Abstract

Pasal 18B ayat (2) UUD NRI 1945 mengatur mengenai penghormatan dan pengakuan atas satuan-satuan masyarakat hukum adat beserta hak-hak tradisionalnya sepanjang keberadaannya masih ada. Salah satu hak masyarakat adat di masyarakat pesisir di Provinsi Lampung ialah hak rumpon sebagai hak ulayat laut. Rumpon laut secara bahasa merupakan jenis alat bantu penangkapan ikan yang dipasang di laut, baik laut dangkal maupun laut dalam. Saat ini eksistensi rumpon laut terancam keberadaannya karena untuk menjaga dan melestarikan sistem pengelolaan perikanan ini tidak didukung oleh tindakan nyata oleh Pemerintah dan masyarakat sekitar pesisir. Tulisan ini melakukan pengkajian atas hak masyarakat hukum atas hak ulayat rumpon di Provinsi Lampung dengan fokus penelitian pada eksistensi hak ulayat laut rumpon pada masyarakat Lampung dan perlindungan konstitusional atas hak ulayat rumpon laut. Metode penelitian yang digunakan yaitu metode socio-legal yang melakukan kajian terhadap aspek hukum dalam ranah das sollen dan das sein.Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia regulates the respect and recognition on customary law community units and their traditional rights as long as they still exist. One of the rights of indigenous peoples in coastal communities in Lampung Province is rumpon’s right as the ulayat right of the sea. Literaly, Rumpon laut is a type of fishing gear installed in the sea, both the shallow and the deep one. Currently the existence of rumpon laut is threatened because the maintenance is not supported by concrete actions by the Government and coastal communities. This paper conducts an assessment of the community’s right on customary rights of rumpon laut in Lampung Province. This paper focuses on the existence of the ulayat right of rumpon laut in Lampung and the constitutional protection of the ulayat right of rumpon laut. The research method used is a sociolegal method that studies the legal aspects in the realm of das sollen and das sein.

Abstract

Indonesian Citizenship Law Policy, in accordance with Article 26  Paragraph (1)of the 1945 Constitution and Act Nr. 12/2006, is closed  in  nature and does not recognize dual citizenship. Community members of the Indonesian Chinese Diaspora who hold foreign nationalities do not have the legal standing to file applications to the Constitutional Court for constitutional review of Act Nr. 12/2006 in an effort to obtain Indonesian citizenship, because they are not Indonesian citizens. In order for an individual to be able to obtain Indonesian citizenship without losing his or her foreign nationality, the principle of dual citizenship must be applied within the Indonesian  Citizenship  Law  Policy.  This can happen if a legislative review on or an amendment to the act (in this case Act Nr. 12/2006 regarding the Citizenship of the Republic of Indonesia) is conducted by Parliament. Thus the Government of the Republic of Indonesia must be absolutely sure and able to fully assure Parliament that Indonesia has   a genuine need for the Indonesian Chinese Diaspora, because they have great potentials and can play an  important  role  in  Indonesia?s development,  both  in terms of the quality of human resources that have been proven and tested abroad, as well as the capital that can be invested in Indonesia.

Abstract

Civil Servants (PNS) as state apparatus have a central presence in bringing policy components to the realization of national goals and national development. These components are accumulated in the form of distribution of duties, functions and obligations of Civil Servants (PNS). In accordance with the provisions of Article 87 paragraph (4) letter b of the ASN Law, and Article 250 letter b of Government Regulation Number 17 of 2020 concerning PNS Management, Civil Servants (PNS) are dishonorably discharged because "Sentenced to prison or imprisonment based on a court decision has permanent legal force for committing a criminal act of occupational crime or a criminal offense related to office and / or general crimes ”. The problem under study is whether "The decision of PT. TUN Jakarta Number 160/B/2020/PT.TUN.JKT which rejected Gatot Rachmanto's request for the Cirebon Regent's Decree (PLT) Number: 888/Kep/260/BKPSDM dated May 28, 2019 to be postponed while the examination of the State Administration dispute is in progress until a court decision is legally enforceable, it will not contradict the provisions of Article 67 paragraph (2) of the Administrative Court Law. This research was conducted using a normative legal research method, with a statutory approach. The data from this research were processed and analyzed using qualitative analysis techniques, and then presented in narrative form.

Abstract

Waste from the pharmaceutical industry is hazardous waste because it is not only dangerous but also poisonous. If it is not processed and managed properly, it will seriously endanger the environment of the living things around it. Therefore, strict enforcement of the law is required to administer environmental permits for these business activities. Enforcement that violations of environmental management standards can be adjudicated by virtue of Law No. 32 of 2009. The sanction includes administrative, criminal and civil sanctions. Administrative sanctions that the government can impose are government injunctions, revocation of environmental permits to do business, and suspension of those permits. Enforcing regulations in the environmental sector is one of the tasks that PPLH has to carry out, so that companies that have failed to comply with regulations on environmental management, in particular regulations on liquid waste management, are subject to sanction in accordance with applicable regulations. Based on the description above, this study will discuss the enforcement of administrative law against pharmaceutical waste, namely paracetamol in Angke Bay and Ancol Beach waters which are currently being discussed. This research is structured normatively based on secondary data and obtained to be analyzed by qualitative methods and described descriptively.

Abstract

The right to get the opportunity to work is not an easy thing for persons with disabilities to obtain. Because, there is discrimination that can be seen in some of the requirements or criteria for the workforce needed. One-eyed view of people with disabilities because it is assumed that the work they do will not be as maximal as if it were done by normal workers. This is certainly interesting to study how legal protection is in fulfilling the right to work for persons with disabilities. This research uses a normative method by collecting secondary data consisting of primary legal materials, namely examining a statutory regulation related to research such as the Constitution of the Republic of Indonesia, Law Number 13 of 2003 concerning Manpower, and Law Number 8 of 2016 concerning Persons with Disabilities, then secondary legal materials, namely using books, journals, and the internet, as well as tertiary legal materials, namely using dictionaries. This research is based on written rules relating to legal protection in terms of fulfilling the right to work for persons with disabilities. The results of this study, that persons with disabilities get legal protection in obtaining jobs listed in several articles, namely Article 67 paragraph (1) of the Labor Law and Article 14 of Law Number 4 of 1997 concerning Persons with Disabilities. Then, with this research it is hoped that it can become material for the government's evaluation so that the government can pay more attention to the rights of persons with disabilities, especially in terms of getting employment opportunities.

Abstract

This study aims to find out how the law protects workers affected by layoffs unilaterally. Termination of employment (PHK) unilaterally should not be carried out because only one party benefits and the other party feels disadvantaged. Therefore, there are problems that result in the end of the rights and obligations of workers and employers regulated in Law Number 13 of 2003 concerning Manpower. It doesn't work, sometimes there are disputes. This usually happens because there is no common understanding between workers/employees and employers. Termination of employment can be resolved bilaterally, conciliation, arbitration and industry-related courts.Basically Termination of Employment (PHK) unilaterally is a decision made by a company without going through a legal process or the establishment of an Industrial Relations Dispute Settlement Institution. There is also disagreement about the legal basis for Termination of Employment (PHK) in which a company can terminate unilaterally for 2 (two) reasons, namely, the first is due to dismissal for the same reason in the worker/employee and the second is dismissal for the same reason in company. Abstract

Technological developments, especially social media, potentially have a negative impact that pretend to social disintegration and instability. To prevent and create a healthy and conducive digital space, the Government issued the Minister of Communication and Information Regulation No.5/2020 concerning Private ESOs. This regulation gives the government authority to supervise Private ESOs and protect social media content. This research aims to examine ministerial regulation effectiveness in realizing social media equilibrium and its impact on digital democracy in Indonesia. This is a sociolegal research. The data was obtained from observation, expert interviews, and literature studies which were analyzed qualitatively. Normatively, restrictions and supervision to the right to use social media through private ESOs can be carried out to be in line with Pancasila’s Spirit. However, there are fundamental errors in ministerial regulation: (1) multiple interpretations norm; (2) unclear parameters of supervision; and (3) weak legal position of ministerial regulations in law enforcement. Sociologically, the presence of ministerial regulations is weak and ineffective because they are: (1) rejected by stakeholders; (2) easy to change; and (3) slowly responded in socialization process and community compliance. More comprehensive implementation regulation is required with, supervision through an electronic system approach to increase the role and participation of community.

Abstract

The significance of this research stems from the prevalence of religious freedom violations in Indonesia, indicative of the inadequate level of respect, protection, and fulfillment of this entitlement within the framework of the Pancasila legal system. This study aims to ascertain how to effectively uphold, safeguard, and fulfill the right to freedom of religion within the Pancasila Rule of Law. Utilizing normative juridical research methods, the findings reveal a discrepancy within the legal norms governing religious rights in the Constitution. While Article 28I, paragraph (1) of the 1945 Constitution unequivocally affirms the inviolability of the right to religion under any circumstances, Article 28J, paragraph (2) of the same Constitution delineates that this right is subject to limitations regulated by law. The research concludes that, despite its normative recognition as an inherent entitlement, numerous violations of religious freedom persist in Indonesia in practical application.

Abstract

The purpose of this study is to analyze and find out the application of the parliamentary threshold in Law No. 7 of 2017 and Constitutional Court Decision Number 116/PUU-XIX/2023 and evaluate whether its application meets the principles of justice. This is motivated by the application of the parliamentary threshold regulated in Law No. 7 of 2027 on General Elections and reaffirmed through Constitutional Court Decision Number 116/PUU-XIX/2023 which is considered not fulfilling the principle of justice and violating the 1945 Constitution. The urgency of this research is to provide legal clarity regarding the parliamentary threshold, which is intended to maintain the quality of representation in parliament, but in practice creates problems of injustice for parties that are unable to meet the threshold. The novelty in this author's research is to show that the application of the parliamentary threshold can reduce the diversity of political choices and affect the fairness of representation. The research method used in this study is the normative method. The results show that the application of the parliamentary threshold in Law No. 7/2017 and Constitutional Court Decision Number 116/PUU-XIX/2023 reflects the Court's efforts to consider the principle of justice. Stating that the threshold is still needed, but it must be reviewed to ensure more proportional and democratic representation. This is in line with the concept of justice according to philosophers who view that the review of the threshold also aims to provide opportunities for underrepresented parties, support the principle of justice as fairness, and achieve justice that allows future parliamentary thresholds to be determined based on popular sovereignty. Tujuan pada penelitian ini adalah untuk menganalisis dan mengetahui penerapan parliamentary threshold dalam UU No. 7 Tahun 2017 dan Putusan MK Nomor 116/PUU-XIX/2023 serta mengevaluasi apakah penerapannya memenuhi asas keadilan. Hal ini dilatarbelakangi oleh penerapan ambang batas parlemen yang diatur dalam UU No. 7 Tahun 2027 tentang Pemilihan Umum dan ditegaskan kembali melalui Putusan MK Nomor 116/PUU-XIX/2023 yang dianggap tidak memenuhi asas keadilan dan melanggar Undang-Undang Dasar Tahun 1945. Urgensi penelitian ini ialah memberikan kejelasan secara hukum mengenai parliamentary threshold yang dimaksudkan untuk menjaga kualitas representasi di parlemen dalam praktiknya justru menciptakan permasalahan ketidakadilan bagi partai-partai yang tidak mampu memenuhi ambang batas tersebut. Kebaruan dalam penelitian penulis ini adalah menunjukkan bahwa penerapan parliamentary threshold dapat mereduksi keberagaman pilihan politik dan memengaruhi keadilan representasi. Metode penelitian yang digunakan dalam penelitian ini adalah metode normatif. Hasil penelitian menunjukkan bahwa penerapan parliamentary threshold dalam UU No. 7 Tahun 2017 dan Putusan MK Nomor 116/PUU-XIX/2023 mencerminkan upaya MK mempertimbangkan asas keadilan. Menyatakan ambang batas tetap diperlukan, tetapi harus ditinjau untuk memastikan representasi yang lebih proporsional dan demokratis. Hal tersebut sejalan dengan konsep keadilan menurut filsuf-filsuf yang memandang peninjauan ambang batas juga bertujuan memberi kesempatan bagi pihak yang kurang terwakili, mendukung prinsip justice as fairness serta mencapai keadilan yang memungkinkan parliamentary threshold masa depan ditetapkan berdasarkan kedaulatan rakyat.

Abstract

Modernity, as a transformation from pre-modern to modern humanity, coincides with the spread of Western values through globalization, such as individualism, secularism, and materialism, which shape modern human character. This has led to new problems: traditional values have been replaced, and modern humans experience psychological issues due to a loss of meaningful freedom and societal control. This phenomenon also influences the behavior of the "strawberry generation," which is seen as fragile. Therefore, the relevance of Pancasila in the modern era must be reformulated to be accepted by the modern generation. The Community Service Team aims to strengthen Pancasila values among students at SMA Negeri 16 Jakarta. This initiative addresses the limited introduction of Pancasila in schools and the gap in understanding among young people, which is often accompanied by deviations from Pancasila values in society. Socialization is carried out through lectures and discussions, with the theme "Strawberry Generation: Strengthening Pancasila Character in the Era of Modernity." The activity was attended by 67 students. The implementation of Pancasila in modern society faces challenges, including weak institutionalization, destructive behavior, and the rise of primordialism. To revitalize Pancasila for the strawberry generation, the involvement of families, schools, religious institutions, and educational bodies is necessary, incorporating it into religious teachings, school curricula, cultural activities, and digital content. This PKM activity helped students understand modernity and the relevance of Pancasila to build resilience in facing its negative aspects ABSTRAK Modernitas sebagai suatu fase transformasi manusia pra modern menuju modern tumbuh bersamaan dengan penguatan nilai-nilai barat melalui proses globalisasi, seperti individualisme, sekularisme, dan materialisme yang membentuk karakter manusia modern. Sebagai konsekuensinya, masalah-masalah baru muncul yaitu dari aspek kultural telah menghapuskan atau menghancurkan tata nilai tradisional dan secara psikologis menimbulkan gangguan kejiwaan manusia modern karena kehilangan kebebasan yang bermakna dan masyarakat kontrol. Fenomena tersebut turut membentuk perilaku generasi strawberry yang dinilai rapuh. Atas dasar tersebut, relevansi Pancasila di era modernitas harus dirumuskan agar dapat diterima bagi generasi modern. Tim Pengabdian Masyarakat bermaksud untuk memperkuat pemahaman nilai-nilai Pancasila di kalangan pelajar SMA Negeri 16 Jakarta. Langkah ini dilatarbelakangi terbatasnya pengenalan Pancasila di sekolah serta kesenjangan pemahaman generasi muda yang masih sering diiringi penyimpangan nilai-nilai Pancasila di masyarakat. Sosialisasi dilakukan melalui metode ceramah dan diskusi. Materi diisi oleh narasumber dengan tema ‘Generasi Strawberry: Penguatan Karakter Pancasila di Era Modernitas’. Kegiatan diikuti oleh 67 pelajar. Implementasi Pancasila diera modernitas mengalami kemandegan karena lemahnya institusionalisasi Pancasila, perilaku destruktif, hingga praktik primordialisme di masyarakat. Revitalisasi Pancasila bagi generasi strawberry memerlukan keterlibatan keluarga, sekolah, institusi sosial-keagamaan, institusi pergerakan, dan institusi pendidikan dan pelatihan melalui penyisipan dalam ajaran agama, kurikulum dan kegiatan sekolah, kegiatan budaya dan kebangsaan, serta konten di dunia digital. Melalui kegiatan PKM ini, pelajar di SMA Negeri 16 Jakarta memiliki pemahaman mengenai makna modernitas dan relevansi Pancasila bagi dirinya untuk membentuk ketahanan diri menghadapi sisi buruk modernitas dan modernisasi.
