Abstract

Modal usaha koperasi terdiri dari modal sendiri dan modal pinjaman. Modal sendiri, utamanya berasal dari iuran para anggota koperasi itu sendiri. Modal pinjaman, antara lain berasal dari pinjaman kepada anggota koperasi itu sendiri pula. Sebagaimana pinjaman pada umumnya, modal usaha koperasi yang berasal dari pinjaman kepada anggotanya, berpotensi terjadi penundaan bahkan gagal pengembalian. Penundaan dan/atau kegagalan pengembalian tersebut dapat menimbulkan perselisihan. Penyelesaian perselisihan, dapat dengan dilakukan dengan menempuh upaya hukum Penundaan Kewajiban Pembayaran Utang Koperasi. Rumusan masalah yang diangkat dalam penelitian ini adalah hak dan kedudukan hukum anggota koperasi yang mengajukan upaya hukum Penundaan Kewajiban Pembayaran Utang terhadap koperasi. Metode penelitian yang diterapkan adalah penelitian yuridis-normatif. Simpulan yang diperoleh adalah terkait modal pinjaman koperasi yang berasal dari anggotanya maka upaya hukum Penundaan Pembayaran Kewajiban Utang dapat diajukan oleh anggota koperasi yang bersangkutan. Pengajuan upaya hukum Penundaan Pembayaran Kewajiban Utang oleh anggota koperasi, menempatkan yang bersangkutan sebagai kreditur konkuren.

Abstract

Kemitraan antara Usaha Mikro, Kecil dan Menengah (UMKM) dan Usaha Besar diyakini menjadi upaya signifikan untuk meningkatkan pertumbuhan UMKM dalam ekonomi nasional. Dalam dinamika hubungan yang asimetris dari segi skala ekonomi serta posisi tawar antara UMKM dan Usaha Besar dimungkinkan Usaha Besar melakukan pemilikan dan/atau penguasaan terhadap mitra UMKM. Pemilikan tentunya sudah jelas tercermin dari adanya kepemilikan berupa porsi saham hingga aset. Penguasaan sendiri belum memiliki definisi yang jelas. Penguasaan memungkinkan Usaha Besar untuk bertindak sesuai kepentingan subjektifnya dan tidak mengindahkan kepentingan UMKM seperti menetapkan klausula perjanjian kemitraan yang merugikan. Hal tersebut sejatinya dilarang dalam berbagai peraturan perundang-undangan tentang UMKM sebagai bentuk perlindungan terhadap UMKM sendiri. Salah satu diskursus yang bisa dikemukakan adalah mengatur larangan penguasaan tersebut dalam bentuk larangan penyalahgunaan posisi tawar dominan lewat rezim hukum persaingan usaha sebagaimana dilakukan oleh berbagai yurisdiksi.

Abstract

The latest version of the draft bill regarding Law on the Prohibition of Monopolistic Practices and Unfair Business Competition has added new arrangements about the abuse of a superior bargaining position. The new law proposal which is intended to amend existing Indonesian competition law (Law Number 5 Year 1999) stipulates that any business actor is prohibited from abuse its superior bargaining position within a partnership agreement with other less dominant entities. Under Law Number 20 Year 2008 on Micro, Small and Medium Enterprises, a partnership agreement means any agreement made between micro, small and medium enterprises and large enterprises like state or privately owned national businesses, joint ventures and foreign businesses that conduct economic activities in Indonesia. Such a condition makes many antitrust experts or economists question the relevancy of regulating abuse of superior bargaining position under competition law. However, several jurisdictions –Japan, Korea, Taiwan, France, and Germany- have regulated the abuse of superior bargaining position under their national competition laws.

Abstract

Forest and land fires, especially on peatlands that often occur in Indonesia, have a huge negative impact both for the environment and for the community. The enforcement of civil law to obtain compensation for damages to the environment and the community must be obtained. The basic use of civil liability through absolute responsibility can be made for activities or businesses within a peat ecosystem or have an impact on the peat ecosystem. In practice, however, it is not necessarily that the polluter can fulfill their compensation fully because there are insolvency problems. Environmental insurance can overcome these problems with the risk transfer mechanism. The issuance of PP no. 46 of 2017 on Economic Instruments provides a way for the implementation of environmental insurance in Indonesia. This research is conducted through a normative juridical method by looking at legal materials that have binding legal force such as legislation.

Abstract

In life, one is always faced with uncertain risks. In the case of the COVID-19 pandemic, a person traveling abroad for business or tourism purposes has the risk of being infected with COVID-19. One of the efforts that one can make to minimize the risk of being infected with the COVID-19 is to transfer the risk to the Insurer by registering with an Insurance Company to get a Travel Insurance. The COVID-19 International Travel Insurance provides a guarantee of protection to someone traveling internationally from the risk of being infected with the COVID-19 so that the trip becomes comfortable, safe, and without worry. The issues to be discussed in this study include the form of liability of the Insurer to the Insured who is infected with COVID-19 and the process of claiming the COVID-19 International Travel Insurance. The purpose of conducting this research is to find out how the accountability of the Insurer to the Insured who is infected with COVID-19 is executed, and how the process for claiming COVID-19 International Travel Insurance is conducted. The analytical method used in this thesis is qualitative analysis which aims to determine the importance of clause specifications on Travel Insurance Policies, as well as the importance of writing the Insurance Policies using words, phrases, and sentences that are clear and easily understood by the prospective Insured so that there are no differences in interpretation. The results of the research conducted by the author produce conclusions in the form of as follows: 1. The coverage benefits that will be provided by the Insurer to the Insured who is infected with COVID-19 will be provided in accordance with what is stated in the COVID-19 International Travel Insurance Policy clause. However, in the Insurance Policy, there is no clause that clearly and in detail explains the limits of coverage that will be borne by the Insurer; 2. The insured who tests positive for COVID-19 while traveling abroad can submit the COVID-19 International Travel Insurance claim to the Insurer. The stages of filing a claim consist of reporting to the Insurance Company while still in the territory of the insured country, filling out a claim form, and preparing claim documents and supporting documents.
