Abstract

Kegiatan perusahaan pada hakekatnya merupakan upaya bersama antara pihak pengusaha dan pekerja yang bertujuan untuk pertumbuhan perusahaan dan juga untuk kesejahteraan para pekerja. Oleh karena itu pihak perusahaan perlu memberikan suatu imbalan yang layak kepada pekerjanya sesuai dengan peraturan perudang-undangan yang berlaku. Dan selain itu, perusahaan wajib memperhatikan segala upaya untuk peningkatan kesejahteraan para pekerja sesuai dengan kemampuan dan kemajuan perusahaan. Hubungan kerja yang baik hanya bisa dicapai apabila setiap karyawan dan perusahaan dapat memahami serta menghayati hak dan kewajiban masing-masing pihak. Dimana pada akhirnya akan menimbulkan dan menumbuhkan saling menghargai dan saling mempercayai dalam menjaga iklim kerja sama yang baik dan harmonis. Yang menjadi permasalahan pokok dalam penelitian ini adalah bagaimana Sistem pengupahan bagi pekerja dalam perjanjian kerja waktu tertentu (PKWT) berdasarkan Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan dan perlindungan pengupahan dalam perjanjian kerja waktu tertentu (PKWT). Metode yang digunakan dalam penelitian ini jika dilihat dari sudut jenisnya, maka penelitian ini tergolong kedalam penelitian normatif. Sedangkan jika dilihat dari sifatnya, maka peneliian ini bersifat deskriptif analitis, yaitu menerangkan dan menganalisa. Upah adalah suatu penerimaan sebagai imbalan dari pengusaha kepada pekerja untuk sesuatu pekerjaan atau jasa yang telah atau akan dilakukan. Hubungan kerja adalah hubungan antara pihak pekerja dengan pihak perusahaan. Hubungan kerja ini terjadi karena adanya perjanjian kerja atau kesepakatan kerja diantara kedua belah pihak, dimana pekerja menyatakan kesanggupannya untuk bekerja pada perusahaan dan pihak perusahaan menyatakan kesanggupannya untuk mempekerjakan pekerja dengan memberi upah. Perjanjian kerja waktu tertentu (PKWT) perjanjian telah ditetapkan suatu jangka waktu yang dikaitkan dengan lamanya hubungan kerja antara pekerja dengan pengusaha. Sistem pengupahan berdasarkan peraturan perusahaan antara pekerja dengan pengusaha. Dimana dalam peraturan perusahaan tersebut dibuat secara tertulis dengan memuat hak-hak dan kewajiban pekerja, termasuk sistem pengupahan.

Abstract

Background. This study was conducted to analyze and assess the barriers in the implementation of oil palm plantation contributions to the government and local communities in Kampar Regency, Riau. Purpose. The samples of this research are oil palm plantation companies and local communities located in Kampar Regency, Riau. Method. n its discussion, the researcher uses a normative juridical approach, the normative juridical approach used in this research is an approach through positive law, namely positive legal rules to find the legality of the data used is secondary data where journals, articles, books, reviews, papers, and others become the main source in this research. Results. The results of this study indicate that 1) the analysis of the contribution of development in the field of capitalization of oil palm plantations by plantation companies to the government and society has not been significant to economic growth. 2) the implementation of oil palm companies towards the government and the people of Kampar Regency, Riau is a different understanding and implementation in perceiving the law, the effectiveness of the budget year is still lacking, the budget is not absorbed, and employment is not absorbed. Conclusion. In addition, field research can also be used as a complement, namely interviews supported by primary data.

Abstract

Background. The existence of Article 28 of Law Number 11 of 2020 in conjunction with Government Regulation in Lieu of Law Number 2 of 2022 and Law Number 6 of 2023 Paragraph 3 on Job Creation, Government Regulation Number 26 of 2021 on the Implementation of the Agricultural Sector. Purpose. Minister of Agriculture Regulation Number 18 of 2021 on the Facilitation of Community Plantation Development, Minister of Agrarian and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Regulation Number 18 of 2021 on the Procedures for Determining Management Rights and Land Rights, and Circular Letter of the Minister of Agrarian and Spatial Planning/Head of the National Land Agency Number 11/Se-Hk.02.02/Viii/2020. Method. the Implementation of Company Obligations in Facilitating Community Plantation Development collectively render the imperative of land redistribution for community plantations, constituting 20% of the aggregate land entitlements vested in plantation enterprises, not as an enforceable obligation but rather as an elective premise, wherein the ethos of facilitating community plantation development is underscored. This scholarly inquiry adopts a Normative Juridical methodology, employing both legislative scrutiny and a case study approach. Results. The findings assert, that the extant regulatory framework concerning land redistribution, as a commitment levied upon plantation entities for fostering community plantation initiatives, presently lacks parity, given that the apportionment of 20% (twenty percent) of land expanses granted under Business Use Rights or from the territories delineated in Plantation Conclusion. Business Licenses or Cultivation Business Licenses, earmarked for community beneficiaries, no longer carries the hallmark of an obligatory tenet but is relegated to the sphere of discretionary choice within the ambit of community plantation development facilitation programs.

Abstract

At a company called pt. Tenago trimindo engaged in the farmers' forest industry, they made an agreement with the people who became workers/ laborers. The employment contract is made as an anticipation that each party will have the opportunity to default in the future. Both from the pt. Tenago trimindo or it could be from the employees. After some time has passed, a work agreement has been agreed between the company and the workers, the facts on the ground explain that the people who work have deviated from the agreed work contract. The fact that the author got from various information there are several contract workers/labor contract treason, both work contracts and collective labor contracts, the violation committed by contract workers/laborers is to run away from the company before the work contract expires, while in the agreement made by pt. Tenago trimindo which has been agreed upon by contract workers/laborers must complete the term of their work contract properly. As for in this study, there are main problems that will be discussed, namely, the factors occurring default agreements between contract workers against pt. Tenago trimindo and the second is legal remedies that can be carried out by the company if the contract workers do not fulfill the contents of the contract work agreement. And the purpose of this study is the same as the formulation of the main problem, namely to find out the results of the formulation of the problem made by the researcher. This legal research belongs to the type of survey research (observational research). This type of research method is intended to solve problems that exist at the present time by collecting data and compiling or clarifying it, then analyzing and seeing a legal reality in society to then obtain a result The results of the research that the authors obtained are factors that influence the occurrence of defaults carried out by contract workers against the company pt. Tenago trimindo are: irregular working hours factors, late payment of basic salary factors, work pressure factors, non-fulfillment of workers' rights, inappropriate job descriptions. The legal remedies that can be taken by the company if the contract workers do not fulfill the contents of the contract work agreement are settlements by the disputing parties so that results that benefit both parties can be obtained. Such a bipartite settlement can be carried out through deliberation and consensus by the parties without being interfered with by any party. However, if the settlement of the non-litigation path cannot be reached, then the litigation route is taken, namely the industrial relations court, hereinafter referred to as PHI.

Abstract

Mediation is a dispute resolution outside the court that present a third party referred to as a mediator. The settlement of industrial relations disputes between contract workers and PT. Surveyor Indonesia Pekanbaru branch refers to law No. 2 of 2004 and the role of the mediator in the settlement of this dispute is considered quite good.
