Abstract

This research was motivated by the emergence of electronic contracts, while every contract contains provisions and implementation of khiyar al-majlis, namely the right of the parties to the transaction to choose to continue or cancel a business transaction as long as the parties are still present at the transaction location. Due to the unclear existence and mechanism for implementing khiyar al-majlis in electronic contracts, this research was urgent. The aim of this research was to determine the existence and mechanism for implementing khiyar al-majlis in electronic contracts. The research method used was normative legal research with a systematic legal approach. Researchers use secondary data or legal materials obtained and processed using selective categorization. All of this legal material was grouped based on criteria that were appropriate to the problems and themes, then analyzed descriptively and analytically. The law of khiyar al-majlis was described and analyzed with explanation, study, systematization, interpretation, and evaluation. The results of this research showed that the existence of khiyar al-majlis in electronic contracts was only legal because the parties were not in the same transaction location as in conventional contracts. Then, the mechanism for implementing khiyar al-majlis could occur directly or indirectly in electronic contracts. This study contributes to the development and actualization of Islamic economic law in the digital era.

Abstract

This study aims to examine the reform of Islamic criminal law in addressing corruption cases through the lens of Maqasid al-Shariah (objectives of Islamic law). The urgency of this research lies in the systemic and pervasive nature of corruption, which undermines governance, public trust, and societal welfare, necessitating a legal framework that not only punishes but also prevents corruption in line with Islamic principles. Employing a normative juridical approach, this research analyzes primary and secondary legal materials related to corruption and Islamic law. The findings reveal that Maqasid al-Shariah provides a holistic framework that emphasizes prevention, rehabilitation, and justice, offering a balanced approach to corruption eradication. The novelty of this study lies in integrating Maqasid al-Shariah into Indonesia’s legal system to address corruption's root causes while promoting societal welfare and justice. Reforming Islamic criminal law based on Maqasid al-Shariah can strengthen anti-corruption efforts by focusing on justice, prevention, and societal welfare. This approach contributes to a more holistic and adaptive legal framework, supporting the eradication of corruption in Indonesia.

Abstract

Purpose: This study aims to analyze the urgency of recovering state financial losses caused by corruption, as regulated in the relevant anti-corruption laws, and to explore the potential for incorporating restorative justice into the Indonesian anti-corruption legal framework. Research methodology: The study employs a normative legal research method, using statutory and case approaches. It analyzes relevant laws, judicial decisions, and international conventions such as UNCAC, to evaluate mechanisms for recovering state losses and propose policy improvements.. Results: The study finds that the return of state financial losses does not eliminate criminal liability for corruption offenders under Indonesian law. However, such restitution may serve as a mitigating factor in sentencing. It also identifies weaknesses in the civil recovery process and emphasizes the inefficiency of current mechanisms. The research supports the inclusion of restorative justice to enhance efficiency and effectiveness in asset recovery. Conclusions: The existing legal framework prioritizes retributive justice, which often delays the recovery of losses. A paradigm shift toward restorative justice, especially in corporate corruption cases, can support state financial recovery without necessarily eliminating criminal sanctions. Limitations: This study focuses solely on corruption cases involving state financial losses and does not fully address systemic reform needs. The civil law procedures discussed remain constrained by conventional legal frameworks. Contribution: This research contributes to legal scholarship by proposing a reformulation of corruption law enforcement through restorative justice principles. It informs policy makers and legal practitioners on the potential integration of non-punitive measures in corruption cases and supports the development of a comprehensive legal system for recovering state assets in line with international norms.

Abstract

Fiqih is a set of rules or laws for every Moslem mukallaf, explored and formulated and determined from detailed arguments. Fiqih has dynamic, elastic characteristics, and is suitable for every place and time until the end of time. So that fiqih can be reformulated or formulated and redefined appropriately in accordance with the times, due to changes and new problems that arise in the lives of Moslems. Among the modern reformist figures of Islam, Fazlur Rahman, offers this method of fiqih reformulation, with a number of methods of ijtihad. Abstract

The phenomenon of childfree, a couple's conscious decision to live a married life without having children, has sparked an in-depth discourse in the study of Islamic law and religious sociology in Indonesia. This polemic is increasingly prominent as open statements from well-known public figures such as Gita Savitri and Cinta Laura, which strengthen the conversation about the legitimacy and implications of this practice in the context of sharia and contemporary social dynamics. This study aims to analyze the views of the Indonesian Ulema Council (MUI) of Muara Jambi Regency on the childfree phenomenon, focusing on the factors behind it and its legal status in the perspective of Islamic law. Adopting a juridical-sociological approach with a descriptive-analytical paradigm, this research utilizes semi-structured interviews with the leadership of MUI Muara Jambi, documentation studies, and non-participant observation. The research findings identify four main factors that encourage childfree practices: psychological unpreparedness to become parents, economic concerns, socio-psychological environmental conditions, and physical health considerations.In the perspective of Islamic law, MUI Muara Jambi categorizes childfree as haram if it is only based on economic concerns, but permissible if it is supported by valid shar'i reasons, such as health risks, provided that it meets the conditions such as mutual agreement between couples and alignment with maqashid sharia. This study contributes to the development of contemporary Islamic legal discourse by offering a moderate perspective that integrates sharia principles with modern social dynamics. [Fenomena childfree, yakni keputusan sadar pasangan suami-istri untuk menjalani kehidupan perkawinan tanpa memiliki keturunan, telah memantik diskursus mendalam dalam kajian hukum Islam dan sosiologi keagamaan di Indonesia. Polemik ini kian mengemuka seiring pernyataan terbuka dari tokoh publik ternama seperti Gita Savitri dan Cinta Laura, yang memperkuat perbincangan mengenai legitimasi dan implikasi praktik tersebut dalam konteks syariah dan dinamika sosial kontemporer. Penelitian ini bertujuan untuk menganalisis pandangan Majelis Ulama Indonesia (MUI) Kabupaten Muara Jambi terhadap fenomena childfree, dengan fokus pada faktor-faktor yang melatarbelakanginya serta status hukumnya dalam perspektif hukum Islam. Mengadopsi pendekatan yuridis-sosiologis berparadigma deskriptif-analitis, penelitian ini memanfaatkan wawancara semi-terstruktur dengan pimpinan MUI Muara Jambi, studi dokumentasi, dan observasi non-partisipan. Temuan penelitian mengidentifikasi empat faktor utama yang mendorong praktik childfree: ketidaksiapan psikologis untuk menjadi orang tua, kekhawatiran ekonomi, kondisi lingkungan sosial-psikologis, dan pertimbangan kesehatan fisik. Dalam perspektif hukum Islam, MUI Muara Jambi mengkategorikan childfree sebagai haram apabila hanya didasarkan pada kekhawatiran ekonomi, namun mubah jika didukung oleh alasan syar’i yang sah, seperti risiko kesehatan, dengan syarat memenuhi ketentuan seperti kesepakatan mutual antar pasangan dan keselarasan dengan maqashid syariah. Abstract

This article discusses the banking system, both conventional and Islamic. Conventional adopts the bank interest system, while Islamic adopts the profit-sharing system. The main findings from the literature indicate that Islamic banks, through the profit-sharing system, offer a more equitable distribution of wealth and are considered to have a better risk-sharing mechanism, especially during periods of financial instability. However, the profit-sharing system often faces challenges related to transparency and monitoring, which can potentially affect operational efficiency. In contrast, conventional banks, although benefiting from a simpler interest-based structure, may expose their customers to interest rate volatility and lack the social justice dimension emphasized in Islamic finance.  [Artikel ini membahas mengenai sistem perbankan, baik bersifat konvensional maupun syariah. Konvesional menganut sistem bunga bank, sedangkan syariah menganut system bagi hasil. Temuan utama dari literatur menunjukkan bahwa bank syariah, melalui sistem bagi hasil, menawarkan distribusi kekayaan yang lebih adil dan dianggap memiliki mekanisme pembagian risiko yang lebih baik, terutama selama periode ketidakstabilan keuangan. Namun, sistem bagi hasil seringkali menghadapi tantangan terkait transparansi dan pemantauan, yang berpotensi mempengaruhi efisiensi operasional. Sebaliknya, bank konvensional, meskipun mendapatkan keuntungan dari struktur berbasis bunga yang lebih sederhana, dapat membuat nasabahnya terkena volatilitas suku bunga dan tidak memiliki dimensi keadilan sosial yang ditekankan dalam keuangan Islam].

Abstract

Purpose: State civil servants have the right to vote in elections, but they are required to be neutral and professional in carrying out their duties and repetition, namely implementing public policies and providing public services to the community without being involved in practical political processes on the election agenda. Research/methodology: : The method used was a normative legal research method. This research method is carried out in several ways, namely, conducting studies, describing, interpreting, systematizing, and assessing and analyzing positive law. Results: The results of this research are regulations regarding the neutrality of the State Civil Apparatus as regulated by Law Number 7 of 2017 concerning General Elections, PP No. 42/2004 concerning the Development of Corps Spirit and the Code of Ethics for Civil Servants, PP No. 42/2004 concerning the Development of Corps Spirit and the Code of Ethics for Civil Servants,  PP No. 53/2010 concerning Civil Servant Discipline, Law No. 5/2014 concerning State Civil Apparatus, and a circular letter from the Minister of State Apparatus Empowerment and Bureaucratic Reform No. 1 of 2023 concerning the Guidance and Supervision of Neutrality of Non-Civil Servants in the Implementation of General Elections and Elections. Conclusions: This study increases knowledge about the neutrality of state civil apparatuses in general elections based on Laws and Government Regulations. This study also provides information for policymakers to understand the neutrality of the State Civil Service in General Elections, so that democracy in Indonesia will improve. Limitations: This study only covers the neutrality of State Civil Apparatus in General Elections; Therefore, expanding the research to the Indonesian National Army and the Republic of Indonesia Police could produce comprehensive findings. Contribution: This study provides legal insights and policy recommendations to strengthen the neutrality of civil servants and support fair and democratic elections in Indonesia.

Abstract

The purpose of this study is to find out how the secret of oaths and their relevance to life values. Qasam in the Qur'an contained in juz 29 & 30, found as many as 18 surahs spread across 48 verses, in juz 29 there are 10 verses out of 5 surahs, and in juz 30 there are 38 verses out of 13 surahs. Of all the qasam verses that are collected from the oath of Allah are classified into 5 categories, including the oath of Allah with angels, celestial bodies, earth creatures, time and place, while in juz 29 it is found that one oath of Allah with the recitation of aiman and the one who is used as the muqsam bih is a polytheist, the oath of Allah in the Qur'an has secrets and important values, including the oath of Allah shows the majesty of the creator,  affirmation and reinforcement conveyed.
