Abstract

Keterbukaan Informasi Publik dapat meningkatkan partisipasi masyarakat dalam melakukan pengawasan terhadap kinerja pemerintah. Sering kali terjadi sengketa antara pemerintah atau badan publik sebagai pengelola informasi dengan masyarakat sebagai pencari informasi. Penyelesaian Sengketa Informasi Publik dihadapkan dengan persoalan konflik norma, yaitu antara UU Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik, PERKIP Nomor 1 Tahun 2013 tentang Prosedur Penyelesaian Sengketa Informasi Publik dan UU Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan. Dalam situasi ini, mematuhi salah satu norma berakibat pada pelanggaran terhadap norma lainnya sehingga untuk dapat melaksanakan salah satu norma diperlukan adanya apa yang disebut sebagai derogasi atau peniadaan validitas norma lainnya yaitu asas lex superior derogate legi inferiori. Metode pendekatan yang digunakan dalam penelitian ini adalah penelitian hukum normatif.

Abstract

Moving on from partner problems, namely the minimal level of participation of Padang village women in village governance, both in terms of nominating village heads and/or becoming village heads, BPD heads, or other strategic positions in the village; the lack of participation and the role of Padang village women in preparing village development programs and drafting village regulations and the role of Padang village women in meetings in the village are still passive / less active 'listeners' in conveying opinions and suggestions. The output target of this community service activity is to increase the insight and knowledge of village cadres about the importance of women's participation in village government. The implementation stages carried out to overcome the above problems consist of three stages, namely: (1) preparation, (2) implementation, and (3) evaluation. In the preparation stage, administrative preparations, location and tools required during the implementation of the activity will be carried out. Then, the next step is the implementation stage. At this stage an increase in knowledge and skills will be carried out with education and training (training) and workshops, as well as the addition of instruments to increase women's participation in village governance. At the end of the training implementation, the community was given a response as evaluation material, and documentation of increasing women's participation in village governance. Furthermore, in the final stage of the activity, namely the closing and evaluation stage, in which a thorough assessment of the implementation of the activity

Abstract

The purpose of this research is first to discover the development of case examination procedures in the current State Administrative Court. Second, to determine the current case examination procedure in the State Administrative Court associated with the Theory of Effectiveness. The type of research used is normative research which places the law as a system of norms, with descriptive analytical methods, namely by describing existing problems and analyzing them. The results of this study show First, there has been an expansion of the competence of the State Administrative Court in receiving, examining & adjudicating a case. The State Administrative Court Law that has not regulated this has resulted in a procedural law vacuum so that the Supreme Court in the 2011-2017 timeframe issued its legal products in the form of Supreme Court Regulations, namely the State Administrative Court Law which previously only regulated 3 types of case examination procedures, namely ordinary examination, simple examination, and rapid examination, currently there are several new case examination procedures regulated in 5 Supreme Court Regulations. Second, in terms of one of the factors in the Theory of Effectiveness, namely the legal factor itself (the law), this factor states that to determine whether a written law functions or not depends on the rule of law itself, one measure of the success of this factor is that the existing rules regarding certain areas of life are quite synchronous / there is no horizontal conflict & hierarchy, but the current main regulation, namely the State Administrative Court Law, in fact has not been synchronised with other regulations issued by the Supreme Court in the form of Supreme Court regulations which aim to fill the void of procedural law, especially the law of examination.

Abstract

Penelitian ini mengkaji mengenai peran pemerintah daerah dalam pemenuhan hak atas pangan melalui percepatan pengembangan pangan berbasis lokal dengan  membuat kebijakan atau dokumen turunan yang dimasukkan ke dalam kebijakan daerah yang berlaku untuk mendukung komitmen pemerintah Indonesia untuk mencapai tujuan pembangunan nasional dan ketahanan pangan dan gizi, dengan mendasarkan pada “Peraturan  Menteri Pertanian No. 65/Permentan/OT.140/12/2010 Tentang Standar Pelayanan Minimal Bidang Ketahanan Pangan Provinsi dan Kabupaten/Kota dan Perpres No. 81 Tahun 2024 yang menetapkan tujuan berikut untuk percepatan penganekaragaman konsumsi pangan berbasis sumber daya local”.Demi tercapainya diversifikasi keanegaragaman pangan berbasi lokal yang akan justru meningkatkan kedulatan pangan, permasalahan dalam penelitian ini adalah upaya Peran Pemerintah Daerah dalam Pemenuhan Hak Atas Pangan Melalui Sumber Pangan Lokal dengan menganalisis peraturan perundang-undangan terkait.
