Abstract

AbstractThis study aims to find out the problems of workers and the implementation of laws and regulations that apply during the Covid-19 pandemic. This type of research is doctrinal legal research using a problem approach consisting of a statutory approach, conceptual approach, and case approach. The results showed that (1) during the Covid-19 pandemic there were increasing problems between employers and workers regarding wage cutting policies implemented by companies; (2) Through the circular of the Ministry of Manpower No. M/3/HK.04/III2020 concerning Worker Protection and Business Continuity in the Framework of Prevention and Prevention of Covid-19, the government gives leeway to be agreed together between companies and workers related to wages to be carried out especially in the Covid-19 pandemic conditions.Keywords: Legal Protection; Workers; Wage Cuts; Covid-19.AbstrakPenelitian ini bertujuan untuk mengetahui permasalahan pekerja dan pelaksanaan peraturan perundang-undangan yang berlaku di masa pandemi Covid-19. Jenis penelitian ini adalah penelitian hukum doctrinal dengan menggunakan pendekatan masalah yang terdiri dari pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Hasil penelitian menunjukkan bahwa (1) selama masa pandemi Covid-19 terdapat peningkatan masalah antara pemberi kerja dan pekerja mengenai kebijakan pemotongan upah yang dilaksanakan oleh perusahaan; (2) melalui surat edaran Kemenaker No M/3/HK.04/III2020 tentang Pelindungan Pekerja dan Kelangsungan Usaha dalam Rangka Pencegahan dan Penanggulangan Covid-19, pemerintah memberi kelonggaran untuk disepakati bersama antara perusahaan dan pekerja terkait pengupahan yang akan dijalankan khususnya dalam kondisi pandemi Covid-19.Kata Kunci: Perlindungan Hukum; Pekerja; Pemotongan Upah; Covid-19.

Abstract

The existence of covid-19 has an impact on the decline in the economy and investment to finance infrastructure in Indonesia. The government must maintain a favorable investment environment in the face of the covid-19 pandemic. This is essential in order to create a level playing field for investors. Insurance is one possibility to non-bank infrastructure financing; this is related to the insurance industry's ability to generate revenue during a pandemic due to increased public awareness of the significance of self-protection against high healthcare costs if exposed to the 19th plague. As a response, the government must aim to attract investors in the insurance business, who will eventually be engaged to create an alternative investment insurance fund for infrastructure development through a Public Private Partnership.

Abstract

Kopi merupakan produk minuman dari biji kopi yang telah digiling lalu kemudian diseduh menggunakan banyak metode dan merupakan salah satu minuman paling populer yang dikonsumsi hampir semua kalangan. Pada era ini produk olahan kopi yang ditawarkan sangat beragam dari kopi murni hingga kopi sachet dengan aneka rasa. Selain itu, Konsumen produk kopi dengan sangat mudah bisa mendapatkan dan mengonsumsi kopi yang diinginkan. Dengan hal ini dimana Indonesia ialah negara dengan penduduk yang kebanyakan seorang muslim, maka Jaminan Produk Halal untuk produk olahan kopi sangat dibutuhkan bagi konsumen maupun pelaku usaha. Negara di tahun 2014 sudah mengundangkan UU No. 33 Tahun 2014 perihal Jaminan Produk Halal (JPH) yang bertujuan untuk melindungi hak konsumen muslim. Upaya pelaksanaan Jaminan Produk Halal (JPH) ditandai dengan label halal dan sertifikat yang diterbitkan Badan Penyelenggara Jaminan Produk Halal yang bernaung di Kementerian Agama namun pelaksanaan sertifikasi dan labelisasi halal dinilai masih sangat kurang dilihat dari mayoritas pengusaha yang tidak mendata produknya untuk mendapatkan label halal dan sertifikat terutama pengusaha dengan skala bisnis mikro kecil menengah. Coffee is a beverage product from coffee beans that have been ground and then brewed using many methods. Coffee is one of the most popular drinks consumed by almost everyone. The coffee industry has grown a lot compared to ten years ago. Nowadays, the processed coffee products offered are very diverse, from pure coffee to sachet coffee with various flavors. Consumers of coffee products can very easily get and consume the coffee they want. Considering that Indonesia is a country with a population that is mostly Muslim, the Halal Product Guarantee for processed coffee products is very much needed by consumers and businesses. The state in 2014 has enacted Law No.33/2014 regarding JPH (Halal Product Guarantee). The law aims to protect the rights of Muslim consumers from the distribution of processed food and medicinal drinks which are consumed in Indonesia. Halal Product Guarantee is a regulation that is mandatory (mandatory) implemented by all business actors who trade their products in Indonesia, including products originating from abroad. Efforts to implement Halal Product Assurance (JPH) are marked by a halal label and a certificate issued by the Halal Product Assurance Organizing Body under the auspices of the Ministry of Religion but the implementation of halal certification and labeling is considered to be still lacking, seen from the majority of entrepreneurs who do not record their products to obtain halal labels and certificates, especially entrepreneurs with micro, small and medium scale businesses.

Abstract

Muslim tourists may take advantage of a variety of Muslim-friendly tourism options, including halal tourism. A growing number of nations are considering expanding their halal tourist offerings, thanks to the industry's meteoric rise since 2018. Among 130 countries, Indonesia topped the 2019 Global Muslim Travel Index as the top halal tourist destination. This success has encouraged Indonesia to increase its efforts in developing halal tourism, taking use of the country's vast potential in this area. Indonesia's advantage in halal tourism must be complemented by particular legislation implementations governing halal tourism to enable structured and orderly implementation. With appropriate regulations, it is hoped that the optimization of halal tourism may become more structured in terms of standards in the promising halal tourism sector, acting as a benchmark for other nations to adopt halal tourism practices. This study aimed to provide additional information on the importance of adopting legislative standards for enforcing halal tourism legislation in Indonesia. This study used normative methodology. In addition to the need for special regulations concerning halal tourism management, careful preparation in terms of adequate scientific and technological updates is required to ensure that halal tourism in Indonesia is well received in the global market. Moreover, there must be a regular control in updating halal tourism regulations in Indonesia between authorized institutions

Abstract

New legal products as well as amendments to existing regulations consistently influence the labor sector. One such example is the mandatory contribution to the Public Housing Savings (TAPERA), regulated under Government Regulation No. 21 of 2024 concerning Amendments to Government Regulation No. 25 of 2020, as a derivative regulation of Law No. 4 of 2016 on Public Housing Savings. This study aims to analyze the effectiveness of government policy implementation related to the mandatory TAPERA contributions that must be fulfilled by workers. The research method employed is normative juridical, using both conceptual and statutory approaches. The findings indicate that the implementation of mandatory TAPERA contributions has not been fully effective. From a regulatory perspective, there are still overlaps with labor and social security regulations, creating legal uncertainty. From an implementation perspective, the contribution collection mechanism has not been well integrated into the labor administration system, thus causing technical obstacles. Furthermore, the low level of public understanding and trust in TAPERA affects worker participation. Therefore, although TAPERA has a strong legal foundation, its effectiveness requires regulatory improvement, transparent management, accountable supervision, and adequate legal protection for participants. Moving forward, effectiveness can only be achieved if the policy is implemented consistently and in a coordinated manner, accompanied by continuous public outreach and institutional strengthening as the foundation for implementation.

Abstract

In today's world, it is still a widespread practice for employers to retain diplomas as a reassurance in job relationships across different industries. This occurs due to the absence of clear legal grounds within Indonesia’s labor law system. Fundamentally, this practice raises legal issues as it pertains to the right of ownership over personal documents and the potential violation of principles of worker protection as stipulated in Law No. 13 of 2003 on Manpower, Law No. 39 of 1999 on Human Rights, and the principle of contractual fairness. This research intends to investigate the occurrence of diploma retention practices in job relationships and to explore the types of legal safeguards that can be offered to employees. Using a normative-juridical approach and case study method, this article finds that withholding diplomas contradicts the principles of freedom to work and legal certainty, and potentially constitutes a form of indirect coercion that may be subject to civil and/or criminal litigation. The need for explicit regulation and stricter labor supervision is the primary recommendation to prevent similar practices in the future.

Abstract

Healthy living is an important part of every individual in the world, with various factors influencing health, one of which is beverage consumption patterns. In Indonesia, especially among the younger generation, consumption of sweetened beverages, especially in consuming Sweetened Packaged Drinks (MBDK), has increased significantly. This phenomenon is triggered by the popularity of drinks that have gone viral on social media and aggressive advertising. The increase in MBDK consumption has the potential to increase various health problems, especially the risk of diabetes among young people. In an effort to control consumption patterns and prevent health risks, the implementation of MBDK Excise is necessary, which is considered to have an impact on several aspects, namely reducing excessive MBDK consumption, the impact on health, socio-economic, and increasing state revenue. The implementation of MBDK Excise has been successfully implemented in various countries, especially in Southeast Asian countries. So far, the implementation of MBDK Excise, which is being implemented by Thailand, Brunei, Malaysia, and the Philippines, has had a positive impact, so the plan to implement MBDK Excise in Indonesia needs to be realized immediately. Therefore, this study aims to analyze the urgency of interpreting MBDK excise duties in implementing regulations. The purpose of this study is to analyze the urgency of implementing the MBDK Excise Tax in implementing regulations as a form of consumer protection. The method used in this research is a normative juridical research method, which involves reviewing secondary literature and then thoroughly analyzing the data for the purposes of this paper.
