieved, in addition to placing criminal law as primum remedium. . Efforts to resolve student immoral cases would be better done with the concept of a minitrial or mini trial, involving the University Ethics and Law Committee (KEHU), students of perpetrators, students of victims, parents/guardians, and witnesses. KEHU acts as a mediator for the parties involved. The completion of the case is when the agreement is signed, and for students, coaching is carried out. The case with the minitrial is as in the Student Code of Ethics. If there is a case related to a criminal act, the minitrial decision can be taken into consideration by the competent authorities.

Abstract

Program asimilasi narapidana di lembaga pemasyarakatan (lapas) di Indonesia terus berjalan hingga Juni tahun 2023. Asimilasi ialah program bagi narapidana yang tujuannya ialah mempersiapkan mereka kembali di masyarakat dengan cara narapidana dibaurkan kepada masyarakat dalam menjalani Sebagian masa pidananya diluar lapas. Dalam implementasi program asimilasi perlu diteliti apakah penerapan program telah sesuai dengan peraturan yang mengatur atau tidak, serta hambatan serta upaya yang dihadapi dalam mengimplementasikan program terkait. Penulis menggunakan pendekatan penelitian kualitatif dengan jenis penelitian yuridis-empiris. Hasil penelitian ini menunjukkan bahwa implementasi peraturan dalam pemberian hak asimilasi bagi Narapidana tindak pidana umum di Lembaga Pemasyarakatan Kelas I Surabaya telah sesuai dengan peraturan berlaku. Namun dalam penelitian ini juga menemukan fakta bahwa terdapat hambatan tertentu yang dialami oleh Lembaga Pemasyarakatan Kelas I Surabaya dalam implementasi program asimilasi narapidana bagi naripidana tindak pidana umum.

Abstract

Human trafficking is an organized crime that violates human rights relating to freedom, security and has the potential to use acts of violence against victims. This research uses empirical juridical research methods by examining a phenomenon that occurs in society associated with the applicable laws. The research was conducted to find out the law enforcement against the crime of trafficking in persons, the obstacles in the implementation of law enforcement, and how the police efforts as law enforcers who act to handle obstacles at the level of investigation and investigation. The results showed that law enforcement of trafficking in persons was dominated by trafficking in persons with sexual utilization and trafficking in Indonesian migrant workers. Case handling begins with a public report then submitted to the unit handling human trafficking cases for a series of investigations, investigations, and submission of files to the prosecutor's office. There are different methods in handling cases tailored to the needs of cases of trafficking in persons with sexual exploitation or exploitation and migrant workers. Based on the research, it is known that investigators find various obstacles caused by internal factors or the investigation process itself and external factors or from the community. Law enforcement is carried out with the aim of restoring the law itself so that evaluation is needed so that the handling of human trafficking crimes runs effectively.

Abstract

Gambling games are a crime regulated in article 303 bis of the Criminal Code. Gambling games are often used as a livelihood. Gamblers often make this a livelihood because the lures that are given from gambling games look profitable with only a little money. But this is of course just a ruse so that someone is interested in participating in gambling. Article 303 bis of the Criminal Code has regulated the crime of gambling as a means of livelihood. The Pasuruan City Police Resort is trying to enforce the law on gambling crimes that occurred in Pasuruan City. Along with the development of the era, there are more and more types of gambling crimes. Judging from its history, criminal acts of gambling will always exist and some of the people playing gambling is a customary habit that does not need to be eliminated or even reported to the Police. This of course makes the role of the Police indispensable in informing the public that this gambling game is a crime that needs to be enforced.

Abstract

Mediation, as defined in Article 1 point 1 of the Supreme Court Regulation (PERMA) No. 1 of 2016 concerning Mediation Procedures in Court, is a method of settlement that uses a negotiation process to reach an agreement between the parties with the assistance of a Mediator. Mediation must be used as a tool to reduce the number of civil cases in court. This study intends to achieve the ease of implementing mediation with high transmission, confidentiality of the parties' names, shorter phases, a quick process, and easy access to the community. This is a descriptive analytical study that takes a normative legal approach. The results of this research show that mediation service providers use the "Ayo Mediasi" application to resolve civil matters outside of prosecution, collaborate with mediators from professional law firms, and are eager to invite the parties to reconcile.

Abstract

Human trafficking is a highly complex form of transnational crime involving transnational criminal networks. This crime generally originates from developing countries with unstable socio-economic conditions, where women and children are often the primary victims. They are forced or tricked into working in exploitative sectors, particularly sexual exploitation, labor exploitation, and other forms of oppression that benefit agents, distributors, and organized crime syndicates. In Indonesia, regulations regarding this crime are stipulated in Law Number 21 of 2007 concerning the Eradication of the Crime of Human Trafficking. This study aims to determine the form of legal protection provided to victims of human trafficking in the jurisdiction of the Surabaya Police, as well as to understand the various obstacles faced by police officers and the efforts made to overcome them. The research method used is empirical juridical, namely examining the law in practice through primary data obtained from interviews, observations, and official documents, then combined with secondary data in the form of legal literature, laws and regulations, and tertiary legal materials to support the analysis. This study found that the Surabaya City Police have implemented legal protection measures for victims of human trafficking in accordance with applicable regulations, from handling reports and conducting investigations and inquiries, to coordinating with relevant agencies such as social services, women's and children's protection agencies, and non-governmental organizations. However, several obstacles remain, including limited police resources, low victim awareness of reporting cases, and threats from perpetrators that discourage victims from cooperating. Despite this, maximum efforts continue to be made through improved inter-agency coordination, legal and psychological assistance for victims, and firm law enforcement against perpetrators. Therefore, it can be concluded that legal protection for victims of human trafficking at the Surabaya City Police has been quite effective, although institutional strengthening and increased public legal awareness are still needed.

Abstract

This study is designed to understand how the application and implementation of restorative justice serve as a last resort principle for handling cases of illegal street racing committed by minors in the Sampang City Police jurisdiction. The approach used in this study is the empirical juridical method, involving the Conceptual Approach and the Statute Approach. The research questions addressed in this study are: (1) How is restorative justice implemented at the police level for handling cases of illegal street racing committed by minors (a study in the Sampang City Police area)? (2) What are the challenges and efforts in implementing restorative justice at the police level for cases of illegal street racing committed by minors (a study in the Sampang City Police area)? According to the study’s findings, the conclusions are as follows: The first research question explores the implementation and process of restorative justice carried out by the Sampang City Police for cases of illegal street racing by minors. The second research question reveals various obstacles in the implementation of restorative justice at the police level concerning cases of illegal street racing involving minors. Additionally, efforts are being made by the police to prevent illegal street racing committed by minors.
