Abstract

One of the most fundamental environmental problems is the deviation in the application of state administrative law. As a result, there are environmental problems experienced by the Awyu Tribe who are affected by the licence of an oil palm plantation company. Especially during the preparation of the Environmental impact assessment form State Administrative Decree did not provide participation to Awyu Tribe. Therefore, this research aims strengthen the role of administrative law in providing legal protection guarantees for the Awyu Tribe affected by oil palm plantation permits and the role of administrative court as downstream protection of the community by government actions. This research uses normative legal research methods with statutory and conceptual approaches and the analysis technique descriptive qualitative. The results showed that administrative law as basic foundation for issuance of state administrative decisions stipulated in Article 87 of Law No. 30/2014 must pay attention to impact of issuance of state administrative decisions, especially human rights. Judges judgments in the Awyu Tribe case tend to be positivistic and not progressive in favour private parties. Judges in deciding environmental cases also apply the values of the General Principles of Good Governance and community participation. In addition, laws and regulations on environmental protection and management are umbrella provisions that have not provided welfare for the Awyu people. The presence of administrative law should be able to provide public protection against environmental cases, because the two laws and regulations have continuity. Judges must be able to apply the value of both rules an effort to protect and prosper the community.

Abstract

Otorita Ibu Kota Nusantara merupakan lembaga baru yang dibentuk berdasarkan Undang-Undang No. 3 Tahun 2022 sebagaimana telah diperbarui dengan Undang-Undang No. 21 Tahun 2023 tentang Ibu Kota Negara. Otorita Ibu Kota Nusantara dipimpin oleh Kepala Otorita yang dipilih, diangkat, dan diberhentikan oleh presiden atas persetujuan DPR serta Kepala Otorita dalam kelembagaan setara dengan Kementerian. Terdapat permasalahan lembaga Otorita Ibu Kota Nusantara yaitu Kepala Otorita yang dipilih dan diberhentikan langsung oleh Presiden tidak mencerminkan asas otonomi daerah, yang mana status Ibu Kota Nusantara sebagai daerah otonomi khusus. Dengan demikian, peneliti mengangkat permasalahan bertujuan untuk meneliti kedudukan serta kewenangan Kepala Otorita berdasarkan perspektif otonomi daerah dan menjelaskan desain ideal kelembagaan Otorita Ibu Kota Nusantara perspektif otonomi daerah. Sehingga, metode penelitian yang digunakan yaitu metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian yang ditemukan adalah penyelenggaraan pemerintahan daerah di Ibu Kota Nusantara tidak mencerminkan otonomi daerah sebagaimana amanat konstitusi. Selanjutnya, desain kelembagaan Otorita Ibu Kota Nusantara tidak melibatkan Dewan Perwakilan Rakyat Daerah (DPRD) sebagai salah satu unsur dari otonomi daerah. Dengan demikian, perlunya kejelasan kedudukan Kepala Otorita dalam menyelenggarakan pemerintahan di Ibu Kota Nusantara dan perlunya asas desentralisasi dalam penyelenggaraan pemerintahan, karena berimplikasi dalam kewenangannya. Lebih lanjut, otonomi daerah sebagai desain yang ideal dalam penyusunan kelembagaan Ibu Kota Nusantara mengingat status dari Ibu Kota Nusantara yaitu otonomi khusus sebagaimana amanat UUD NRI 1945.

Abstract

This study aims to examine the following problems: First, how does the dissenting opinion influence the 2024 General Election Results Dispute decision on the Legitimacy of the Elected President-Vice President? Second, What are the implications of the dissenting opinion on the 2024 General Election Results Dispute decision on the legitimacy of the President-Vice President's office? This study uses a normative legal research method with a statutory regulatory approach and a conceptual approach. The analysis technique is descriptive qualitative, interpretative, and heuristic. The study of this research is the Dissenting Opinion by three Constitutional Court Judges in Decision Number 1/PHPU.PRES-XXII/2024 and Number 2/PHPU.PRES-XXII/2024. The results of the study indicate the influence of dissenting opinion on the legitimacy of the elected President and Vice President, for a good democratic society, a desired national ideal. In addition, interpreting the dissenting opinion regarding the General Election Results Dispute (Pemilu) as a reference for improving future elections to be better. The dissenting opinion in this case provides a new perspective and interpretation of the election contestation in Indonesia. One of the most fundamental causes of the 2024 presidential and vice-presidential election was the incumbent's irregularities or interference in the election agenda. Furthermore, concerns were raised regarding the lack of neutrality of state civil servants, the distribution of social assistance funds leading up to the election and during the campaign period, and political ethics. Consequently, an imbalance occurred in the presidential and vice-presidential nomination process, creating new problems in resolving the 2024 election dispute.

Abstract

This research aims to analyze to what extent business and human rights principles have been implemented to protect workers and laborers in Indonesia according to the gender perspective. This research employed a normative method by analyzing the norms set forth in international law synchronized with the provisions in the statute (statutory approach) in Indonesia descriptively and conceptually. The research concludes that Ruggie initiated business and human rights principles as a new concept regarding corporate responsibility to meet the development of human rights. The protection of human rights for workers, especially women, has not been sufficiently given. The management of the dimension of human rights in employment-related matters requires business relations and human rights with the concept of three pillars. First, the state is responsible for preventing violations of human rights. Second, corporations are responsible for respecting human rights. Third, this pillar manages access to the recovery of victims of human rights violations. Furthermore, the protection of workers and laborers is governed by an employment law that needs to be elaborated further by normalizing business and human rights principles in the employment sector.
