Abstract

Tulisan ini mencoba menyajikan informasi yang cukup memadai sekitar hukum Islam di Indonesia sesudah kemerdekaan dalam kemajemukan masyarakat dalam bidang perundang-undangan, budaya dan ibadah dengan ulasan sejarah yang dilaluinya. Perjalanan panjang dan cukup melelahkan bagi bangsa Indonesia hingga ke gerbang kemerdekaan, bila dikaitkan dengan sistem hukum, maka dikenal adanya tiga sistem hukum. Sistem-sistem hukum yang dimaksud bila diurut berdasarkan umurnya terdiri atas: sistem hukum adat, hukum Islam, dan hukum Barat. Setelah Indonesia merdeka, maka masalah yang sangat asasi adalah : Negara baru ini hendak didasarkan atas Weltanschauung apa? Para wakil rakyat Indonesia ketika itu terbagi ke dalam dua kelompok: satu kelompok mengajukan agar negara berdasarkan kebangsaan dan kelompok yang lain mengajukan Islam sebagai dasar negara

Abstract

Direct Election System in Makassar City in Islamic Law Perspective, this is located in Makassar City, South Sulawesi Province. This type of research is descriptive qualitative. While the approach used in this study is a formal juridical approach. The results of the study indicate that the mechanism of direct elections in Makassar City in accordance with the 1945 Constitution, Article 18 paragraph (4) affirms: "Governors, Regents, and Mayors respectively as Heads of Provincial, Regency, and City Governments are democratically elected". It's just that there are still those that are not in line with the provisions of Islamic law and law, for example being elected as Regional Head because of nepotism, using the power of money or called money politics. Regional Head in Makassar City, it can be said that he is competent. However, when viewed from the post-conflict local election law, it turns out that there is one important requirement that is omitted, namely about public testing, so that it is not chosen from its capacity, but is chosen more in terms of the strength of political parties and in terms of the strength of the funds. The character of the voters is also diverse and generally, there are still some whose voting rights can be bought with money.

Abstract

The socio-political leadership in the Kingdom of Balanipa strongly influenced by the history of its formation and relations with several significant kingdoms in South Sulawesi, also affected by the penetration of the colonizing nation into the land of Mandar. This study uses the concept of royal leadership with a historical approach, the time of colonization, and the inclusion of Islamic understanding in several kingdoms in South Sulawesi. By using several theories of historians, such as Ahmad Sewang, Muhammad Daud Amin, Edwar Polinggomang, and several studies of Ancient Manuscripts about the Balanipa Mandar and kingdom, such as Lontar to Napo, Luaor and Balanar Mandar. This research is a grounded research, namely in the form of historical research that seeks to recover data and historical sources both written in a number of books and classic texts such as the Lontara Mandar manuscript, and in speech, in the form of stories and testimonies by historical figures in the land of Mandar and know much about the history of the kingdom of Balanipa. The analysis shows that the discourse about the history of the kingdom in Mandar began from the formation of the kingdom of Balanipa in the mid-16th century, even though there was a large kingdom that was prominent before that was the Kingdom of Passokkorang (in Mapilli, Polman) and the Kingdom of Baras (in Pasangkayu, North Mamuju). The coronation of the king as the leader and appointment of the King in the kingdom of Balanipa, has strict requirements, one of which is to become a king, must bequeath a value of the principles of leadership that must prioritize the interests of the people, especially those relating to economic life, social, security and public order.

Abstract

Studi ini membahas tentang sejauhmana peran Bawaslu Provinsi Sulawesi-Selatan dalam menerapkan Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum untuk meminimalisir pelanggaran Pemilu di Kota Makassar. Jenis Penelitian ini ialah penelitian deskriptif kualitatif lapangan. Penelitian ini dilakukan untuk mengumpulkan sejumlah data yang diperoleh dari informan di lapangan untuk menemukan berbagai fakta atau fenomena sosial, kemudian menganalisisnya dan berupaya melakukan teorisasi berdasarkan apa yang diamati. Lokasi Penelitian dilakukan di Kota Makassar. Lokasi ini dipilih karena memiliki semua aspek pendukung agar dapat berjalan dengan baik dan Kota Makassar terkenal sebagai daerah sentral politik di Sulawesi Selatan.

Abstract

The results of this dissertation research show (1) the orientations of the inclusive insightful da’wah materials in Kecamatan Bacukiki are that da'i must be sincere, that da'i becomesa role model, that da'i always learns and upgrades knowledge. Inclusive da'wah should use local languages, straightforward ways, narrative-substantive da’wah without indoctrination, calm and wise da'wah. Da’wah should be suitable to the needs of mad'u, suitable to the development of science and technology, and the level of knowledge of mad'u. Inclusive Da'wah is carried out based on da'wah maps andits relevance to plural societies. It should encourage social transformation, can be applied, and carried out in a dialogical manner; (2) The obstacles of inclusive da'wah are fanatical people, da'wah that does not enlighten and educate, da’wah that is not in accordance with the situation, conditions and ways of thinking of the people, da’wah that does not useBuginese language, preserved Buginese culture, da’i who are not yet competent, not communicative, and generally still low in IT skills; (3) The solutions to the obstacles of inclusive da'wah are that there should be a mapping of da'wah in Kecamatan Bacukiki, the Regional Government and Ministry of Religious Affairs must be synergistic, da’i should master the local language namely Buginese, da’i should be trained. Inclusive da'wah should be comprehensive, affordable access to the society, having syllabus, enlightening da'wah, and da’i who has competence, integrity and exemplary profile. The implications of this research are that (1) the Regional Government of Parepare must take care of the tolerance and harmony of the Bacukiki society, (2) the Ministry of Religious Affairs of Parepare makes a map of da'wah, trains da'i, compensates da'i, etc.; (3) the Indonesian Ulema Council becomes a representative forum for the people and carries out its main duties and functions; (4) Religious Social Organizations train their da'i professionally and responsibly; and (5) Da’wah practitioners always develop their competence and qualifications, master Arabic, Indonesian, and Buginese, master Information and Communication Technology, and protect them selves to have personality integrity.

Abstract

Lesbian, Gay, Bisexual and Transgender (LGBT) is a term used since the 1990s to describe a group of people with different sexual orientations and behaviors. This term replaces the previous phrase "Gay Community". Some countries that reject LGBT people are Saudi Arabia, Yemen, Sudan and Iran, which are known to have imposed the death penalty on LGBT people. Though there have been no reports of actual death sentences in recent years. This study aims to reveal the relationship between the benefits of Islamic law and the possibility of imposing the death penalty on LGBT offenders. A normative approach is used in this study and it is found that in Islam, LGBT is prohibited. Although scholars differ on the punishment for LGBT offenders, there are still LGBT offenders found in the Muslim community. The maslahah perspective is presenting studies and guidelines that can be used as a reference in determining the appropriate punishment for LGBT offenders. The assumption about the permissibility of being LGBT can be rebutted by the presence of power that underlies one's religious beliefs. Scientists hope that punishment for LGBT offenders will not only become a discourse but should be considered if possible to be implemented. The government and all related elements must be able to provide awareness that stigma, discrimination or prejudice against LGBT people is something that can happen because religion prohibits LGBT actions and the concept of human rights is upheld in Indonesia.

Abstract

This paper explores the basic concepts and correlations of illat, hikma and sabab, all three of which are terms that often intersect in the construction of Islamic law. exploring and contemplating the existence of the three concepts is very important to map out the basic differences between the three. Concept exploration uses library sources that are analyzed to obtain the basis for conceptual differences and explore the relationship between illat, hikma and sabab. The correlation between Illat, Wisdom and Sabab can be divided into two: first; the relationship between illat and sabab to wisdom, wisdom is complementary to both in providing a more philosophical construction of law, not just punishing. Second; The relationship between illat and sabab is complementary if you look at the generality and specificity of the two.

Abstract

Artikel ini menjelaskan tentang masalah-maslah kontemporer yang telah bertumbuhan dan diminta untuk menyelesaikannya. Sekarang ini, yang penting harus dipahami bahwa pembela iman (mujtahid) harus benar-benar mempelajari dan melihat kembali banyak masalah hukum diputuskan dan tergantung pada kondisi dan kebutuhan. Jenis penelitian ini merupakan penelitian pustaka. Sedangkan hasil dari penelitiannya adalah: Sejarah perkembangan ijtihad dapat dikelompokkan menjadi lima masa, yaitu: masa Rasulullah SAW Di zaman Rasulullah SAW, masa sahabat, masa tabiin (masa imam mazhab), masa sesudah imam madzhab yang sempat mengalami masa taqlid dan masa kejumudan ijtihad, dan masa kini atau masa kontenporer. Ijtihad dalam isu-isu hukum Islam kontemporer merupakan salah satu metode yang menjadikan hukum Islam dapat lebih dinamis dan bersifat kontekstual serta tidak ketinggalan zaman.

Abstract

This article describes contemporary problems that have been growing and are being asked to solve. This research is literature research with a casuistic approach and analyzed descriptively qualitatively. The results of the study show that a mujtahid must really study and review many legal issues decided and depending on the conditions and needs. Ijtihad is one of the methods of extracting Islamic law that logically and rationally in social change always tries to conduct research or experiments on increasing law in society, so it must be tested that the value of ijtihad can be justified by scientists and is objective. Ijtihad in issues of contemporary Islamic law is one method that makes Islamic law more dynamic and contextual in nature and not out of date.

Abstract

استهدف هذا البحث إلى بيان ومعرفة دور القواعد الفقهية في بناء وتطوير الفقه الإسلامي في ممر العصور. هذا البحث هو بحث مكتبي واعتمد على منهج وصفي وتحليلي للوصول إلى النتائج. وكانت نتيجة البحث تبين أن للقواعد الفقهية والفتوى دورًا هامًّا في بناء الفقه الإسلامي وتطيره وتطوره حيث إن الفتوى قد أصحت منهجًا من مناهج استنباط الحكم الشرعي والقواعد الفقهية تُعتبر أهم أداة التي تساعد العالم والمجتهد والمفتي في عملية استنباط الأحكام الشرعية.
