Abstract

The format for regulating new and renewable energy in the draft law on new and renewable energy in Indonesia still contains many polemics and problems. This is motivated by various problems of conception and substance in it, such as misconceptions about nomenclature, problems with institutional formats, licensing problems, and the accommodation of nuclear energy. This paper aims to analyze the potential impacts and prospects of energy using a green constitution point of view. This study used normative juridical research with a statutory and conceptual approach. The results show that the environment is the dominant entity affected by energy management and utilization activities, both fossil energy and new renewable energy with different potential impacts. The prospect of a green constitution has been contained in the draft law on new and renewable energy, but it cannot be realized optimally because transition policies in Indonesia still have dual orientations and overlapping arrangements. The principles of a green constitution can be a guiding concept and norm for the format of regulation and implementation of the use and utilization of new and renewable energy so that it is in line with the values ​​of environmental protection and preservation.

Abstract

Abstract Illegal mining is one of the problems in natural resource management in Indonesia. The enactment of Law Number 3 of 2020 concerning the Amendment to Law Number 4/2009 concerning Mineral and Coal Mining (UU No. 4/2009) further strengthens the concept of ecosystem protection, one of which is through reclamation and post-mining obligations. However, in the current law, there is confusion regarding the assignment of reclamation responsibility. The purpose of this paper is to examine how the concept of legal responsibility for illegal mining, and provide justification or consideration of the urgency of reclamation responsibility for illegal mining. This research employed a normative method and statutory, case, and conceptual approaches. The results of the study indicate that there is a legal vacuum in the current mining regulations regarding reclamation responsibility for illegal mining. The concept of responsibility for reclamation in Law no. 3/2020 is only charged to legal mining but does not cover illegal mining, causing many mine pits to be left unattended, and this situation has claimed many lives. Parties involved in Illegal mining in Indonesia should not only be burdened with liability but also environmental obligations or responsibilities in the form of reclamation and post-mining from illegal mining activities carried out. The first thing that can be done by the Government is to amend Law No. 3/2020 by expanding the concept of recovery responsibility to ensure that it can cover illegal mining. The imposition of reclamation responsibility for illegal mining is expected to provide maximum recovery for the ecosystem around the former mine.   Abstrak Pertambangan ilegal merupakan salah satu masalah dalam pengelolaan sumber daya alam di Indonesia. Lahirnya Undang-Undang Nomor 3 Tahun 2020 tentang Perubahan Atas Undang- Pertambangan Mineral dan Batubara sebelumnya (UU No. 4/2009) semakin memperkuat konsep perlindungan ekosistem salah satunya melalui kewajiban reklamasi dan pasca tambang. Akan tetapi, dalam aturan hukum saat ini terdapat kerancuan mengenai pembebanan tanggung jawab reklamasi. Tujuan penulisan ini adalah untuk mengkaji bagaimana konsep pertanggungjawaban hukum pertambangan ilegal, dan memberikan justifikasi atau pertimbangan urgensi tanggung jawab reklamasi untuk pertambangan ilegal. Metode penelitian dalam penelitian ini adalah penelitian normatif dengan pendekatan perundang-undangan, pendekatan kasus, dan konseptual. Hasil penelitian menunjukkan bahwa terdapat kekosongan hukum (legal vacuum) dalam aturan pertambangan saat ini mengenai tanggung jawab reklamasi bagi pertambangan ilegal. Konsep tanggung jawab reklamasi dalam UU No. 3/2020 hanya dibebankan kepada pertambangan legal namun tidak menjangkau pertambangan ilegal. Hal ini menyebabkan banyak lubang tambang yang dibiarkan yang merenggut banyak korban jiwa. Pelaku pertambangan ilegal di Indonesia seharusnya tidak hanya dibebani tanggung jawab pidana, melainkan kewajiban atau tanggung jawab lingkungan dalam bentuk reklamasi dan pasca tambang dari kegiatan tambang ilegal yang dilakukan. Hal pertama yang dapat dilakukan oleh Pemerintah adalah melakukan perubahan terhadap UU No. 3/2020 dengan memperluas konsep tanggung jawab pemulihan sehingga dapat juga menjangkau pertambangan ilegal. Pembebanan tanggung jawab reklamasi bagi pertambangan ilegal ini diharapkan dapat memberikan pemulihan yang maksimal bagi ekosistem sekitar bekas tambang.

Abstract

This study aims to analyse and identify the problem of plastic marine debris in Indonesia and in the ASEAN Frame. This research employed a normative approach involving the implementation of the ASEAN Framework, Law No. 32 of 2009 concerning Environmental Protection and management, based on the principle of sustainability. The government and the local Government's duties are to ensure that marine debris will be implemented in a good manner and based on environmentally sound management, as in line with Presidential Regulation No. 83 Year 2018 on Marine Debris Management.  This study also uses qualitative methods to explain and analyze the phenomena and social dynamics of marine plastic debris. The ASEAN framework involves the encouragement of the preparation of regional action plans to combat marine plastic debris. This is important, considering that the four ASEAN countries (Indonesia, Vietnam, Thailand, and the Philippines) are the largest producers of marine plastic debris in the world, while Indonesia is involved in every stage of environmental diplomacy in ASEAN.  The research results show that the measures taken by ASEAN range from the initiation stage to the implementation of the ASEAN Regional Action Plan to Combat Marine Debris in ASEAN Member States 2021 – 2025 including in Indonesia. Every state performs its own marine debris management, depending on the Area, population, mastery of technology and state budget. Abstrak Penelitian ini bertujuan untuk menganalisis dan mengidentifikasi permasalahan sampah plastik di laut di Indonesia dan dalam kerangka ASEAN. Metode penelitian yang digunakan adalah pendekatan normatif, peraturan perundang-undangan dengan mengimplementasikan Kerangka ASEAN, Undang-Undang Republik Indonesia No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup, berdasarkan prinsip keberlanjutan. Tugas Pemerintah dan Pemerintah Daerah adalah menjamin pengelolaan sampah laut dilaksanakan dengan baik dan berdasarkan pengelolaan yang berwawasan lingkungan, Peraturan Presiden Nomor 83 Tahun 2018 tentang Pengelolaan Sampah Laut. Penelitian ini juga menggunakan metode kualitatif untuk menjelaskan dan menganalisis fenomena, dinamika sosial sampah plastik di laut. Kerangka kerja ASEAN adalah dengan mendorong penyusunan rencana aksi regional untuk memerangi sampah plastik di laut. Hal ini penting karena keempat negara ASEAN (Indonesia, Vietnam, Thailand, Filipina) merupakan penghasil sampah plastik laut terbesar di dunia. Indonesia terlibat dalam setiap tahapan diplomasi lingkungan hidup di ASEAN. Hasil penelitian menunjukkan, Di ASEAN mulai dari tahap inisiasi hingga implementasi Rencana Aksi Regional ASEAN untuk Memerangi Sampah Laut di Negara Anggota ASEAN 2021 – 2025 termasuk di Indonesia. Dalam melaksanakan pengelolaan sampah laut tidak selalu sama di setiap Negara, terdapat empat unsur yang membedakannya tergantung pada Luas Wilayah, jumlah penduduk, penguasaan teknologi dan anggaran pendapatan Negara.

Abstract

Along with the threat of the climate crisis, countries in the world are starting to make efforts to mitigate and adapt to climate change. This commitment is outlined in the Earth Summit, Kyoto Protocol and even the Paris Agreement. One form of effort is to carry out carbon trading as an economic instrument in controlling climate change. In the course of its implementation, carbon trading can actually give rise to problems of conflict, evictions, violations of human rights, and even an increase in carbon emissions, especially for developing countries as carbon providers/carbon offsets. Thus, an assessment needs to be carried out to find out the source of the problem. This article aims to examine carbon trading policies in ASEAN countries in an effort to find comparisons as well as existing shortcomings or problems. The method used is normative legal research with a statutory approach and a comparative approach to examine differences in policies from each country. It is hoped that this article can provide a contribution in the form of an analytical picture and information that can help the government to continue to make improvements through economic instruments to control climate change.

Abstract

The legislative controversy over the Job Creation Law and its dynamics reached Law no. 6/2023 produces problematic norms. One of the problematic norms in the Employment cluster is Article 154A paragraph (1) letter m of the Law No. 6/2023 which regulates termination of employment if a worker experiences prolonged illness or disability due to a work accident. This article aims to review the conflict between these norms and other norms as well as legal protection measures for workers with disabilities due to work accidents. The research method used is normative legal research with a statutory and conceptual approach. The research results found that Article 154A paragraph (1) letter m of the Law No. 6/2023 conflicts or is disharmonious internally, horizontally and vertically with other regulations, such as the Employment Law (Law No. 13/2003), the Law on Persons with Disabilities (Law No. 8/2016), to the Indonesia Constitution 1945. The legal protection that can be carried out is first by making existing changes to the norms a quo and more repressive protection will probably be carried out because this regulation has come into effect, such as assistance, advocacy and providing free legal aid to workers with disabilities resulting from work accidents who have had their employment terminated.

Abstract

An ambitious project that aims to distribute government and economic centers more evenly in Indonesia. However, this development process faces significant challenges, one of which is related to its impact on indigenous communities inhabiting the area. This study identifies and analyzes the main problems that arise due to the development of the IKN, especially in terms of the existence and potential of indigenous peoples' rights. The research method used is normative legal research with a legislative and conceptual approach. The results of the study indicate that the rights of indigenous peoples that have been guaranteed by international and national legal instruments have been violated due to the development of the IKN. This is due to the minimal participation of Indigenous peoples in decision-making and the failure to fulfill the rights of Indigenous peoples in the IKN area, such as land rights and control of customary land, original rights, rights to develop and preserve customs, rights to recognition and protection of Indigenous peoples, and other rights. Amid the ongoing IKN development process, the government needs to take steps to restore and protect the rights of indigenous peoples. This research is expected to be part of that reference.

Abstract

The discussion of legal ideals Pancasila in Indonesia has become a prolonged discourse and may not be final. This is motivated by the dynamics and problems of the nation and state in various sectors of life, one of which is the environmental sector. This paper aims to examine the potential for developing legal ideals in the national environmental law system. The research method used is normative legal research. The results of the study show that in its implementation the legal ideals of Pancasila are still not running as they should in the environmental sector in Indonesia. This is because there are deviations in values ​​in the preparation of legal policies and action agendas. In the development of a national environmental law system, legal ideals cannot be seen and read explicitly, but must continue to be explored and interpreted in every Pancasila value. The ideals of Pancasila law contain environmental values such as ecological, ecoreligious, ecosocial, and ecocracy values. The legal ideals of Pancasila are positioned and functioned as a way of life, guiding norms, and critical norms in the legal agenda in the environmental sector

Abstract

Penggunaan kendaraan listrik berbasis baterai sebagai kendaraan dinas pemerintah telah menjadi fokus perhatian beberapa negara, termasuk Indonesia. Dalam upaya untuk mewujudkan tujuan tersebut, pemerintah akan melakukan pengadaan mobil dinas pemerintah berbasis baterai melalui Instruksi Presiden Nomor 7 Tahun 2022 tentang penggunaan Kendaraan Bermotor Listrik Berbasis Baterai (KBLBB). Namun, permasalahan yang timbul adalah apakah pemerintah telah memperhatikan aspek pengadaan berkelanjutan dalam percepatan penggunaan kendaraan dinas pemerintah berbasis baterai. Tulisan ini menganalisis secara yuridis mengenai kebijakan dan penerapan pemerintah dalam memperhatikan aspek pengadaan berkelanjutan terhadap pengadaan kendaraan dinas pemerintah khususnya mobil yang berbasis baterai. Metode yang digunakan adalan penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menemukan bahwa pengadaan kendaraan dinas pemerintah berbasis baterai dengan memperhatikan aspek pengadaan berkelanjutan merupakan cara melakukan transisi energi khususnya menurunkan polusi kendaraan bermotor. Meskipun demikian, kebijakan khusus pengembangan kendaraan listirk di Indonesia belum memadai, sehingga perlu dibentuk dan memperhatikan kesadaran penggunaan KBLBB dan rencana jangka panjang berbasis ekonomi berkelanjutan.

Abstract

One of the most fundamental environmental problems is the deviation in the application of state administrative law. As a result, there are environmental problems experienced by the Awyu Tribe who are affected by the licence of an oil palm plantation company. Especially during the preparation of the Environmental impact assessment form State Administrative Decree did not provide participation to Awyu Tribe. Therefore, this research aims strengthen the role of administrative law in providing legal protection guarantees for the Awyu Tribe affected by oil palm plantation permits and the role of administrative court as downstream protection of the community by government actions. This research uses normative legal research methods with statutory and conceptual approaches and the analysis technique descriptive qualitative. The results showed that administrative law as basic foundation for issuance of state administrative decisions stipulated in Article 87 of Law No. 30/2014 must pay attention to impact of issuance of state administrative decisions, especially human rights. Judges judgments in the Awyu Tribe case tend to be positivistic and not progressive in favour private parties. Judges in deciding environmental cases also apply the values of the General Principles of Good Governance and community participation. In addition, laws and regulations on environmental protection and management are umbrella provisions that have not provided welfare for the Awyu people. The presence of administrative law should be able to provide public protection against environmental cases, because the two laws and regulations have continuity. Judges must be able to apply the value of both rules an effort to protect and prosper the community.
