Abstract

Masalah yang sering terjadi di Indonesia adalah kasus narkotika pada anak tidak diberikan perlindungan hukum dan banyak dari kasus ini anak justru diberikan hukuman di penjara. Penelitian ini ditunjukan untuk menganalisis yuridis pemberian tindakan rehabilitasi sebagai upaya perlindungan hukum terhadap anak dalam tindak pidana narkotika dalam Putusan Pengadilan Tenggarong Nomor 21/Pid.Sus-Anak/2020/PN. TRG. Penelitian ini menggunakan metode penelitian yuridis normatif atau penelitian doctrinal. Hasil penelitian bahwa penegakan hukum rehabilitatif terhadap pecandu narkotika dan penyalahgunaan narkotika pada anak berdasarkan Undang-Undang narkotika perlu adanya sebuah penegakan hukum tanpa menahan dan memberikan hukuman penjara melainkan diberikan alternatifnya yaitu dengan cara menempatkan para pecandu narkotika ke lembaga rehabilitasi. Penerapan pidana terhadap anak penggunaan narkotika dalam putusan no. 21/pid.sus-anak/2020/PN.TRG memberikan hukuman rehabilitasi setelah dilakukannya penjara selama 4 bulan pada anak. Tidak diterapkan rehabilitasi ketika penyidikan dan penuntutan. Penerapan rehabilitasi baru dilakukan setelah adanya vonis putusan Majelis Hakim, yang disertai vonis pidana penjara. Dengan ini, maka PN Tenggarong dapat dinilai tidak konsisten dalam menerapkan keadilan restoratif kepada anak yang berhadapan di hadapan hukum. Hal ini sudah diatur dalam pengaturan hukum pada pemberian tindakan rehabilitasi terhadap anak dalam tindak pidana narkotika diatur berdasarkan Pasal 54 Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika dan Surat Edaran Mahkamah Agung RI Nomor: 4 Tahun 2010 tentang Penempatan Penyalahgunaan.

Abstract

The COVID-19 pandemic is very risky and requires quick action and policy-making for the safety of all. For this reason, the government has taken a policy related to using specific budget allocations by facilitating the procurement process of goods and services to prevent and handle COVID-19. Still, in the process, many acts have occurred that are detrimental to state finances. The method used in this thesis is the normative legal research method, which refers to legal norms with data sources obtained by examining library materials to obtain secondary data in the form of primary, secondary, and tertiary materials. The study results found that in the two decisions studied, the judges had carefully considered the legal facts in the trial but still had different interpretations regarding the element of "Unlawfully" in the Corruption Law. Several factors cause the provisions of Article 2 paragraph 2 of the Corruption Law not to be applied to perpetrators of corruption during the pandemic, namely from the Public Prosecutor, Panel of Examining Judges, and the applicable regulations. Criminal policy in overcoming corruption in the relationship between business actors and procurement officials is carried out in two ways: non-penal policy by increasing supervision. In contrast, penal policy has been carried out by making changes to the Corruption Crime Law. It is hoped that the Examining Judge can have uniformity in interpreting Article 2 and Article 3 of the Corruption Crime Law so that there is no disparity in punishment for corruption convicts so that no parties feel disappointed by the decisions made.

Abstract

Abstract: The problem of illegal cultivation on State-Owned Enterprise (BUMN) plantations that occurs at PT Perkebunan Nusantara III (PTPN III) Persero Kebun Bangun is not just a regional problem, but should be a national problem, a national and state problem, because the problem of illegal cultivation occurs in throughout Indonesia. The formulation of the problem in this thesis research is how to regulate positive law regarding criminal acts of illegal cultivation at PTPN III Kebun Bangun, what is the purpose of punishing criminal acts of illegal cultivation at PTPN III Kebun Bangun, how to deal with criminal acts of illegal cultivation at PTPN III Kebun Bangun. The research method used is a normative legal research method with descriptive analytical research characteristics, with a statutory statute approach, a conceptual approach, a historical legal approach, a historical legal approach, a comparative comparative approach, and a case approach. Primary, secondary and tertiary data sources, using library research techniques and document data collection are then analyzed qualitatively. It is necessary to increase the capacity of law enforcement officials in dealing with the problem of criminal acts of illegal cultivation.Keywords: Prevention, Crime, Illegal Cultivation, PTPN III Abstrak: Permasalahan dalam Penggarapan liar di perkebunan Badan Usaha Milik Negara (BUMN) yang terjadi pada PT Perkebunan Nusantara III (PTPN III) Persero Kebun Bangun bukan sekedar merupakan Masalah daerah, namun seharusya menjadi masalah nasional, masalah bangsa dan Negara, karena masalah penggarapan liar terjadi di seluruh wilayah Indonesia. Rumusan masalah dalam penelitian tesis ini adalah bagaimana pengaturan hukum positif terhadap tindak pidana penggarapan liar di di PTPN III Kebun Bangun, apa tujuan pemidanaan terhadap tindak pidana penggarapan liar di PTPN III Kebun Bangun, bagaimana penanggulangan tindak pidana penggarapan liar di PTPN III Kebun Bangun. Metode penelitian yang digunakan adalah metode penelitian hukum normatif dengan sifat penelitian deskriptif analisis, dengan pendekatan perundang-undangan statute approach, pendekatan konseptual conceptual approach, pendekatan sejarah hukum historical approach, pendekatan perbandingan comparative approach, dan pendekatan kasus case approach. Sumber data primer, sekunder dan tersier, dengan teknik penelitian kepustakaan (library research) dan pengumpulan data dokumen kemudian dianalisis secara kualitatif. Perlu dilakukan peningkatan kapasitas aparat penegak hukum dalam menghadapi masalah tindak pidana penggarapan liar ini.   Kata kunci: Penanggulangan, Tindak Pidana, Pengarapan Liar, PTPN III

Abstract

Green This research explores the normative, ethical, and constitutional foundations necessary for addressing green financial crime in Indonesia through an integrated framework that combines Islamic jurisprudence, Pancasila values, and constitutional environmental mandates. While financial misconduct causing ecological harm, such as the misuse of climate funds or carbon trading fraud, continues to escalate, Indonesia's environmental legal framework lacks clear definitions and effective enforcement mechanisms to address such crimes adequately. This study employs a normative legal research method, incorporating statutory, conceptual, comparative, and futuristic approaches, supported by content analysis to examine existing regulations' limitations and alternative normative systems' potential contributions. Islamic legal principles such as ʿadl, maṣlaḥah, mīzān, and sadd al-dharīʿah offer a moral foundation for establishing ecologically responsible financial governance. At the same time, Pancasila affirms a justice-based model rooted in national ideology. Furthermore, constitutional guarantees of the right to a healthy environment remain under-enforced due to legal fragmentation and institutional barriers. This research advocates for a value-based reform model that frames environmental protection as an administrative task and a multidimensional ethical obligation grounded in religious, philosophical, and constitutional perspectives. It proposes a framework for more accountable, sustainable, and spiritually rooted environmental governance in Indonesia.

Abstract

The problem of spreading fake news/hoaxes. This happens almost all over the world, including Indonesia. One example of hoaxes in Indonesia is the spread of false information in North Sumatra province, especially through social media. Thesis writing technique This research approach is a normative legal system. The results of the study show that Developing a Criminal Law Policy to Combat False Information Crimes Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning the Criminal Code, Law no. 1 of 1946 concerning Criminal Law Regulations, and Law Number 1 of 2023 concerning Electronic Transaction Information (ITE). Provisions related to the COVID-19 pandemic are in the updated Criminal Code.
