Abstract

The primary aim of this research is to evaluate the imperative need for the establishment of a dedicated judicial body to address electoral disputes in Indonesia, particularly in light of the imminent concurrent elections scheduled for 2024 and the limited jurisdiction of the Constitutional Court in adjudicating such matters. This study employs normative legal research methodologies, incorporating legislative analysis, scrutiny of judicial precedents, and a comparative law framework as its principal approach. Uruguay serves as a pertinent comparative reference within the contextual parameters of this inquiry. The research findings unequivocally indicate the indispensability of instituting a specialized court for regional head elections, as mandated by Constitutional Court Decision Number 97/PUU-XI/2013. This imperative is substantiated by a series of legal arguments, namely: (a) the constrictive nature of the law's mandate, (b) the Constitutional Court's role as a constitutional enforcement institution rather than a court of justice, (c) the absence of an appellate process, contravening fundamental principles inherent to the electoral law system, (d) the quantitative approach to dispute resolution, impeding the attainment of justice, and (e) the presence of a distinct judicial system, engendering uncertainty and impeding the realization of justice, certainty, and expediency within the election legal framework. The establishment of specialized courts for regional head elections in Indonesia is analogous to the implementation of analogous courts in Uruguay and Costa Rica. In both jurisdictions, specialized election courts function as distinct entities, operating autonomously from the conventional judicial powers vested in the Supreme Court or the Constitutional Court.

Abstract

Background. The existence of Article 28 of Law Number 11 of 2020 in conjunction with Government Regulation in Lieu of Law Number 2 of 2022 and Law Number 6 of 2023 Paragraph 3 on Job Creation, Government Regulation Number 26 of 2021 on the Implementation of the Agricultural Sector. Purpose. Minister of Agriculture Regulation Number 18 of 2021 on the Facilitation of Community Plantation Development, Minister of Agrarian and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Regulation Number 18 of 2021 on the Procedures for Determining Management Rights and Land Rights, and Circular Letter of the Minister of Agrarian and Spatial Planning/Head of the National Land Agency Number 11/Se-Hk.02.02/Viii/2020. Method. the Implementation of Company Obligations in Facilitating Community Plantation Development collectively render the imperative of land redistribution for community plantations, constituting 20% of the aggregate land entitlements vested in plantation enterprises, not as an enforceable obligation but rather as an elective premise, wherein the ethos of facilitating community plantation development is underscored. This scholarly inquiry adopts a Normative Juridical methodology, employing both legislative scrutiny and a case study approach. Results. The findings assert, that the extant regulatory framework concerning land redistribution, as a commitment levied upon plantation entities for fostering community plantation initiatives, presently lacks parity, given that the apportionment of 20% (twenty percent) of land expanses granted under Business Use Rights or from the territories delineated in Plantation Conclusion. Business Licenses or Cultivation Business Licenses, earmarked for community beneficiaries, no longer carries the hallmark of an obligatory tenet but is relegated to the sphere of discretionary choice within the ambit of community plantation development facilitation programs.

Abstract

Disahkannya undang-undang cipta kerja menuai polemik luar biasa ditengah masyarakat. Reaksi penolakan terjadi diberbagai penjuru wilayah di Indonesia sebagai bentuk keberatan atas lahirnya undang-undang cipta kerja, mengingat undang-undang ini dibahas pada saat Indonesia sedang mengalami krisis diberbagai sektor akibat pandemi covid-19. Undang-undang cipta kerja dibentuk tanpa memperhatikan partisipasi dan kebutuhan masyarakat. Sehingga berdasarkan fenomena tersebut menarik untuk mengkaji mengenai konfigurasi politik yang terjadi pada pembentukan undang-undang cipta kerja. Metode yang digunakan dalam penelitian ini adalah metode yuridis normative dengan melakukan pengkajian kepustakaan terkait permasalahan yang dibahas. Undang-undang cipta kerja memiliki konfigurasi politik yang berwatak otoriter, hal tersebut ditinjau dari beberapa indikator penilaian seperti kedudukan partai politik dan parlemen yang lemah, kedudukan lembaga eksekutif (pemerintah yang intervensionis, dan pers yang terpasung).

Abstract

This research aims to examine in depth the existence of succession for Regional Heads using kinship relations in terms of the concept of the rule of law and formulate the implications of succession for Regional Heads based on kinship relations for the implementation of government duties in the region in the context of the rule of law. Indonesia, as stated in its constitution, adheres to the concept of a rule of law, this is attached to Article 1 paragraph (3) of the 1945 Constitution "Indonesia is a rule of law". One indicator of the application of the concept of the rule of law in a sovereign state is the limitation of power in administering the state. The problem studied in this research is related to how the succession of Regional Heads is related to kinship relations in terms of the concept of the rule of law. The research method used in this research is normative juridical, where the author examines through literature study and analyzes based on various relevant literature. Succession of Regional Heads based on kinship relations in Indonesia has recently become a disturbing phenomenon. As an effort to limit the existence of dynastic politics, this has been done by issuing "Law Number 8 of 2015 concerning Amendments to Law Number 1 of 2015 concerning the Determination of PERPPU Number 1 of 2014 concerning the Election of Governors, Regents and Mayors, especially in Article 7 letter r" However, this provision was canceled by the Constitutional Court with the issuance of "Constitutional Court Decision Number 33/PUU-XIII/2015". So, the absence of regulations that provide restrictions on this phenomenon has caused the succession of Regional Heads based on kinship relations to become a bad precedent in state administration Rampant updates to this research are expected by the government and the DPR to issue regulations that place restrictions on incumbents being involved in conflicts of interest in the succession of regional heads who have kinship relationships

Abstract

The Constitutional Court Decision No. 90/PUU-XXI/2023 concerning the age requirement for presidential and vice-presidential candidates has generated extensive constitutional debate in Indonesia. As the guardian of the 1945 Constitution, the Constitutional Court is expected to uphold legal certainty and constitutional consistency. However, this decision introduces a new interpretation by adding normative meaning to Article 169 letter q of Law No. 7 of 2017 on General Elections, raising questions regarding the limits of judicial authority. This article aims to analyze the ratio decidendi of Decision No. 90/PUU-XXI/2023 within the framework of open legal policy and to examine the extent to which the Constitutional Court has exercised its authority in adding legal norms. This study employs normative juridical research using statutory and conceptual approaches, supported by primary, secondary, and tertiary legal materials. The findings indicate that the decision reflects a shift in the Constitutional Court’s role toward norm creation, which deviates from its function as a negative legislator and undermines legal certainty and the principle of justice.

Abstract

Siswa-siswi smp pada era digitalisasi merupakan pengguna aktif sosial media. Adapun sosial media yang banyak digunakan adalah instragram, facebook, twitter dan tiktok. Disatu sisi penggunaan sosial media bagi siswa bermanfaat, diantaranya adalah keterbukaan akses informasi yang diperlukan oleh siswa-siswi. Namun demikian, penggunaan sosial media ini juga menuai berbagai dampak, diantaranya gangguan fokus belajar, berkurangnya etika dan sopan santun, minder, child grooming online, hingga menjadi korban penipuan karena kecerobohannya membagikan informasi pribadi seperti alamat, identitas keluarga, password akun dan sebagainya. Tujuan dari kegiatan ini adalah untuk memberikan edukasi terkait dengan data pribadi dan batasan privasi terutama bagi siswa-siswi dalam menggunakan sosial media. Metode kegiatan ini terdiri dari tahapan penyusunan materi, tahapan sosialisasi dan juga evaluasi. Kegiatan ini berhasil memperluas wawasan siswa-siswi SMPN 02 Siak Hulu dalam hal data pribadi dan batasan privasi dalam bersosial media. Wawasan ini diharapkan dapat meminimalisir dan melindungi siswa-siswi dari dampak negatif akibat penggunaan sosial media
