Abstract

Generally, Islam permits a wife to stipulate any conditions in a marriage contract. The Muslim jurists however differed in determining the validity of certain conditions and terms upon which their marriage is to take place. One of the controversial conditions is that the wife includes a condition pertaining to polygamy in the marriage contract. It is interesting to note that the practice of inserting stipulations pertaining to polygamy is not a new practice or unusual among many Muslims in the Middle East. Therefore, this article seeks to discuss the possibilities to adopt the Hanbalite’s principles on this matter in muslim countries where the Shafi’ite school of thought is predominantly followed. This article argued that by allowing the wife to insert stipulations pertaining to polygamy in a marriage contract does not go against Islam. This is because stipulations in the marriage contract are often aimed at preventing such eventuality and also protecting the position of women should it come to prevent.

Abstract

This paper is prepared based on the research on 18 couples of husbands and wives from a faculty at a state Islamic university in Yogyakarta. The research found that good communication between husbands and wives in household life could build family resilience and prevent divorce. This study used normative-sociology approach combined with the maṣlaḥah mursalah and convergence theories, which was further combined with the Ibnu Miskawaih and K. Hajar Dewantoro’s theories. The data was collected by distributing questionnaires to 18 couples of husbands and wives. The study found that a good communication between wives and husbands could be built through verbal and non-verbal communications. These verbal and non-verbal communications had the same strength in building a good communication, depending on the situations. There were times when it was more appropriate to use verbal communication, while there were also times when non-verbal communication was the right choice. It could, therefore, be said that communication played a crucial role in building family resilience. Thus, analyzed using the maṣlaḥah mursalah theory, it was not an exaggeration to state that building communication is a necessity for husbands and wives. It is not even exaggerating to say that building a good communication is an obligation that husbands and wives cannot ignore.

Abstract

Since Religious Court Law was amended by Law No. 3 of 2006, every sharia economic case is stipulated as the competency of the Religious Court. Conversely, Bankruptcy Law No. 37 of 2004 has never been synchronized with the amended Religious Courts Law. Therefore, the competent court does not handle sharia economic bankruptcy (al-taflis) cases. This study aims to ensure that al-taflis can be examined based on sharia economic principles by the most appropriate judicial forum. It is normative legal research using primary and secondary legal materials such as court decisions, statutory, books, journals, reports, and internet sources, then analyzing and synchronizing to get an ideal formula regarding how al-taflis cases are settled in court. The result shows that al-taflis is appropriately stipulated as the absolute competence of Religious Courts. Case studies of al-taflis court decisions settled by the Commercial Court so far, also indicate that sharia principles are not sufficiently considered in the decisions, even ignored. Therefore, it is urgent to make synchronization efforts by amending the Bankruptcy Law until it can accommodate the settlement of al-taflis case through Religious Courts. Otherwise, it will be only a utopian sharia economic bankruptcy law

Abstract

Abstract

Violence against women occurs not only within households but also in pre-marital relationships, as exemplified by the ngemblok tradition practiced by the Muslim community in Rembang, Central Java. This tradition involves a marriage proposal process where the woman’s family presents goods (seserahan) to the prospective groom to symbolise the binding of their pre-marital relationship. This article aims to analyse the ngemblok tradition, examining the reasons and experiences of those involved, particularly women, and assessing the tradition from the perspectives of state law and human rights. Through in-depth interviews with 16 key informants, including participants in the tradition, the study found that ngemblok facilitates acquaintance between the bride and groom and their families through a matchmaker appointed by the woman’s family. The patriarchal culture grants the woman’s parents, especially the father, unilateral authority in selecting a partner for their daughter, often leading to sexual and psychological violence. Women frequently feel compelled to comply with their parents’ wishes to avoid social stigma and sanctions and to uphold ancestral traditions. This article argues that patriarchal cultural mechanisms render women powerless in ending pre-marital relationships, undermining gender equality and human rights, and perpetuating violence against women.
