Abstract

Technological developments, especially social media, potentially have a negative impact that pretend to social disintegration and instability. To prevent and create a healthy and conducive digital space, the Government issued the Minister of Communication and Information Regulation No.5/2020 concerning Private ESOs. This regulation gives the government authority to supervise Private ESOs and protect social media content. This research aims to examine ministerial regulation effectiveness in realizing social media equilibrium and its impact on digital democracy in Indonesia. This is a sociolegal research. The data was obtained from observation, expert interviews, and literature studies which were analyzed qualitatively. Normatively, restrictions and supervision to the right to use social media through private ESOs can be carried out to be in line with Pancasila’s Spirit. However, there are fundamental errors in ministerial regulation: (1) multiple interpretations norm; (2) unclear parameters of supervision; and (3) weak legal position of ministerial regulations in law enforcement. Sociologically, the presence of ministerial regulations is weak and ineffective because they are: (1) rejected by stakeholders; (2) easy to change; and (3) slowly responded in socialization process and community compliance. More comprehensive implementation regulation is required with, supervision through an electronic system approach to increase the role and participation of community.

Abstract

Isu kekerasan seksual terus berkembang sebagaimana perkembangan kejahatan terkait kekerasan seksual. Hal ini dilatarbelakangi oleh semakin maraknya kasus-kasus kekerasan seksual di Indonesia. Untuk menjawab permasalahan ini, maka dibentuklah UU TPKS sebagai solusi dari maraknya kekerasan seksual di Indonesia. Dalam UU TPKS tidak hanya berfokus pada korban perempuan dari tindak pidana kekerasan seksual, tetapi mencakup juga yang disebut kelompok rentan. Namun demikian, reformasi Hukum Pidana Indonesia mengenal adanya KUHP baru yang di dalamnya dimuat prinsip-prinsip penting dalam perumusan eperti rekodifikasi terbuka, prinsip Keseimbangan, dan prinsip lain yang relevan dalam penyusunan KUHP Indonesia. KUHP juga sudah mengadopsi nilai-nilai yang ada dalam konvensi-konvensi internasional termasuk CEDAW yang merupakan salah satu konvensi terpenting bagi pengaturan UU TPKS. Hal ini tentu akan menimbulkan perbedaan pendapat, apakah ketentuan hukum pidana materiil dalam UU TPKS (yang baru disahkan) perlu untuk dimasukkan dalam KUHP atau dibiarkan tetap berada di luar sebagai suatu ketentuan pidana khusus? Artikel ini akan membahas permasalahan mengenai kedudukan UU TPKS terhadap KUHP. Permasalahan akan dijawab dengan melihat proses legislasi UU TPKS termasuk landasan teoritis yang digunakan perumus UU TPKS. Selanjutnya, penulis juga akan menganalisis apakah UU TPKS merupakan suatu undang-undang khusus terutama jika dibandingkan dengan perkembangan isu-isu aktual yang ada di KUHP.

Abstract

Mining in Indonesia is a vital sector that contributes significantly to the economy. However, current regulations still reveals a number of weaknesses that impact environmental sustainability and community welfare. These include weak law enforcement, lack of transparency and public participation at all stages of mining activities, inadequate mechanisms to ensure corporate social responsibility and environmental and post-mining reclamation, provisions that are not responsive to changing social and environmental conditions, further exacerbating the situation. This research uses a normative legal research method with an analytical approach to the provisions of laws and regulations based on facts obtained from secondary sources by paying attention to the credibility of these secondary sources. The main findings of the research reveal that environmental problems arise due to misalignment between mining laws and environmental laws. Environmental laws are not positioned as a command to mitigate the environmental impact of mining, and issues are further compounded by overlapping regulations on mining reclamation. The welfare of the community remains an unfulfilled promise, as environmental economic rights are increasingly eroded by the provisions in Article 162 of Law No. 3 of 2020. The rampant illegal mining activities further harm state finances, exacerbated by the absence of sophisticated infrastructure to monitor mining areas and potential sites in real time using satellite imagery. Additionally, inadequate distribution of corporate social responsibility (CSR) funds has left mining and affected areas without proper support, highlighting the urgent need for CSR regulations in the future be regulated at the legislative level. Furthermore, regulatory efforts to adopt green technology remain insufficient, with a lack of fiscal incentives and investment protection for companies committed to sustainable practices. The situation is further worsened by the lack of transparency in the mining sector, further exacerbates the situation as there is still no clear mechanism to ensure accountability or provide the public with access to crucial mining operation data. Based on the complex mining problems from multi-sectors, the regulatory reform framework must involve authorized government institutions and involve public participation in regulatory reform and the outcomes of the rules formed can accommodate the protection of public participation and protection of public rights in mining, respond to effective law enforcement and provide great contribution to the state, society, and global collaboration.

Abstract

Introduction to the Problem: The practice of criminal law in a country should evolve technologically, as in Indonesia, where electronic surveillance of prisoners has been adopted. Indonesia has correctional facilities that are experiencing tremendous overcrowding, and this trend not only hinders the effective rehabilitation of inmates but also burdens the state coffers. Countries with well-organised biobanks have used this surveillance technology to prevent this malfunction. Purpose/Study Objectives: This research aims to analyze whether there is a possibility of introducing electronic monitoring of prisoners in Indonesia as a possible amendment to the Criminal Sanctions Implementation Act by conducting an international review of the experience of similar practices in several countries with civil law (Latvia, Iceland, France, Norway, Croatia, Kosovo), common law (England and Wales), and mixed law (Thailand) systems. Design/Methodology/Approach: This research utilises qualitative approaches, especially normative legal analysis and comparison. The data was collected by way of thorough analysis of legal documents from different jurisdictions that have varying legal traditions, such as civil law countries like Latvia, Iceland, France, Norway, Croatia, and Kosovo, common law countries of England and Wales, and Thailand, which has a mixed legal system. The comparison of these legal systems assists in constructing possible integration of electronic surveillance systems in the criminal law system in Indonesia. Findings: Research shows that electronic monitoring of prisoners in Indonesia has potential despite the lack of legislation for such tracking due to the relevance of implementation, especially for low-risk prisoners and first-time offenders. Concerns are identified, such as inadequate infrastructure, lack of comprehensive legislation and resistance from various groups. However, the promising benefits outweigh those concerns, as well as features such as a 40% reduction in prison overcrowding and improvements in recidivism rates of inmate rehabilitation.
