Abstract

Narcotics abuse recently has always increased, not only among adults but also among adolescents and children. The cause of this abuse consists of two factors, namely factor internal and external. Therefore, cases of drug abuse are increasing every year. This study was conducted with the aim to find out the form of law enforcement against narcotics abusers in the process of investigating narcotics crimes. The research method used in this study was normative juridical approach which is supported by empirical juridical by detailing the description and collecting primary data through interviews. The results of this study show that there are two forms of law enforcement against narcotics abusers, namely repressive law enforcement and rehabilitative law enforcement as regulated in Law Number 35 of 2009 concerning narcotics. Based on the interviews conducted, it is known that there are several obstacles in law enforcement on narcotics cases at the Kolaka National Narcotics Agency, namely the lack of personnel, the unresponsive community in providing information to investigators as the key to successful law enforcement and decreasing of operational costs in supporting facilities and infrastructure

Abstract

This research aims to investigate the evaluation of faculty performance by utilizing a combined approach of the Analytic Hierarchy Process (AHP) and the Borda Method. The primary objective of this study is to develop a more structured, objective, and inclusive evaluation framework for assessing faculty performance. The AHP method is employed to address the complexity of determining the weights of evaluation criteria and sub-criteria, while the Borda Method provides a platform for various stakeholders to express their assessments in a participatory manner. This study is conducted using a qualitative research approach. Data is collected through surveys administered to students, colleagues, and administrators to provide evaluations of faculty performance based on predetermined criteria. The research results indicate that the combined approach of AHP and Borda is capable of offering a more accurate and holistic depiction of faculty performance. The AHP method assists in reducing subjectivity in weight determination, while the Borda Method facilitates the inclusion of opinions from various stakeholders.

Abstract

Pertambangan di Indonesia dari berbagai riset telah menunjukan dampak positif diantaranya adalah sebagai lokomotif perekonomian yang secara langsung berkontribusi langsung pada peningkatan PDB, selain itu pada aspek ekonomi sektor riil berkontribusi terhadap peningkatan serapan tenaga kerja, peningkatan pendapatan, mempunyai multi efek player dengan meningkatkan usaha mikro masyarakat, namun disatu sisi riset yang lain menunjukan  dampak negatif terutama dampak lingkungan, konflik agraria, alih fungsi lahan dari pertanian menjadi kawasan eksploitasi pertambangan menyebabkan defisit  persediaan pangan. Khusus untuk permasalahan mitra pada pengabdian masyarakat ini karena terdapat protes warga soal kerusakan lingkungan, konflik horizontal antara masyarakat dan perusahaan, aktifitas ilegal memuat nikel tanpa memiliki syarat admininstrasi yang lengkap, untuk  itu kami melakukan pengabdian kepada masyarakat kiranya dengan informasi yang kami transformasikan masalah dapat diselesaikan oleh stake holders yang didaerah Lokasi mitra. Metode yang kami lakukan ialah metode pra pelaksanaan dan pelaksanaan; pra pelaksanaan dengan  memperhatikan base line visi misi fakultas hingga menentukan topik yang sesuai, kemudian melaksanakan observasi berita dan konfirmasi lapangan untuk memastikan urgensi kebutuhan mitra yang sesuai dengan topik, mengiventaris bahan materi lalu merumuskannnya hingga sistematis dan tersaji dengan baik, kemudian pelaksanaan  dilakukan dengan metode  service learning. Hasil dan pembahasan kami mengemukakan sumber hukum dan ketentuan inti pertambangan di Indonesia, tata kelola dan manejem lingkungan, penanganan konflik agraria, norma yang dapat diterapkan apabila perusahan badan hukum atau perorangan memuat nikel keatas kapal yang belum lengkap syarat admininstrasinya, layanan pengaduan masyarakat yang dapat diakomodir pemeritah daerah sesuai dengan norma undang-undang saat ini.

Abstract

This study aims to analyze the correlation between physical literacy, physical activity, and physical fitness among students of SMA 1 Kolaka. Using a cross-sectional research design, this study involved 200 randomly selected students. Data were collected through physical literacy questionnaires, physical activity records, and physical fitness tests. Data analysis employed Pearson correlation tests and multiple linear regression. Results showed significant positive correlations between physical literacy and physical activity (r = 0.68, p < 0.001) and physical fitness (r = 0.72, p < 0.001). Physical activity also positively correlated with physical fitness (r = 0.75, p < 0.001). Regression analysis revealed that physical literacy and physical activity together explained 65% of the variation in students' physical fitness. These findings emphasize the importance of enhancing physical literacy and promoting physical activity to improve high school students' physical fitness.

Abstract

Corporate branding through Corporate Social Responsibility (CSR) programs has become a key strategy for many mining companies in Indonesia. CSR is supposed to be a tangible manifestation of a company’s contribution to social and environmental development around its area of operation. However, in practice, CSR is often just an image tool to improve the company’s reputation without having a significant positive impact on society. This article examines the phenomenon of CSR in the Indonesian mining sector, which is often involved in scandals and manipulative practices. The research highlights various cases where mining companies fail to fulfill their social responsibilities, manipulate CSR reports, and exploit local communities. Through a qualitative analysis approach, this article reveals that CSR programs in the mining sector are more often used as a means to improve public image than to make a real contribution to sustainable development. The conclusion of this study shows the need for supervisory reforms and clear rules related to criminal sanctions for misuse of CSR funds so that CSR implementation does not only become a means of imaging, but actually has a positive sustainable impact.

Abstract

This research is motivated by the many forms of criminal acts at each stage of the General Election, one of which can occur at the stages of registration, verification and determination of political parties as potential election participants, as well as different law enforcement mechanisms for election crimes and other criminal acts. It is important to carry out this research with the aim of finding out criminal acts that arise during the stages of registration, verification and determination of political parties as candidate participants in the election and to find out the law enforcement process for criminal acts that occur. The method used in this research is empirical normative which was carried out with literature studies and field studies carried out by the Kolaka Regency Integrated Law Enforcement Center. The results of the research show that the criminal aspects at the stages of Registration, Verification and Determination of Candidates for Election Contestants include criminal acts regulated in the provisions of Article 518 of Law Number 7 of 2017 concerning General Elections (not following up on the findings of Bawaslu, Provincial Bawaslu and/or Regency Bawaslu/ City in carrying out verification of political parties as candidates for Election Contestation), Article 263 of the Criminal Code (Forgery of Documents) and Article 67 of Law Number 27 of 2022 concerning Protection of Personal Data (UU PDP) as well as law enforcement for election crimes is different from criminal acts in general, which using the concept of speedy trial. The things that differentiate include the mechanism for investigation, prosecution and trial which is carried out quickly, can be carried out without the presence of the defendant (in absentia), and legal action can only be taken at the appeal level. In the implementation of handling election crimes at the Kolaka Regency Gakkumdu Center, starting from the Report/Findings Stage, Initial Study, First Discussion, Clarification, Study of suspected violations, Second Discussion, Plenary Meeting, Investigation, Third Discussion, and Prosecution.

Abstract

Mining in Indonesia is a vital sector that contributes significantly to the economy. However, current regulations still reveals a number of weaknesses that impact environmental sustainability and community welfare. These include weak law enforcement, lack of transparency and public participation at all stages of mining activities, inadequate mechanisms to ensure corporate social responsibility and environmental and post-mining reclamation, provisions that are not responsive to changing social and environmental conditions, further exacerbating the situation. This research uses a normative legal research method with an analytical approach to the provisions of laws and regulations based on facts obtained from secondary sources by paying attention to the credibility of these secondary sources. The main findings of the research reveal that environmental problems arise due to misalignment between mining laws and environmental laws. Environmental laws are not positioned as a command to mitigate the environmental impact of mining, and issues are further compounded by overlapping regulations on mining reclamation. The welfare of the community remains an unfulfilled promise, as environmental economic rights are increasingly eroded by the provisions in Article 162 of Law No. 3 of 2020. The rampant illegal mining activities further harm state finances, exacerbated by the absence of sophisticated infrastructure to monitor mining areas and potential sites in real time using satellite imagery. Additionally, inadequate distribution of corporate social responsibility (CSR) funds has left mining and affected areas without proper support, highlighting the urgent need for CSR regulations in the future be regulated at the legislative level. Furthermore, regulatory efforts to adopt green technology remain insufficient, with a lack of fiscal incentives and investment protection for companies committed to sustainable practices. The situation is further worsened by the lack of transparency in the mining sector, further exacerbates the situation as there is still no clear mechanism to ensure accountability or provide the public with access to crucial mining operation data. Based on the complex mining problems from multi-sectors, the regulatory reform framework must involve authorized government institutions and involve public participation in regulatory reform and the outcomes of the rules formed can accommodate the protection of public participation and protection of public rights in mining, respond to effective law enforcement and provide great contribution to the state, society, and global collaboration.
