Abstract

Resolving business disputes is very important in the business world and can be done using various methods such as mediation, arbitration, and litigation, each of which has advantages and disadvantages. This research aims to compare the effectiveness of these three methods in the context of resolving business disputes in Indonesia. This research method uses a comparative design, with primary data collected through interviews and surveys, as well as secondary data from document analysis and industry reports. The research results show that mediation is the most frequently used method and produces the highest level of agreement and satisfaction between the parties. However, the level of compliance with decisions is higher in arbitration and litigation methods. Industry trends show increased use of mediation, reflecting a shift towards more efficient and cost-effective solutions. These findings imply that companies and policymakers in Indonesia should promote the use of mediation, develop mediation capacity, and ensure a supportive regulatory framework is in place. With these steps, resolving business disputes in Indonesia can become more efficient, effective, and satisfying for all parties involved.

Abstract

Hak-hak asasi pelaku kejahatn mulai dari status sebagai tersangka, terdakwa bahkan sampai terpidana adalah tidak sebanding dengan perlindungan hakhak asasi kepada korban dalam ranga pemulihan dari kerugian atau penderitaan. Tujuan penelitian ini untuk mengkaji tantangan implementasi kebijakan pemberian restitusi bagi korban tindak pidana. Metode penelian ini menggunakan yuridis normative, mengkaji aspek aturan hukum yang berlaku saat ini. Penelitian ini didapatkan bahwa pentingnya pemberian restitusi bagi korban. Mengingat korban selama ini hanya diwakilkan oleh aparat penegak hukum. Meski adanya pengajuan ganti rugi oleh penuntut umum, namun tidak semuanya mengerti akan prosedur pengajuan ganti rugi atas terjadinya tindak pidana. Bagi korban sangat dibutuhkan mendapat ganti kerugian tanpa pandang usia, latar belakang Pendidikan dan status sosial.

Abstract

This study examines the legal challenges and gaps in consumer protection related to custody agreements in co-working spaces in Indonesia. With the growing popularity of co-working spaces, consumers face significant issues such as the burden of proof in cases of lost or stolen items, unreasonably low compensation limits, and a lack of awareness about their legal rights. Existing legal frameworks, including Law No. 8/1999 on Consumer Protection (UUPK) and the Indonesian Civil Code (KUHPerdata), provide basic consumer rights but fail to address emerging risks such as cybersecurity threats, data protection, and complex service contracts in the co-working space context. Through a normative legal research methodology, this study analyzes the adequacy of current laws and proposes specific reforms to enhance consumer protection. It recommends updates to the UUPK, including clear guidelines on physical and digital security, consumer contract transparency, and liability for loss or damage, particularly concerning digital goods. The study also suggests strengthening dispute resolution mechanisms, incorporating modern technologies like biometric identification and blockchain for improved security and transparency, and establishing industry-wide standards. Lastly, it emphasizes the importance of consumer education and advocacy to ensure that users are aware of their rights. By implementing these recommendations, Indonesia can ensure a more secure and equitable co-working space environment.

Abstract

This study aims to examine the company's liability from a legal point of view for the cancellation of a certain time work agreement during the covid-19 pandemic. This study uses a normative juridical research method. Based on Presidential Decree Number 12 of 2020 concerning the Determination of Non-Natural Disasters, the spread of Covid-19 is designated as a National Disaster. This is also guided by Law Number 4 of 1984 concerning Outbreaks of Infectious Diseases and Law Number 24 of 2007 concerning Disaster Management. The cancellation of a certain time work agreement as a result of the CoviD-19 pandemic, namely termination of employment by employers during the Covid 19 pandemic. The Covid 19 pandemic is used as a Force Majeure reason for employers to terminate employment. Force Majeure can legally be used as an excuse by business actors to lay off their workers. This is as stated in Article 164 Paragraph (1) of Law Number 13 of 2003 concerning Manpower.Penelitian ini bertujuan untuk mengkaji pertanggungjawaban perusahaan jika ditinjau dari segi hukum atas terjadinya pembatalan perjanjian kerja waktu tertentu di masa pandemi Covid-19. Penelitian ini menggunakan metode penelitian yuridis normatif. Berdasarkan Keputusan Presiden Nomor 12 Tahun 2020 tentang Penetapan Bencana Non Alam Penyebaran Covid-19 ditetapkan sebagai Bencana Nasional. Hal ini juga berpedoman pada Undang-Undang Nomor 4 Tahun 1984 tentang Wabah Penyakit Menular dan UU Nomor 24 Tahun 2007 tentang Penanggulangan Bencana. Batalnya perjanjian kerja waktu tertentu akibat dari pandemi Covid-19, yaitu pemutusan hubungan kerja yang dilakukan pengusaha pada masa pandemi Covid 19. Pandemi Covid 19 dijadikan alasan force majeure bagi pengusaha dalam melakukan pemutusan hubungan kerja. Force Majeure secara sah dapat dijadikan alasan oleh para pelaku usaha untuk melakukan PHK kepada pekerjanya. Hal ini sebagaimana disebut dalam Pasal 164 Ayat (1) Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan.

Abstract

This research was structured to find out and analyze the effectiveness of public services in Demak district, especially in the Demak district government's reporting channel. Along with technological developments, the Demak Regency Communication and Informatics Service (DINKOMINFO) is moving to provide efforts and innovation on issues regarding public services. The program provided is in the form of public services in the form of reports through booths, websites, SMS, social media, and applications to convey public complaints. This research is a qualitative descriptive study with a process of document analysis and observation. The information taken comes from a sample involving the people of Demak district. At this stage of the study, an analysis of public knowledge and the effectiveness of the number of users of the complaint report service was used, namely Hallo Demak and the SP4N report application, Demak district. The results of the study obtained the effectiveness of public services in Demak district through SP4N reports that the Demak district had experienced an increase in the range from December 2020 to mid-January 2021 in a period of 1.5 months receiving a total of 212 complaints, but the data was not optimal and uneven. There are still many people who do not know and even use the service. The lack of equality in the form of direct introduction and involving many parties such as students, university students, laborers, village officials, has an effect on ordinary people to participate and feel the benefits of the facilities provided.   Keywords: SPAN; Report; Introduction; Benefits.

Abstract

Penyelesaian sengketa online (ODR) menjadi salah satu cara untuk meningkatkan akses keadilan di dunia digital. Studi ini bertujuan mendorong ODR yang awalnya merupakan alat bantu teknologi dalam penyelesaian sengketa didorong untuk menjadi prosedur penyelesaian sengketa di samping manfaat dari mekanisme penyelesaian sengketa yang lebih cepat dan lebih murah dibandingkan dengan litigasi tradisional dan penyelesaian sengketa alternatif. Pendekatan eksplorasi metode campuran digunakan, menggunakan pendekatan kuantitatif (survei) dan terutama pendekatan kualitatif untuk mengumpulkan data. Hasil kajian ini menyimpulkan bahwa sistem penyelesaian melalui ODR dibutuhkan untuk memperluas akses keadilan dan perlindungan kepada masyarakat. Akhirnya, temuan ini memiliki implikasi praktis bagi pembuat kebijakan dan regulator.

Abstract

Sexual crimes against children are a serious issue that requires effective legal handling. One of the punishments implemented in Indonesia is chemical castration. This study aims to analyze the effectiveness of chemical castration as a punishment for perpetrators of child sexual abuse in Indonesia from a juridical perspective. This study aims to analyze the effectiveness of chemical castration as a punishment for perpetrators of child sexual abuse in Indonesia from a juridical perspective. The research utilizes a normative and empirical juridical approach, with data collection techniques involving document studies and secondary literature. Theories employed in this study include the Law Enforcement Theory, Criminal Justice System Theory, and Due Process Theory. Despite chemical castration being regulated under Law Number 17 of 2016 on Child Protection and Government Regulation Number 70 of 2020, its implementation faces various obstacles. The findings reveal significant legal gaps and challenges in the execution of chemical castration, including the lack of detailed regulations and procedural clarity. Recommendations are provided to improve the effectiveness of chemical castration, such as revising regulations, enhancing coordination among relevant institutions, and ensuring adequate training and certification for medical practitioners involved in the procedure.

Abstract

The integration of Artificial Intelligence (AI) into electronic contracts introduces new legal challenges, particularly regarding civil liability for losses caused by algorithmic errors or system failures. This study aims to examine the mechanisms for enforcing such liability within the Indonesian legal framework by analyzing both tort-based responsibility and contractual liability arising from electronic transactions. Using a normative juridical method supported by statutory, conceptual, and comparative approaches, this research evaluates the relevant legal provisions, liability principles, and international practices. Under Article 1365 of the Civil Code, parties controlling or benefiting from AI may be held liable if negligence leads to harm. Meanwhile, the electronic information and transactions Law and Government Regulation 71 of 2019 provide the foundation for contractual claims, including obligations related to system reliability, data integrity, and digital audits. The findings show that enforcing liability requires clear causal proof, algorithmic transparency, and the ability to assess both material and non-material losses. Comparative cases such as Deloitte Australia, DoNotPay, and OpenAI demonstrate the global relevance of due diligence, algorithm auditing, and human accountability. This study concludes that Indonesia’s existing legal framework offers adaptive mechanisms for addressing AI-related losses, while emphasizing the need to strengthen regulatory clarity and accountability standards in the digital era.
