Abstract

Adol sende is a form of assurance that currently exists in rural and indigenous communities. Adol sende is implemented as an effort to fulfill people's life needs. But in practice, there is an extortion element in the implementation of adol sende because the object of guarantee is too long controlled by the creditor (controlled and used). This causes the debtor does not get the economic rights of the land which is used as the object of adol sende. In Article 7 of Act Number 56 Prp.1960 the government provides a limitation of the timing of adol sende implementation to overcome the extortion in farming practices. The purpose of this research is to know how to implement pawn transaction (adol sende) and constraints faced by people who live in Pentong Hamlet, Selorejo Subdistrict, Pundhong District, Bantul Regency in connection with the implementation of Article 7 of Law Number 56 Prp 1960. The research method is empirical sociology, research location is Pentong Hamlet, Selorejo Village, Pundhong District, Bantul Regency. The result of the research is the implementation of adol sende by the people of Pentong Hamlet, in relation to the implementation of Article 7 of Law Number 56 Prp 1960, there was no harmony. The Pentong community remains in their living law, where the implementation of adol sende is unlimited. The obstacles in the implementation of adol sende consists of 2 things, internal constraints because of ignorance of the community itself over the time limits set by the government. While external constraints exist in the absence of education in the form of socialization of the government against the provisions of Article 7 of Law Number 56 Prp 1960.

Abstract

Sengketa waris adalah sengketa kedua terbesar di Pengadilan Agama Kota Malang dan Pengadilan Agama Kabupaten Malang. Sengketa waris juga merupakan salah satu sengketa keperdataan yang kerap terjadi di Desa Sumbersekar. PKK Desa Sumbersekar melalui kegiatan konsultasi pada Program Masyarakat Peduli Perempuan, Ibu dan Anak (MADU PRIA), berupaya memberikan jasa konsultasi penyelesaian sengketa waris terutama waris Islam, mengingat mayoritas penduduk Desa Sumbersekar bergama Islam dan melakukan pembagian harta warisan berdasarkan Hukum Waris Islam adalah bentuk ketaatan kepada Allah SWT. Sayangnya, pengetahuan mengenai Hukum Waris Islam yang dimiliki kader PKK Desa Sumbersekar masih minim. Oleh karena itu, dibutuhkan penyuluhan hukum mengenai hukum waris Islam kepada para kader PKK Desa Sumbersekar.

Abstract

Social security is one of the basic rights of workers both local and migrant workers as stated on Art. 25 Universal Declaration of Human Rights. The enactment of single markets and production based in the era of ASEAN Economic Community inevitably brings migrant workers particularly in Indonesia and Singapore. This must be in line with a proper legal instruments to protect migrant workers? rights in a social security participation. This study aims to compare on how Indonesia and Singapore provide legal protection to migrant workers in the social security participation and what social security programs that can be followed in both countries. The research method used is a normative research method with a statute approach. The result of the study shows that Indonesia has provided protection for migrant workers the same way as local workers as stated on Art. 22 Universal Declaration of Human Rights, whereas Singapore only provides the social security to local workers. Migrant workers get the protection through other ways, namely insurance and bilateral/multilateral agreements. For the social security programs followed by migrant workers, both Indonesia and Singapore do not provide the programs related to what has been regulated on Art. 25 Universal Declaration of Human Rights.

Abstract

Koperasi Inatek adalah koperasi primer yang didirikan pada tahun 2018. Tujuan pendirian koperasi ini adalah peningkatan kesejahteraan mahasiswa dan alumi Prodi Teknik Informatika UMM dengan cara mendorong kemandirian ekonomi anggota koperasi melalui kewirausahaan berbasis teknologi. Kendala yang saat ini dihadapi adalah kebutuhan terhadap analisis dan revisi anggaran dasar, serta tidak adanya dokumen hukum penunjang kegiatan transaksi Koperasi Inatek yang meliputi naskah rumusan perjanjian jual beli dan perjanjian pemborongan pekerjaan yang sesuai dan tidak bertentangan dengan Pasal 1320 KUHPerdata. Metode yang digunakan adalah pengkapasitasan sistem nilai yang terdapat dalam teori community development. Hasilnya, terbentuk sejumlah dokumen yang dibutuhkan Koperasi Inatek, sebagaimana yang telah diidentifikasi di atas. Kesimpulan, dokumen hukum yang telah disusun, membantu Koperasi Inatek untuk menjalankan kegiatan bisnisnya karena dokumen tersebut dalam penyusunannya memperhatikan: 1) Peraturan perundangan yang berlaku seperti UU Perkoperasian, KUHPerdata, UU Ketenagakerjaan 2) Syarat sah perjanjian, 3) asas-asas dalam perjanjian, dan 4) unsur perjanjian.

Abstract

Kabupaten Malang adalah kabupaten di Jawa Timur dengan tingkat perkawinan usia anak tertinggi, berdasarkan hasil survey BKKBN. Secara legal formal, hal ini terjadi karena Pasal 7 (2) UU No.1/1974 tentang perkawinan mengatur batas minimum usia perkawinan, berada di usia anak. Saat ini, usia minimum perkawinan sudah direvisi melalui UU No.16/2019. Tujuan pengabdian adalah meningkatkan pemahaman perihal usia minimum perkaiwinan dan dampak negative perkawinan usia anak, melalui kegiatan sosialiasi. Hasil sosialisasi, melalui indikator selisih nilai antara pretest dan postest menunjukan adanya penambahan tingkat pemahaman sebanyak 28%.

Abstract

Era industri 4.0 mendukung perkembangan sistem bekerja secara Remote Working. Dengan berbagai sistem yang ada, hubungan kerja yang timbul antara Pemberi kerja dan Pekerja dimulai dengan adanya Perjanjian Kerja. Secara fakta, Perjanjian kerja yang seringkali memgalami permasalahan di Indonesia adalah PKWT. Remote working dalam PKWT yang dilakukan melalui media elektronik tentunya harus dilihat dari berbagai aspek hukum, yaitu: KUHPerdata, UU Ketenagakerjaan dan UU Cipta Kerja sebagai pembaharuannya, serta UU ITE. Oleh karena itu, penulisan ini akan menguraikan beberapa hal yaitu: Pertama, bagaimana pola PKWTdengan konsep Remote Working dalam prespektif UU Cipta Kerja?; Kedua, bagaimana keabsahan PKWTdengan konsep remote working dalam prespektif UU Cipta Kerja?. Dengan menggunakan metode penelitian yuridis normatif dapat diuraikan bahwa PKWT dengan konsep remote working pada prinsipnya jg harus tunduk pada UU Ketenagakerjaan dan UU Cipta Kerja. Selain itu, terdapat beberapa aspek hukum yang harus diperhatikan oleh para pihak dalam perjanjian kerja sehingga keabsahan perjanjian kerja dapat terpenuhi dan dapat melindungi hak dan kewajiban masing-masing pihak.

Abstract

The application of the online learning system during the COVID-19 pandemic has caused problems related to learning methods that require adequate facilities that not all students have. In addition, the community also feels that this method is not optimal for students, especially elementary school students who find it difficult to accept online learning which also due to heaps of works to replace the material students can use. The purpose of this paper is to see that the study at the home policy is the right government action to take in accordance with the legal protection mandated by Law No. 35 of 2014 concerning Amendments to Law No. 23 of 2002 concerning Child Protection to continue on carrying out the learning process so that the world of education is not paralyzed due to the spread of COVID-19. The purpose of this study is to examine the study at the home policy as a guarantee of legal protection mandated by Law No. 35 of 2014 concerning Amendments to Law No. 23 of 2002 concerning Child Protection. The method used in this study is the normative method. The outcomes show that online learning policies are the best solution and are in line with the principles of legal protection for children's rights in Indonesia, especially regarding the right to be safe from harm, to be kept away from disease, and the right to live and develop.
